There is appropriated from the general fund of the 6 33 state to the college student aid commission for the fiscal 6 34 year beginning July 1, 1995, and ending June 30, 1996, the 6 35 following amounts, or so much thereof as may be necessary, to 7 1 be used for the purposes designated: 7 2 1. FTEs 7.05 7 8 From the moneys appropriated in this subsection, $15,000 7 9 for the fiscal year beginning July 1, 1995, and ending June 7 10 30, 1996, shall be expended to provide grants to students who 7 11 would meet the requirements for receipt of a vocational- 7 12 technical tuition grant, but who are enrolled in a licensed 7 13 school of cosmetology arts and sciences under chapter 157, or 7 14 a licensed barber school under chapter 158. The amount of the 7 15 grant made by the college student aid commission pursuant to 7 16 this subsection shall be not less than $300 or the amount of 7 17 the student's established financial need. 7 18 2. UNIVERSITY OF OSTEOPATHIC MEDICINE AND HEALTH SCIENCES 7 19 a. For forgivable loans to Iowa students attending the 7 20 university of osteopathic medicine and health sciences, under 7 21 the forgivable loan program pursuant to section 261.19A: 7 22 .................................................. $ 379,260 7 23 b. For the university of osteopathic medicine and health 7 24 sciences for an initiative in primary health care to direct 7 25 primary care physicians to shortage areas in the state: 7 26 .................................................. $ 425,000 7 27 The moneys appropriated in this lettered paragraph shall be 7 28 used as follows: 7 29 (1) To reduce student loan debt for primary care 7 30 physicians in an amount not to exceed $30,000 per student for 7 31 a four-year period of medical service in medically underserved 7 32 areas of the state. 7 33 (2) For tuition scholarships for students attending the 7 34 university of osteopathic medicine and health sciences who 7 35 agree to practice primary care medicine in medically 8 1 underserved areas of the state. The student shall practice in 8 2 the state two years for every year of tuition. A person 8 3 receiving funds under this subparagraph shall not be eligible 8 4 for funds under subparagraph (1). 8 5 (3) For general administration costs of the university for 8 6 the primary care initiative, the university shall expend an 8 7 amount not to exceed $50,000. 8 8 The university of osteopathic medicine and health sciences 8 9 shall report quarterly to the legislative fiscal bureau 8 10 concerning the expenditure of funds used pursuant to 8 11 subparagraphs (1), (2), and (3) of this lettered paragraph. 8 12 The university shall also submit the annual audit of the 8 13 university to the legislative fiscal bureau within six months 8 14 following the year being audited. The college student aid 8 15 commission shall not provide moneys for subparagraphs (1) and 8 16 (2) of this lettered paragraph until the university has signed 8 17 and submitted contracts for the use of these moneys for 8 18 reduction of student loan debt and tuition scholarships. 8 19 Funds for subparagraph (3) of this lettered paragraph shall be 8 20 provided quarterly to the university. Notwithstanding section 8 21 8.33, the funds for this lettered paragraph shall not revert 8 22 to the general fund but be available for expenditure the 8 23 following fiscal year for purposes of subparagraphs (1) and 8 24 (2). 8 25 3. STUDENT AID PROGRAMS 8 26 For payments to students for student aid programs: 8 27 .................................................. $ 1,469,790 8 28 From the moneys appropriated in this subsection, $1,397,790 8 29 for the fiscal year beginning July 1, 1995, and ending June 8 30 30, 1996, shall be expended for an Iowa grant program, with 8 31 funds to be allocated to institutions pursuant to section 8 32 261.93A. The remainder shall be allocated for the graduate 8 33 student financial assistance program. 8 34 Sec. 5. FTEs 5,780.87 11 3 The university of Iowa hospitals and clinics shall submit 11 4 quarterly a report regarding the portion of the appropriation 11 5 in this lettered paragraph expended on general support in a 11 6 format required by the legislative fiscal bureau and 11 7 department of management which delineates the expenditures and 11 8 purposes of the funds. 