1 1 Section 1. NEW SECTION. 8A.2 FAMILY OPPORTUNITY
1 2 DISTRICTS.
1 3 1. The purpose of this section is to enable local
1 4 jurisdictions to establish community partnerships to redirect
1 5 existing public funds to achieve improved outcomes for
1 6 children and their families. The state and local
1 7 jurisdictions shall negotiate new relationships in the
1 8 decategorization of funding appropriated and available to
1 9 local jurisdictions which share the risk related to and
1 10 responsibility for achieving improved outcomes.
1 11 2. A family opportunity district board is created within
1 12 the council on human investment. The staff of the council on
1 13 human investment shall act as staff to the board. The board
1 14 shall select a chairperson, annually, from its membership. A
1 15 simple majority of the members of the board shall constitute a
1 16 quorum. On or before June 30, 1997, the board shall do all of
1 17 the following:
1 18 a. Issue a request for applications to be submitted by
1 19 local jurisdictions to participate in family opportunity
1 20 districts in order to develop new, community-based strategies
1 21 which are cross-system in focus, to improve outcomes for
1 22 children and their families.
1 23 b. Select from the requests received, at least three
1 24 jurisdictions to develop and implement family opportunity
1 25 district plans. The board shall establish criteria for
1 26 selection of the jurisdictions. Selection criteria shall
1 27 include a component which measures the comprehensiveness of
1 28 the plan and the capacity of the jurisdiction to implement the
1 29 plan.
1 30 c. Provide technical assistance, if requested, to assist
1 31 selected jurisdictions in developing and implementing the
1 32 family opportunity district plans, including but not limited
1 33 to assistance in providing information regarding state and
1 34 federal funding directed to the local jurisdiction for use in
1 35 implementation of the plans.
2 1 d. Negotiate with local jurisdictions the state and local
2 2 jurisdiction duties in implementing the family opportunity
2 3 district plans. The negotiations shall include methods to
2 4 evaluate the performance of the family opportunity districts.
2 5 The board shall coordinate and respond to any requests from a
2 6 local jurisdiction relating to waiver of existing rules or
2 7 regulations, the pooling and redirecting of existing state
2 8 funds, and the seeking of federal waivers.
2 9 e. Provide for maximum flexibility and creativity in the
2 10 designing and implementation of family opportunity district
2 11 plans with an emphasis on the plans' potential for improving
2 12 outcomes for children and their families.
2 13 f. Review and approve or disapprove any provision in a
2 14 family opportunity district plan submitted which requires the
2 15 waiver or superseding of any state rule relating to local
2 16 jurisdiction actions or expenditure of funds for services
2 17 provided to children and their families.
2 18 g. Report provisions included in a local jurisdiction's
2 19 family opportunity district plan which require the waiver or
2 20 superseding of a state law or rule to the general assembly for
2 21 review and necessary action.
2 22 3. A local jurisdiction seeking to develop and implement a
2 23 family opportunity district plan shall do all of the
2 24 following:
2 25 a. Define the geographic service area of the local
2 26 jurisdiction.
2 27 b. Establish a local jurisdiction family opportunity
2 28 district governing body which shall develop and implement the
2 29 family opportunity district plan. In its initial application,
2 30 the local jurisdiction shall demonstrate the involvement in
2 31 the governing body, which controls the allocation of funds
2 32 anticipated to be used in funding the family opportunity
2 33 district plan, of community leaders, employees of departments,
2 34 agencies and offices of the local jurisdiction which provide
2 35 services to children and their families, and consumers.
3 1 c. Develop a budget for the development and implementation
3 2 of the family opportunity district plan which includes a
3 3 commitment of ongoing local funding and which also involves
3 4 the commitment of other private and public resources to the
3 5 family opportunity district.
3 6 d. Negotiate the specific requirements of the family
3 7 opportunity district plan and implementation of the plan
3 8 including the specific duties of the state and local
3 9 jurisdictions. The plans may include provisions for local
3 10 jurisdiction actions or expenditure of funds under the plan
3 11 which involve waiver of state rules relating to services to
3 12 children and their families.
3 13 4. The family opportunity district board shall include all
3 14 of the following members:
3 15 a. The directors, or their designees, of the department of
3 16 human services, the department of human rights, the department
3 17 of education, the Iowa department of public health, the
3 18 department of employment services, the department of
3 19 management, and any other state departments or agencies, as
3 20 necessary, as determined by the board.
3 21 b. Four members of the general assembly shall serve as ex
3 22 officio, nonvoting members. The legislative members shall be
3 23 appointed by the majority leader of the senate, after
3 24 consultation with the president of the senate, by the minority
3 25 leader of the senate, and by the speaker of the house, after
3 26 consultation with the majority leader and minority leader of
3 27 the house of representatives. Appointments shall comply with
3 28 sections 69.16 and 69.16A. Vacancies shall be filled by the
3 29 original appointing authority and in the manner of the
3 30 original appointments. Legislative members shall serve terms
3 31 of two years and shall receive compensation pursuant to
3 32 section 2.12.
3 33 c. Additional members, which the governor shall appoint,
3 34 who are not affiliated with a state agency but who are members
3 35 of the general public with expertise or interest in children
4 1 and family issues.
4 2 5. For the purposes of this section, "local jurisdiction"
4 3 or "jurisdiction" means one or more cities, counties, or
4 4 school districts or a combination of any of these entities.
4 5 Sec. 2. APPROPRIATION – FAMILY OPPORTUNITY DISTRICT
4 6 ADMINISTRATION. There is appropriated from the general fund
4 7 of the state to the department of management for the fiscal
4 8 year beginning July 1, 1996, and ending June 30, 1997, the
4 9 following amount, or so much thereof as is necessary, for the
4 10 following purpose:
4 11 For the administration of the family opportunity district
4 12 program, and for salaries, support, maintenance, miscellaneous
4 13 purposes, and for not more than the following full-time
4 14 equivalent positions:
4 15 .................................................. $ 60,000
4 16 ................................................FTEs 1.00
4 17 Sec. 3. REPEAL – FAMILY OPPORTUNITY DISTRICT
4 18 BOARD. Section 1, subsections 2 and 4, of this Act,
4 19 relating to the family opportunity district board, are
4 20 repealed June 30, 1998.
