PAG LIN 1 1 Section 1. Rule of civil procedure 56.1, paragraph a, Iowa 1 2 court rules, third edition, is amended to read as follows: 1 3 a. Upon any individual aged eighteenyearsormoreolder 1 4 who has not been adjudged incompetent, either by taking the 1 5 individual's signed, dated acknowledgment of service endorsed 1 6 on the notice; or by serving the individual personally; or by 1 7 serving, at the individual's dwelling house or usual place of 1 8 abode, any person residing therein who is at least eighteen 1 9 years old, but if such place is a rooming house, hotel, club, 1 10 or apartment building, the copy shall there be delivered to 1 11 such a person who is either a member of the individual's 1 12 family or the manager, clerk, proprietor, or custodian of such 1 13 place or delivered to an individual aged eighteen or older who 1 14 also resides in the room or apartment unit of the individual 1 15 who is to be served; or upon the individual's spouse at a 1 16 place other than the individual's dwelling house or usual 1 17 place of abode if probable cause exists to believe that the 1 18 spouse lives at the individual's dwelling house or usual place 1 19 of abode. 1 20 EXPLANATION 1 21 This bill provides for personal service on a roommate of 1 22 the person being served, even if the roommate is not related 1 23 by blood or marriage, if the roommate is 18 years of age or 1 24 older. 1 25 LSB 2066SC 76 1 26 mk/jw/5