11 9 Funds appropriated in this lettered paragraph shall not be 11 10 used to perform abortions except medically necessary 11 11 abortions, and shall not be used to operate the early 11 12 termination of pregnancy clinic except for the performance of 11 13 medically necessary abortions. For the purpose of this 11 14 lettered paragraph, an abortion is the purposeful interruption 11 15 of pregnancy with the intention other than to produce a live- 11 16 born infant or to remove a dead fetus, and a medically 11 17 necessary abortion is one performed under one of the following 11 18 conditions: 11 19 (1) The attending physician certifies that continuing the 11 20 pregnancy would endanger the life of the pregnant woman. 11 21 (2) The attending physician certifies that the fetus is 11 22 physically deformed, mentally deficient, or afflicted with a 11 23 congenital illness. 11 24 (3) The pregnancy is the result of a rape which is 11 25 reported within 45 days of the incident to a law enforcement 11 26 agency or public or private health agency which may include a 11 27 family physician. 11 28 (4) The pregnancy is the result of incest which is 11 29 reported within 150 days of the incident to a law enforcement 11 30 agency or public or private health agency which may include a 11 31 family physician. 11 32 (5) The abortion is a spontaneous abortion, commonly known 11 33 as a miscarriage, wherein not all of the products of 11 34 conception are expelled. 11 35 The total quota allocated to the counties for indigent 12 1 patients for the fiscal year beginning July 1, 1995, shall not 12 2 be lower than the total quota allocated to the counties for 12 3 the fiscal year commencing July 1, 1994. The total quota 12 4 shall be allocated among the counties on the basis of the 1990 12 5 census pursuant to section 255.16. 12 6 d. It is further the 14 12 intent of the general assembly to provide funding in fiscal 14 13 years beginning July 1, 1996, and July 1, 1997, in the total 14 14 amount of $5.35 million for the construction of the facility 14 15 to house the national advanced driving simulator to match 14 16 federal funds provided for the project. Funds provided for 14 17 the construction of the facility to house the national 14 18 advanced driving simulator in fiscal years beginning July 1, 14 19 1996, and July 1, 1997, shall only be expended upon receiving 14 20 notification from the national highway traffic safety 14 21 administration that the United States congress has authorized 14 22 the construction of the national advanced driving simulator, 14 23 that federal funds have been appropriated to begin 14 24 construction, and that delivery of the motion base, graphics 14 25 system, and integrating software will take place in 14 26 substantial compliance with the United States department of 14 27 transportation's acquisition schedule as set forth in the 14 28 cooperative agreement between the state university of Iowa and 14 29 the national highway traffic safety administration. 14 30 3. Reallocations of sums received under section 6, 16 30 subsections 2, 3, 4, 5, and 6, of this Act, including sums 16 31 received for salaries, shall be reported on a quarterly basis 16 32 to the co-chairpersons and ranking members of the legislative 16 33 fiscal committee and the joint appropriations subcommittee on 16 34 education. 16 35 Sec. 8. For the fiscal year beginning July 1, 1995, and 17 1 ending June 30, 1996, the state board of regents may use 17 2 notes, bonds, or other evidences of indebtedness issued under 17 3 section 262.48 to finance projects that will result in energy 17 4 cost savings in an amount that will cause the state board to 17 5 recover the cost of the projects within an average of six 17 6 years. 17 7 Sec. 9. MEDICAL ASSISTANCE &endash; SUPPLEMENTAL AMOUNTS. 