  1  1    Section 1.  Section 236.3B, Code 1995, is amended by adding
  1  2 the following new unnumbered paragraph:
  1  3    NEW UNNUMBERED PARAGRAPH.  The county attorney may utilize
  1  4 the funds remitted to the county treasurer pursuant to section
  1  5 602.8105, subsection 2, paragraph "a", to defray the costs of
  1  6 the assistance authorized in this section.
  1  7    Sec. 2.  Section 602.8105, subsection 2, paragraph a, Code
  1  8 1995, is amended to read as follows:
  1  9    a.  For filing an application for a license to marry,
  1 10 thirty forty dollars.  For issuing an application for an order
  1 11 of the district court authorizing the issuance of a license to
  1 12 marry prior to the expiration of three days from the date of
  1 13 filing the application for the license, five dollars.  The
  1 14 court shall authorize the issuance of a marriage license
  1 15 without the payment of any fees imposed by this paragraph upon
  1 16 a showing that the applicant is unable to pay the fees.
  1 17    Notwithstanding section 602.8108 or any other provision of
  1 18 law to the contrary, ten dollars of the marriage license fee
  1 19 shall be a surcharge which the clerk of the district court
  1 20 shall remit to the county treasurer for use by the county
  1 21 attorney to provide legal assistance in domestic abuse actions
  1 22 in accordance with section 236.3B.  
  1 23                           EXPLANATION
  1 24    This bill increases the fee for a marriage license from $30
  1 25 to $40 and directs that $10 of the fee be distributed to the
  1 26 county treasurer for use by the county attorney to fund legal
  1 27 assistance to certain plaintiffs in domestic abuse actions in
  1 28 accordance with section 236.3B.  Section 236.3B provides that
  1 29 the county attorney may provide assistance to a plaintiff in a
  1 30 domestic abuse action who does not have sufficient funds to
  1 31 pay for legal assistance if the assistance does not create a
  1 32 conflict of interest for the county attorney.
