  1  1    Section 1.  Section 452A.17, subsection 1, paragraph b,
  1  2 subparagraph (7), Code Supplement 1995, is amended to read as
  1  3 follows:
  1  4    (7)  Claim shall be made by and the amount of the refund
  1  5 shall be paid to the person who purchased the motor fuel or
  1  6 undyed special fuel as shown in the supporting invoice unless
  1  7 that person designates another person as an agent for purposes
  1  8 of filing and receiving the refund for idle time, power
  1  9 takeoff, reefer units, pumping credits, and transport
  1 10 diversions.
  1 11    Sec. 2.  EFFECTIVE DATE.  This Act, being deemed of
  1 12 immediate importance, takes effect upon enactment.  
  1 13                           EXPLANATION
  1 14    This bill allows a person to designate another person as an
  1 15 agent for purposes of filing and receiving any type of motor
  1 16 vehicle fuel tax refunds.  The bill is effective upon
  1 17 enactment.