17 8 For the fiscal year beginning July 1, 1995, and ending June 17 9 30, 1996, the department of human services shall continue the 17 10 supplemental disproportionate share and a supplemental 17 11 indirect medical education adjustment applicable to state- 17 12 owned acute care hospitals with more than 500 beds and shall 17 13 reimburse qualifying hospitals pursuant to that adjustment 17 14 with a supplemental amount for services provided medical 17 15 assistance recipients. The adjustment shall generate 17 16 supplemental payments intended to equal the state 17 17 appropriation made to a qualifying hospital for treatment of 17 18 indigent patients as provided in chapter 255. To the extent 17 19 of the supplemental payments, a qualifying hospital shall, 17 20 after receipt of the funds, transfer to the department of 17 21 human services an amount equal to the actual supplemental 17 22 payments that were made in that month. The aggregate amounts 17 23 for the fiscal year shall not exceed the state appropriation 17 24 made to the qualifying hospital for treatment of indigent 17 25 patients as provided in chapter 255. The department of human 17 26 services shall deposit the portion of these funds equal to the 17 27 state share in the department's medical assistance account and 17 28 the balance shall be credited to the general fund of the 17 29 state. To the extent that state funds appropriated to a 17 30 qualifying hospital for the treatment of indigent patients as 17 31 provided in chapter 255 have been transferred to the 17 32 department of human services as a result of these supplemental 17 33 payments made to the qualifying hospital, the department shall 17 34 not, directly or indirectly, recoup the supplemental payments 17 35 made to a qualifying hospital for any reason, unless an 18 1 equivalent amount of the funds transferred to the department 18 2 of human services by a qualifying hospital pursuant to this 18 3 provision is transferred to the qualifying hospital by the 18 4 department. 18 5 If the state supplemental amount allotted to the state of 18 6 Iowa for the federal fiscal year beginning October 1, 1995, 18 7 and ending September 30, 1996, pursuant to section 1923 (f)(3) 18 8 of the federal Social Security Act, as amended, or pursuant to 18 9 federal payments for indirect medical education is greater 18 10 than the amount necessary to fund the federal share of the 18 11 supplemental payments specified in the preceding paragraph, 18 12 the department of human services shall increase the 18 13 supplemental disproportionate share or supplemental indirect 18 14 medical education adjustment by the lesser of the amount 18 15 necessary to utilize fully the state supplemental amount or 18 16 the amount of state funds appropriated to the state university 18 17 of Iowa general education fund and allocated to the university 18 18 for the college of medicine. The state university of Iowa 18 19 shall transfer from the allocation for the college of medicine 18 20 to the department of human services, on a monthly basis, an 18 21 amount equal to the additional supplemental payments made 18 22 during the previous month pursuant to this paragraph. A 18 23 qualifying hospital receiving supplemental payments pursuant 18 24 to this paragraph that are greater than the state 18 25 appropriation made to the qualifying hospital for treatment of 18 26 indigent patients as provided in chapter 255 shall be 18 27 obligated as a condition of its participation in the medical 18 28 assistance program to transfer to the state university of Iowa 18 29 general education fund on a monthly basis an amount equal to 18 30 the funds transferred by the state university of Iowa to the 18 31 department of human services. To the extent that state funds 18 32 appropriated to the state university of Iowa and allocated to 18 33 the college of medicine have been transferred to the 18 34 department of human services as a result of these supplemental 18 35 payments made to the qualifying hospital, the department shall 19 1 not, directly or indirectly, recoup these supplemental 19 2 payments made to a qualifying hospital for any reason, unless 19 3 an equivalent amount of the funds transferred to the 19 4 department of human services by the state university of Iowa 19 5 pursuant to this paragraph is transferred to the qualifying 19 6 hospital by the department. 19 7 Continuation of the supplemental disproportionate share and 19 8 supplemental indirect medical education adjustment shall 19 9 preserve the funds available to the university hospital for 19 10 medical and surgical treatment of indigent patients as 19 11 provided in chapter 255 and to the state university of Iowa 19 12 for educational purposes at the same level as provided by the 19 13 state funds initially appropriated for that purpose. 