PAG LIN 1 1 Section 1. Section 252.25, unnumbered paragraph 1, Code 1 2 1995, is amended to read as follows: 1 3 The board of supervisors of each county shall provide for 1 4 the assistance of poor persons lawfully initsthe county who 1 5 are ineligible for, or are in immediate need and are awaiting 1 6 approval and receipt of, assistance under programs provided by 1 7 state or federal law, or whose actual needs cannot be fully 1 8 met by the assistance furnished under those programs. The 1 9 county board of supervisors shall establish general rules as 1 10itsthe board's members deem necessary to properly discharge 1 11 their responsibility under this section. 1 12 Sec. 2. PUBLIC ASSISTANCE ELIGIBILITY WAIVER. 1 13 1. For the purposes of this section, unless the context 1 14 otherwise requires, "public assistance" means assistance for 1 15 the following purposes paid for in whole or in part by the 1 16 federal government in combination with the state or a 1 17 political subdivision of the state: 1 18 a. The family investment program under chapter 239. 1 19 b. The medical assistance program under chapter 249A. 1 20 c. Child day care funding. 1 21 2. The department of human services shall submit waiver 1 22 requests to the United States department of health and human 1 23 services for authorization for the state and political 1 24 subdivisions of the state to apply an additional eligibility 1 25 provision to public assistance, if existing eligibility 1 26 provisions require the recipient to have a dependent child. 1 27 The eligibility provision shall require that at the time of 1 28 the dependent child's birth, at least one of the parents of 1 29 the child was either a citizen or was lawfully present in the 1 30 United States. The department shall report to the general 1 31 assembly by December 15, 1996, as to the status of the request 1 32 or requests. If implementation of an approved federal waiver 1 33 would require a change in a state law, the department shall 1 34 submit a proposal for amending the state law to the governor 1 35 and the general assembly. 2 1 EXPLANATION 2 2 This bill relates to eligibility of persons for certain 2 3 forms of public assistance. 2 4 This bill amends section 252.25, relating to eligibility 2 5 for county general assistance, by requiring a person to be in 2 6 the county lawfully as a condition of eligibility. 2 7 In addition, the bill directs the department of human 2 8 services to submit federal waiver requests to revise 2 9 eligibility requirements applicable to certain public 2 10 assistance programs for which a dependent child is required 2 11 for eligibility purposes. The additional eligibility 2 12 provision shall require that at the time of the dependent 2 13 child's birth, at least one of the parents of the child was a 2 14 citizen or was lawfully present in the United States. The 2 15 following public assistance programs which receive a 2 16 combination of federal and state or local government funding 2 17 are to be addressed: the family investment program under 2 18 chapter 239, medical assistance under chapter 249A, and child 2 19 day care assistance. 2 20 The department is to report to the general assembly by 2 21 December 15, 1996, as to the status of the waiver requests. 2 22 If a state law change is required to implement an approved 2 23 waiver request, the department shall submit a proposal for 2 24 amending the law to the governor and the general assembly. 2 25 LSB 4141XS 76 2 26 jp/cf/24
