PAG LIN
  1  1    Section 1.  APPOINTED STATE OFFICERS.  The governor shall
  1  2 establish a salary for appointed nonelected persons in the
  1  3 executive branch of state government holding a position
  1  4 enumerated in section 2 of this Act within the range provided,
  1  5 by considering, among other items, the experience of the
  1  6 individual in the position, changes in the duties of the
  1  7 position, the incumbent's performance of assigned duties, and
  1  8 subordinates' salaries.  However, the attorney general shall
  1  9 establish the salary for the consumer advocate, the chief
  1 10 justice of the state supreme court shall establish the salary
  1 11 for the state court administrator, and the state fair board
  1 12 shall establish the salary of the secretary of the state fair
  1 13 board, each within the salary range provided in section 2 of
  1 14 this Act.
  1 15    The governor, in establishing salaries as provided in
  1 16 section 2 of this Act, shall take into consideration other
  1 17 employee benefits which may be provided for an individual
  1 18 including, but not limited to, housing.
  1 19    A person whose salary is established pursuant to section 5
  1 20 of this Act and who is a full-time permanent employee of the
  1 21 state shall not receive any other remuneration from the state
  1 22 or from any other source for the performance of that person's
  1 23 duties unless the additional remuneration is first approved by
  1 24 the governor or authorized by law.  However, this provision
  1 25 does not exclude the reimbursement for necessary travel and
  1 26 expenses incurred in the performance of duties or fringe
  1 27 benefits normally provided to employees of the state.
  1 28    Sec. 2.  STATE OFFICERS &endash; SALARY RATES AND RANGES.  The
  1 29 following annual salary ranges are effective for the positions
  1 30 specified in this section for the fiscal year beginning July
  1 31 1, 1995, with the pay period beginning June 30, 1995, and for
  1 32 subsequent fiscal years until otherwise provided by the
  1 33 general assembly.  The governor or other person designated in
  1 34 section 4 of this Act shall determine the salary to be paid to
  1 35 the person indicated at a rate within the salary ranges
  2  1 indicated from funds appropriated by the general assembly for
  2  2 that purpose.
  2  3    1.  The following are salary ranges 1 through 5:

  2 10    2.  The following are range 1 positions:  There are no
  2 11 range 1 positions.
  2 12    3.  The following are range 2 positions:  administrator of
  2 13 the arts division of the department of cultural affairs,
  2 14 administrators of the division of persons with disabilities,
  2 15 the division on the status of women, the division on the
  2 16 status of African-Americans, the division for deaf services,
  2 17 and the division of Latino affairs of the department of human
  2 18 rights, administrator of the division of professional
  2 19 licensing and regulation of the department of commerce,
  2 20 executive director of the commission of veterans affairs, and
  2 21 administrator of the division of emergency management of the
  2 22 department of public defense.
  2 23    4.  The following are range 3 positions:  administrator of
  2 24 criminal and juvenile justice planning of the department of
  2 25 human rights, administrator of the division of community
  2 26 action agencies of the department of human rights, and
  2 27 chairperson and members of the employment appeal board of the
  2 28 department of inspections and appeals.
  2 29    5.  The following are range 4 positions:  superintendent of
  2 30 banking, superintendent of credit unions, drug abuse
  2 31 prevention coordinator, administrator of the alcoholic
  2 32 beverages division of the department of commerce, state public
  2 33 defender, and chairperson and members of the board of parole.
  2 34    6.  The following are range 5 positions:  consumer
  2 35 advocate, job service commissioner, labor commissioner,
  3  1 industrial commissioner, administrator of the historical
  3  2 division of the department of cultural affairs, administrator
  3  3 of the public broadcasting division of the department of
  3  4 education, the administrator of the state racing and gaming
  3  5 commission of the department of inspections and appeals,
  3  6 commandant of the veterans home, and secretary of the state
  3  7 fair board.
  3  8    7.  The following are salary ranges 6 through 9:

  3 14    8.  The following are range 6 positions:  director of the
  3 15 department of human rights, director of the Iowa state civil
  3 16 rights commission, executive director of the college student
  3 17 aid commission, director of the department for the blind, and
  3 18 executive secretary of the ethics and campaign disclosure
  3 19 board.
  3 20    9.  The following are range 7 positions:  director of the
  3 21 department of cultural affairs, director of the department of
  3 22 personnel, director of public health, executive director of
  3 23 the department of elder affairs, commissioner of public
  3 24 safety, director of the department of general services,
  3 25 director of the department of commerce, director of the law
  3 26 enforcement academy, and director of the department of
  3 27 inspections and appeals.
  3 28    10.  The following are range 8 positions:  commissioner of
  3 29 insurance, executive director of the Iowa finance authority,
  3 30 director of revenue and finance, director of the department of
  3 31 natural resources, director of the department of corrections,
  3 32 director of the department of employment services, and
  3 33 chairperson of the utilities board.  The other members of the
  3 34 utilities board shall receive an annual salary within a range
  3 35 of not less than ninety percent but not more than ninety-five
  4  1 percent of the annual salary of the chairperson of the
  4  2 utilities board.