19 14 The department of human services shall, in any compilation 19 15 of data or other report distributed to the public concerning 19 16 payments to providers under the medical assistance program, 19 17 set forth reimbursements to a qualifying hospital through the 19 18 supplemental disproportionate share and supplemental indirect 19 19 medical education adjustment as a separate item and shall not 19 20 include such payments in the amounts otherwise reported as the 19 21 reimbursement to a qualifying hospital for services to medical 19 22 assistance recipients. 19 23 For purposes of this section, "supplemental payment" means 19 24 a supplemental payment amount paid for medical assistance to a 19 25 hospital qualifying for that payment under this section. 19 26 DEPARTMENT OF CULTURAL AFFAIRS 19 27 Sec. 10. There is appropriated from the general fund of 19 28 the state to the department of cultural affairs for the fiscal 19 29 year beginning July 1, 1995, and ending June 30, 1996, the 19 30 following amounts, or so much thereof as is necessary, to be 19 31 used for the purposes designated: 19 32 1. Notwithstanding section 8.33, funds appropriated 20 30 in 1994 Iowa Acts, chapter 1193, section 14, remaining 20 31 unencumbered or unobligated on June 30, 1995, shall not revert 20 32 to the general fund of the state but shall be available for 20 33 purposes of the Iowa grant program, in addition to funds 20 34 appropriated in section 4, subsection 3, unnumbered paragraph 20 35 2 of this Act, with funds to be distributed pursuant to 21 1 section 261.93A. 21 2 Sec. 12. There is appropriated from the scholarship and 21 3 tuition grant reserve fund to the college student aid 21 4 commission for the fiscal year beginning July 1, 1995, and 21 5 ending June 30, 1996, the amount of $160,000 for purposes of 21 6 the work-study program, in addition to funds appropriated in 21 7 section 261.85 as amended by this Act. 21 8 Sec. 13. Funds appropriated for state scholarships 21 9 pursuant to section 261.25, subsection 2, for the fiscal year 21 10 beginning July 1, 1995, and ending June 30, 1996, shall be 21 11 used in their entirety to fund scholarships to eligible 21 12 students, and the college student aid commission shall not 21 13 place an across-the-board ceiling on the amount distributed 21 14 under the state scholarship program. 21 15 Sec. 14. Section 260D.12, Code 1993, as amended by 1994 21 16 Iowa Acts, chapter 1181, section 13, is amended to read as 21 17 follows: 21 18 260D.12 PAYMENT OF APPROPRIATION. 21 19 Payment of appropriations for distribution under this 21 20 chapter or of appropriations made in lieu of such 21 21 appropriations, shall be made by the department of revenue and 21 22 finance infourmonthly installments due on or aboutNovember21 2315, February 15, May 15, and August 15the fifteenth of each 21 24 month of a budget year, and installments shall be as nearly 21 25 equal as possible, as determined by the department of revenue 21 26 and finance, taking into consideration the relative budget and 21 27 cash position of the state resources. 21 28 Sec. 15. Section 260D.14A, unnumbered paragraphs 1 and 5, 21 29 Code 1995, are amended to read as follows: 21 30 The department of education shall provide for the 21 31 establishment of a community college excellence 2000 account 21 32 in the office of the treasurer of state for deposit of moneys 21 33 appropriated to the account for purposes of funding quality 21 34 instructional centers and program and administrative sharing 21 35 agreements under sections 260C.45 and 260C.46. There is 22 1 appropriated from the general fund of the state to the 22 2 department of education for the fiscal year beginning July 1, 22 319951997, an amount equal to two and five-tenths percent of 22 4 the total state general aid generated for all community 22 5 colleges during the budget year under this chapter for deposit 22 6 in the community college excellence 2000 account. In the next 22 7 succeeding two fiscal years, the percent multiplier shall be 22 8 increased in equal increments until the multiplier reaches 22 9 seven and one-half percent of the total state general aid 22 10 generated for all community colleges during the budget year. 22 11 It is the intent of the general assembly that the general 22 12 assembly enact legislation by July 1,19951997, that will 22 13 increase the maximum percent multiplier established in this 22 14 section from seven and five-tenths percent to ten percent. 