PAG LIN 1 1 Section 1. Section 91A.2, subsection 3, unnumbered 1 2 paragraph 1, Code 1995, is amended to read as follows: 1 3 "Employee" means a natural person who is employed, or has 1 4 been employed, in this state for wages by an employer. 1 5Employee"Employee" also includes a commission salesperson who 1 6 takes orders or performs services, or has taken or performed 1 7 services, on behalf of a principal and who is, or has been, 1 8 paid on the basis of commissions but does not include persons 1 9 who purchase, or who have purchased, for their own account for 1 10 resale. For the purposes of this chapter, and chapter 91B, 1 11 the following persons engaged in agriculture are not 1 12 employees: 1 13 Sec. 2. Section 91A.2, subsection 4, Code 1995, is amended 1 14 to read as follows: 1 15 4. "Employer" means a person, as defined in chapter 4, who 1 16 in this state employs, or has employed, for wages a natural 1 17 person. An employer does not include a client, patient, 1 18 customer, or other person who obtains professional services 1 19 from a licensed person who provides the services on a fee 1 20 service basis or as an independent contractor. 1 21 EXPLANATION 1 22 This bill broadens the definitions of "employee" and 1 23 "employer" under the Iowa wage payment collection law to 1 24 include former employees, former employers, and salespersons 1 25 who have taken or performed services on behalf on a principal 1 26 and who have been paid on the basis of commissions. However, 1 27 under the bill, "employee" does not include salespersons who 1 28 have purchased for their own account for resale. Persons 1 29 engaged in agriculture who are not employees for purposes of 1 30 the Iowa wage payment collection law are not, under the bill, 1 31 employees for purposes of chapter 91B, pertaining to employee 1 32 access to personnel files. 1 33 LSB 2076SS 76 1 34 kh/jj/8
