  1  1    Section 1.  Section 372.4, unnumbered paragraph 3, Code
  1  2 1995, is amended to read as follows:
  1  3    The mayor shall appoint a council member as mayor pro tem,
  1  4 and.  The mayor shall appoint the marshal or chief of police,
  1  5 subject to confirmation by the city council, except where an
  1  6 intergovernmental agreement makes other provisions for police
  1  7 protection or as otherwise provided in section 400.13.  Other
  1  8 officers must be selected as directed by the council.  The
  1  9 mayor is not a member of the council and may not vote as a
  1 10 member of the council.  
  1 11                           EXPLANATION
  1 12    This bill provides that the appointment of a marshal or
  1 13 chief of police by the mayor in a city which is not under
  1 14 civil service or a chapter 28E agreement is subject to
  1 15 confirmation by the city council.
