1 1 Section 1. NEW SECTION. 261B.13 PROHIBITION OF
1 2 FRAUDULENT DEGREES.
1 3 A school shall not grant a degree to a student without the
1 4 successful completion by the student of the requirements of an
1 5 academic, educational, or professional program of study. This
1 6 section does not apply to an honorary degree granted by a
1 7 school to a person as a result of an unusual or outstanding
1 8 achievement, contribution, or distinction of the person or a
1 9 degree awarded posthumously.
1 10 Section 261B.12 applies to this section.
1 11 EXPLANATION
1 12 This bill provides that a school shall not grant a degree
1 13 to a student without the successful completion by the student
1 14 of the requirements of an academic, educational, or
1 15 professional program of study. The bill does not apply to an
1 16 honorary degree granted by a school to a person as a result of
1 17 an unusual or outstanding achievement, contribution, or
1 18 distinction of the person or a degree awarded posthumously.
1 19 A school for the purposes of the bill includes a school
1 20 that provides a postsecondary instructional program or course
1 21 leading to a degree, or uses in its name the term "college",
1 22 "academy", "institute", or "university" or a similar term to
1 23 imply that the school is primarily engaged in the education of
1 24 students at the postsecondary level, and which makes a charge
1 25 for its services.
1 26 The bill authorizes the secretary of state or the secretary
1 27 of state's designee to obtain a cease and desist order against
1 28 a school violating the prohibition against granting fraudulent
1 29 degrees. If the school does not cease and desist, the
1 30 secretary of state may seek judicial enforcement of the cease
1 31 and desist order in any district court of the state of Iowa.