  4  3    11.  The following are range 9 positions:  director of the
  4  4 department of education, director of human services, director
  4  5 of the department of economic development, executive director
  4  6 of the state board of regents, director of the state
  4  7 department of transportation, lottery commissioner, the state
  4  8 court administrator, and the director of the department of
  4  9 management.
  4 10    Sec. 3.  PUBLIC EMPLOYMENT RELATIONS BOARD.
  4 11    1.  The salary rates specified in this section are
  4 12 effective for the fiscal year beginning July 1, 1995, with the
  4 13 pay period beginning June 30, 1995, and for subsequent fiscal
  4 14 years until otherwise provided by the general assembly.  The
  4 15 salaries provided for in this section shall be paid from funds
  4 16 appropriated to the public employment relations board from the
  4 17 salary adjustment fund, or if the appropriation is not
  4 18 sufficient from funds appropriated to the public employment
  4 19 relations board pursuant to any other Act of the general
  4 20 assembly.
  4 21    2.  The following annual salary rates shall be paid to the
  4 22 persons holding the positions indicated:
  4 23    a.  Chairperson of the public employment relations board:  
  4 24 .................................................. $     59,600
  4 25    b.  Two members of the public employment relations board:  
  4 26 .................................................. $     55,400
  4 27    Sec. 4.  COLLECTIVE BARGAINING AGREEMENTS FUNDED &endash; GENERAL
  4 28 FUND.  There is appropriated from the general fund of the
  4 29 state to the salary adjustment fund for the fiscal year
  4 30 beginning July 1, 1995, and ending June 30, 1996, for
  4 31 distribution by the department of management to the various
  4 32 state departments, boards, commissions, councils, and
  4 33 agencies, including the state board of regents, the amount of
  4 34 $34,700,000, or so much thereof as may be necessary, to fully
  4 35 fund the following annual pay adjustments, expense
  5  1 reimbursements, and related benefits:
  5  2    1.  The collective bargaining agreement negotiated pursuant
  5  3 to chapter 20 for employees in the blue collar bargaining
  5  4 unit.
  5  5    2.  The collective bargaining agreement negotiated pursuant
  5  6 to chapter 20 for employees in the public safety bargaining
  5  7 unit.
  5  8    3.  The collective bargaining agreement negotiated pursuant
  5  9 to chapter 20 for employees in the security bargaining unit.
  5 10    4.  The collective bargaining agreement negotiated pursuant
  5 11 to chapter 20 for employees in the technical bargaining unit.
  5 12    5.  The collective bargaining agreement negotiated pursuant
  5 13 to chapter 20 for employees in the professional fiscal and
  5 14 staff bargaining unit.
  5 15    6.  The collective bargaining agreement negotiated pursuant
  5 16 to chapter 20 for employees in the university of northern Iowa
  5 17 faculty bargaining unit.
  5 18    7.  The collective bargaining agreement negotiated pursuant
  5 19 to chapter 20 for employees in the clerical bargaining unit.
  5 20    8.  The collective bargaining agreement negotiated pursuant
  5 21 to chapter 20 for employees in the professional social
  5 22 services bargaining unit.
  5 23    9.  The collective bargaining agreement negotiated pursuant
  5 24 to chapter 20 for employees in the community-based corrections
  5 25 bargaining unit.
  5 26    10.  The collective bargaining agreement negotiated
  5 27 pursuant to chapter 20 for employees in the judicial branch of
  5 28 government bargaining unit.
  5 29    11.  The collective bargaining agreement negotiated
  5 30 pursuant to chapter 20 for employees in the patient care
  5 31 bargaining unit.
  5 32    12.  The collective bargaining agreement negotiated
  5 33 pursuant to chapter 20 for employees in the science bargaining
  5 34 unit.
  5 35    13.  The annual pay adjustments, related benefits, and
  6  1 expense reimbursements referred to in sections 5 and 6 of this
  6  2 Act for employees not covered by a collective bargaining
  6  3 agreement.
  6  4    Sec. 5.  NONCONTRACT STATE EMPLOYEES &endash; GENERAL.
  6  5    1.  a.  For the fiscal year beginning July 1, 1995, the
  6  6 maximum salary levels of all pay plans provided for in section
  6  7 19A.9, subsection 2, as they exist for the fiscal year ending
  6  8 June 30, 1995, shall be increased by 3 percent for the pay
  6  9 period beginning June 30, 1995.
  6 10    b.  In addition to the increases specified in this
  6 11 subsection, for the fiscal year beginning July 1, 1995,
  6 12 employees may receive a merit increase or the equivalent of a
  6 13 merit increase.
  6 14    2.  The pay plans for state employees who are exempt from
  6 15 chapter 19A and who are included in the department of revenue
  6 16 and finance's centralized payroll system shall be increased in
  6 17 the same manner as provided in subsection 1.
  6 18    3.  This section does not apply to members of the general
  6 19 assembly, board members, commission members, salaries of
  6 20 persons set by the general assembly pursuant to this Act, or
  6 21 set by the governor, employees designated under section 19A.3,
  6 22 subsection 5, and employees covered by 581 IAC 4.5(17).
