1 1 Section 1. Section 124.210, subsection 5, Code 1995, is
1 2 amended by adding the following new paragraph and relettering
1 3 the subsequent paragraphs:
1 4 NEW PARAGRAPH. c. Ephedrine.
1 5 EXPLANATION
1 6 This bill provides for the designation of the drug
1 7 ephedrine as a schedule IV controlled substance. As such,
1 8 manufacturing, distributing, or dispensing ephedrine is
1 9 subject to the registration requirements of Iowa Code section
1 10 124.302. The unauthorized manufacturing, delivery, or
1 11 possession of ephedrine will constitute an aggravated
1 12 misdemeanor pursuant to section 124.401, subsection 1,
1 13 paragraph "d".
1 14 BACKGROUND STATEMENT
1 15 SUBMITTED BY THE AGENCY
1 16 On October 30, 1995, the Iowa methamphetamine awareness
1 17 campaign, conducted by the governor's alliance on substance
1 18 abuse, identified concerns about the availability of certain
1 19 substances used to make methamphetamine, such as "ephedrine".
1 20 Ephedrine is a chemical precursor for amphetamines and is the
1 21 preferred precursor for the clandestine production of
1 22 methamphetamine (speed) and methcathinone (cat). In addition,
1 23 ephedrine's stimulant properties have made the drug a desired
1 24 "upper" that can currently be easily obtained over-the-counter
1 25 in Iowa. It has been well demonstrated that the nonmedically
1 26 supervised use of ephedrine and its salts and isomers is
1 27 potentially hazardous. Ephedrine's increasing abuse and
1 28 illicit use have prompted legislation in 15 other states to
1 29 control its sale and distribution. The states of Missouri and
1 30 Wisconsin have classified ephedrine as a schedule IV
1 31 controlled substance.
1 32 This bill designates the drug "ephedrine" (products
1 33 containing ephedrine only and ephedrine-combination products)
1 34 as a schedule IV controlled substance and thereby makes it
1 35 available to consumers only on the prescription of an
2 1 authorized, prescribing practitioner. This will reduce its
2 2 abuse as a stimulant and its illicit use as a precursor for
2 3 the clandestine production of methamphetamine and
2 4 methcathinone.
