1 1 Section 1. Section 8D.13, Code 1995, is amended by adding
1 2 the following new subsection:
1 3 NEW SUBSECTION. 5A. Notwithstanding subsection 5, the
1 4 state may own fiber optic cable facilities or facilities with
1 5 DS-3 capacity for a part III connection which is a spur
1 6 connection. For purposes of this subsection, "spur
1 7 connection" means a connection which is associated with a part
1 8 III authorized user which is a school district and which is
1 9 located no more than one and one-half miles from a fiber optic
1 10 cable route used or to be used for connecting a facility,
1 11 identified in the Iowa national guard request for proposals
1 12 dated October 10, 1994, and any subsequent addendum, to the
1 13 network, or no more than one and one-half miles from an Iowa
1 14 national guard facility which is or is to be connected to the
1 15 network. The spur connection shall be for a single site
1 16 within the school district as determined by the local school
1 17 board and approved by the commission. The spur connection
1 18 shall be no more than one and one-half miles long and shall be
1 19 connected to such fiber optic cable route or national guard
1 20 facility.
1 21 Sec. 2. There is appropriated from the general fund of the
1 22 state to the Iowa telecommunications network fund under the
1 23 control of the Iowa telecommunications and technology com-
1 24 mission for the fiscal year beginning July 1, 1995, and ending
1 25 June 30, 1996, the following amount, or so much thereof as may
1 26 be necessary, to be deposited in a separate account and to be
1 27 used, notwithstanding section 8D.13, for costs associated with
1 28 spur connections to the network as defined in section 8D.13,
1 29 subsection 5A, which extend from a connection to an Iowa
1 30 national guard facility:

1 32 EXPLANATION
1 33 This bill provides that the state may own fiber optic cable
1 34 facilities or facilities with DS-3 capacity for a connection
1 35 associated with a part III authorized user which is located no
2 1 more than one and one-half miles from a fiber optic cable
2 2 route used or to be used for connecting a facility, identified
2 3 in the Iowa national guard request for proposals dated October
2 4 10, 1994, and any subsequent addendum, to the network, or no
2 5 more than one and one-half miles from an Iowa national guard
2 6 facility which is or is to be connected to the network. These
2 7 connections are defined as spur connections.