  6 23    4.  The pay plans for the bargaining eligible employees of
  6 24 the state shall be increased in the same manner as provided in
  6 25 subsection 1.  As used in this section, "bargaining eligible
  6 26 employee" means an employee who is eligible to organize under
  6 27 chapter 20, but has not done so.
  6 28    5.  The policies for implementation of this section shall
  6 29 be approved by the governor.
  6 30    Sec. 6.  STATE EMPLOYEES &endash; STATE BOARD OF REGENTS.  Funds
  6 31 from the appropriation in section 4 of this Act shall be
  6 32 allocated to the state board of regents for the purposes of
  6 33 providing increases for state board of regents employees
  6 34 covered by section 4 of this Act and for employees not covered
  6 35 by a collective bargaining agreement as follows:
  7  1    1.  For regents merit system employees to fund for the
  7  2 fiscal year beginning July 1, 1995, increases comparable to
  7  3 those provided for similar contract-covered employees in this
  7  4 Act.
  7  5    2.  For faculty members and professional and scientific
  7  6 employees to fund for the fiscal year beginning July 1, 1995,
  7  7 percentage increases comparable to those provided for
  7  8 contract-covered employees in section 4, subsection 6, of this
  7  9 Act.
  7 10    Sec. 7.  APPROPRIATIONS FROM ROAD FUNDS.
  7 11    1.  There is appropriated from the road use tax fund to the
  7 12 salary adjustment fund for the fiscal year beginning July 1,
  7 13 1995, and ending June 30, 1996, the following amount, or so
  7 14 much thereof as may be necessary, to be used for the purpose
  7 15 designated:
  7 16    To supplement other funds appropriated by the general
  7 17 assembly:  
  7 18 .................................................. $  1,246,687
  7 19    2.  There is appropriated from the primary road fund to the
  7 20 salary adjustment fund, for the fiscal year beginning July 1,
  7 21 1995, and ending June 30, 1996, the following amount, or so
  7 22 much thereof as may be necessary, to be used for the purpose
  7 23 designated:
  7 24    To supplement other funds appropriated by the general
  7 25 assembly:  
  7 26 .................................................. $  3,055,214
  7 27    3.  Except as otherwise provided in this Act, the amounts
  7 28 appropriated in subsections 1 and 2 shall be used to fund the
  7 29 annual pay adjustments, expense reimbursements, and related
  7 30 benefits for public employees as provided in this Act.
  7 31    Sec. 8.  SPECIAL FUNDS &endash; AUTHORIZATION.  To departmental
  7 32 revolving, trust, or special funds, except for the primary
  7 33 road fund or the road use tax fund, for which the general
  7 34 assembly has established an operating budget, a supplemental
  7 35 expenditure authorization is provided, unless otherwise
  8  1 provided, in an amount necessary to fund salary adjustments as
  8  2 otherwise provided in this Act.
  8  3    Sec. 9.  GENERAL FUND SALARY MONEYS.  Funds appropriated
  8  4 from the general fund of the state in this Act relate only to
  8  5 salaries supported from general fund appropriations of the
  8  6 state except for employees of the state board of regents.
  8  7 However, it is the intent of the general assembly that this
  8  8 section shall apply to all state employees commencing with the
  8  9 fiscal year beginning July 1, 1996, and ending June 30, 1997.
  8 10 The department of management and the legislative fiscal bureau
  8 11 shall prepare a plan to implement this section for all state
  8 12 employees not later than February 1, 1996.
  8 13    Sec. 10.  FEDERAL FUNDS APPROPRIATED.  All federal grants
  8 14 to and the federal receipts of the agencies affected by this
  8 15 Act which are received and may be expended for purposes of
  8 16 this Act are appropriated for those purposes and as set forth
  8 17 in the federal grants or receipts.
  8 18    Sec. 11.  Section 7G.1, subsection 8, paragraph a, Code
  8 19 1995, is amended to read as follows:
  8 20    a.  The commission may employ personnel, including an
  8 21 executive director whose salary shall not exceed executive
  8 22 branch pay grade classification 35 40, to administer its
  8 23 programs and services.  The personnel shall be considered
  8 24 state employees.  
  8 25                           EXPLANATION
  8 26    This bill relates to and appropriates moneys to fund salary
  8 27 adjustments for appointed nonelected officers, employees
  8 28 subject to collective bargaining agreements, and noncontract
  8 29 employees.
  8 30    Appointed nonelected state officers and state employees,
  8 31 except the officers and employees of the state board of
  8 32 regents, will receive a 3 percent increase with the pay period
  8 33 beginning June 30, 1995.  If eligible, the state employees may
  8 34 also receive merit step increases.
  8 35    Salary ranges for appointed state officers are increased by
  9  1 approximately 3 percent.
  9  2    The state board of regents officers and employees not under
  9  3 collective bargaining receive similar pay increases to the
  9  4 regents contract employees.
  9  5    The bill funds the salary adjustments for the fiscal year
  9  6 beginning July 1, 1995.
  9  7    The bill increases the maximum amount that may be paid the
  9  8 executive director of the state sesquicentennial commission.