22 15 Sec. 16. Section 261.12, subsection 1, paragraph b, Code 22 16 1995, is amended to read as follows: 22 17 b. For the fiscal year beginning July 1,19891995, and 22 18 for each following fiscal year, two thousandsixseven hundred 22 19fiftyseventy-five dollars. 22 20 Sec. 17. Section 261.25, subsections 1 and 3, Code 1995, 22 21 are amended to read as follows: 22 22 1. There is appropriated from the general fund of the 22 23 state to the commission for each fiscal year the sum of 22 24thirty-twothirty-five millionfoureight hundred twenty-two 22 25 thousand three hundred sixty-two dollars for tuition grants. 22 26 3. There is appropriated from the general fund of the 22 27 state to the commission for each fiscal year the sum of one 22 28 million four hundredtwenty-fourfifty-eight thousand seven 22 29 hundredeightyeighty-four dollars for vocational-technical 22 30 tuition grants. 22 31 Sec. 18. Section 261.85, unnumbered paragraph 1, Code 22 32 1995, is amended to read as follows: 22 33 There is appropriated from the general fund of the state to 22 34 the commission for each fiscal year the sum oftwothree 22 35 millioneight hundred ninety-eight thousand eight hundred23 1fortydollars for the work-study program. 23 2 Sec. 19. Section 294A.25, subsection 8, Code 1995, is 23 3 amended to read as follows: 23 4 8. For the fiscal year beginning July 1,19941995, to the 23 5 department of education from phase III moneys the amount of 23 6 one million two hundred fifty thousand dollars for support for 23 7 the operations of the new Iowa schools development corporation 23 8 and for school transformation design and implementation 23 9 projects administered by the corporation. Of the amount 23 10 provided in this subsection, one hundred fifty thousand 23 11 dollars shall be used for the school and community planning 23 12 initiative. 23 13 Sec. 20. Section 303.3, subsection 3, Code 1995, is 23 14 amended to read as follows: 23 15 3. Notwithstanding section 8.33, moneys committed to 23 16 grantees under contract that remain unexpended on June 30 of 23 17 any fiscal year shall not revert but shall be available for 23 18 expenditure for purposes of thecontractprogram until June 30 23 19 of the succeeding fiscal year. 23 20 Sec. 21. FUNDS TRANSFERRED. 23 21 1. For the fiscal year beginning July 1, 1995, and ending 23 22 June 30, 1996, the amount of $260,000 is to be paid to the 23 23 department of education from additional funds transferred from 23 24 phase I to phase III for development of a K-12 and community 23 25 college management information system. Notwithstanding 23 26 section 294A.20, if the additional funds transferred from 23 27 phase I to phase III are insufficient for purposes of the 23 28 appropriation provided under this subsection, moneys allocated 23 29 to phase III, which would otherwise revert to the general fund 23 30 under section 294A.20, shall be transferred to the department 23 31 in an amount sufficient to fully fund the appropriation made 23 32 under this subsection. 23 33 2. For the fiscal year beginning July 1, 1995, and ending 23 34 June 30, 1996, up to $50,000 from additional funds transferred 23 35 from phase I to phase III is to be paid to the department of 24 1 education for support of the Iowa mathematics and science 24 2 coalition. If funds available from the specified sources are 24 3 insufficient to fully fund the appropriation, the amount 24 4 appropriated to the department under this subsection shall be 24 5 reduced to an amount equal to the available funds. 24 6 Sec. 22. 1994 Iowa Acts, chapter 1181, section 18, is 24 7 amended to read as follows: 24 8 SEC. 18.CONTINGENTEFFECTIVE DATE. Sections 12, 13, 14, 24 9 and 15 of this division shall take effectupon the publication24 10date of the state comprehensive annual financial report24 11prepared in accordance with generally accepted accounting24 12principles which indicates that the payment of the obligation24 13described in the section is made in accordance with generally24 14accepted accounting principlesJuly 1, 1995.A report shall24 15be made by the department of management to the Code editor on24 16or before the publication date of the report.24 17 Sec. 23.
