  1  1    Section 1.  Section 622B.4, Code 1995, is amended to read
  1  2 as follows:
  1  3    622B.4  LIST.
  1  4    The division of deaf services of the department of human
  1  5 rights shall prepare and continually update a listing of
  1  6 qualified and available interpreters.  The courts and
  1  7 administrative agencies shall maintain a directory of
  1  8 qualified interpreters for deaf and hard-of-hearing persons as
  1  9 furnished by the department of human rights.  The division of
  1 10 deaf services shall maintain information on the qualifications
  1 11 a list of interpreters, which information is confidential
  1 12 except which shall be made available to a court,
  1 13 administrative agency, or interested parties to an action
  1 14 using the services of an interpreter.  
  1 15                           EXPLANATION
  1 16    This bill provides that the list of qualified and available
  1 17 interpreters maintained by the deaf services division of the
  1 18 department of human rights will be considered nonconfidential
  1 19 information.  This information has previously been regarded as
  1 20 confidential except when provided to a court, administrative
  1 21 agency, or interested parties to an action using the services
  1 22 of an interpreter.  
  1 23                      BACKGROUND STATEMENT
  1 24                     SUBMITTED BY THE AGENCY
  1 25    The deaf services commission of Iowa (DSCI) provides a list
  1 26 of qualified interpreters to the courts, administrative
  1 27 agencies, or to any interested parties to an action using the
  1 28 services of an interpreter.  In preparing this list, DSCI
  1 29 informs parties how this information will be used and receives
  1 30 permission from each interpreter before adding their name to
  1 31 the list.  Stating that the information is confidential is not
  1 32 necessary when such practices ensure the informed use of the
  1 33 personal data.  Therefore, the commission saw this as an
  1 34 oversight in terms of the information being deemed
  1 35 confidential when in fact it is public.
