1 1 Section 1. Section 257.31, Code 1995, is amended by adding
1 2 the following new subsection:
1 3 NEW SUBSECTION. 17. a. If a district's average
1 4 transportation costs per pupil exceed the state average
1 5 transportation costs per pupil determined under paragraph "b"
1 6 by one hundred fifty percent, the committee may grant
1 7 transportation assistance aid to the district. Such aid shall
1 8 be miscellaneous income and shall not be included in district
1 9 cost.
1 10 b. To be eligible for transportation assistance aid, a
1 11 school district shall annually certify its actual cost for all
1 12 children transported in all school buses not later than July
1 13 31 after each school year on forms prescribed by the
1 14 committee.
1 15 c. A district's average transportation costs per pupil
1 16 shall be determined by dividing the district's actual cost for
1 17 all children transported in all school buses for a school year
1 18 pursuant to section 285.1, subsection 12, less the amount
1 19 received for transporting nonpublic school pupils under
1 20 section 285.1, by the district's actual enrollment for the
1 21 school year excluding the shared-time enrollment for the
1 22 school year as defined in section 257.6. The state average
1 23 transportation costs per pupil shall be determined by dividing
1 24 the total actual costs for all children transported in all
1 25 districts for a school year, by the total of all districts'
1 26 actual enrollments for the school year.
1 27 d. Funds transferred to the committee in accordance with
1 28 section 321.34, subsection 18, are appropriated to and may be
1 29 expended for the purposes of the committee, as described in
1 30 this section. However, highest priority shall be given to
1 31 districts that meet the conditions described in this
1 32 subsection. Notwithstanding any other provision of the Code,
1 33 unencumbered or unobligated funds transferred to the committee
1 34 pursuant to section 321.34, subsection 18, remaining on June
1 35 30 of the fiscal year for which the funds were transferred,
2 1 shall not revert but shall be available for expenditure for
2 2 the purposes of this subsection in subsequent fiscal years.
2 3 Sec. 2. Section 321.34, Code Supplement 1995, is amended
2 4 by adding the following new subsection:
2 5 NEW SUBSECTION. 18. EDUCATION PLATES.
2 6 a. Upon application and payment of the proper fees, the
2 7 director may issue education plates to the owner of a motor
2 8 vehicle subject to registration under section 321.109,
2 9 subsection 1, light delivery truck, panel delivery truck,
2 10 pickup, motor home, multipurpose vehicle, or travel trailer.
2 11 b. Education plates shall be designed by the department in
2 12 cooperation with the department of education.
2 13 c. The special school transportation fee for letter number
2 14 designated education plates is thirty-five dollars. The fee
2 15 for personalized education plates is twenty-five dollars,
2 16 which shall be paid in addition to the special school
2 17 transportation fee of thirty-five dollars. The fees collected
2 18 by the director under this subsection shall be paid monthly to
2 19 the treasurer of state and credited to the road use tax fund.
2 20 Notwithstanding section 423.24, and prior to the crediting of
2 21 revenues to the road use tax fund under section 423.24,
2 22 subsection 1, paragraph "d", the treasurer of state shall
2 23 transfer monthly from those revenues to the school budget
2 24 review committee in accordance with section 257.31, subsection
2 25 16, the amount of the special school transportation fees
2 26 collected in the previous month for the education plates.
2 27 d. Upon receipt of the special registration plates, the
2 28 applicant shall surrender the current registration receipt and
2 29 plates to the county treasurer. The county treasurer shall
2 30 validate the special registration plates in the same manner as
2 31 regular registration plates are validated under this section.
2 32 The annual special school transportation fee for letter number
2 33 designated plates is ten dollars, which shall be paid in
2 34 addition to the regular annual registration fee. The annual
2 35 fee for personalized education plates is five dollars, which
3 1 shall be paid in addition to the annual special school
3 2 transportation fee and the regular annual registration fee.
3 3 The annual special school transportation fee shall be credited
3 4 as provided under paragraph "c".
3 5 Sec. 3. EFFECTIVE DATE. This Act takes effect on January
3 6 1, 1997.
3 7 EXPLANATION
3 8 This bill provides for the issuance of special license
3 9 plates for education and for the transfer of special license
3 10 plates for education revenues to the school budget review
3 11 committee.
3 12 The bill requires the payment of additional fees for the
3 13 special plate as well as additional fees for subsequent
3 14 renewal of the registration of the vehicle with the special
3 15 plate. The additional fees collected for the special plate
3 16 shall be transferred to the school budget review committee,
3 17 which may use the funds for the purposes of the committee.
3 18 However, the committee shall give highest priority in granting
3 19 funds derived from the education license plate revenue to
3 20 school districts whose average transportation costs per pupil
3 21 exceed the state average transportation costs per pupil by one
3 22 hundred fifty percent.
3 23 The special school transportation fee for letter number
3 24 designated education plates is $35. An additional fee of $25
3 25 is assessed for personalized education plates. The annual
3 26 special school transportation fee for letter number designated
3 27 plates is $10, paid in addition to the regular annual
3 28 registration fee. The annual fee for personalized education
3 29 plates is $5, paid in addition to the annual special school
3 30 transportation fee and the regular annual registration fee.
3 31 The bill takes effect on January 1, 1997.
