1 1 Section 1. NEW SECTION. 252B.5A LIEN – RELEASE – CASE
1 2 CLOSURE.
1 3 At the time of closure of a case for which the child
1 4 support recovery unit is providing enforcement services
1 5 pursuant to this chapter, and no later than thirty days
1 6 following receipt of a written request by an obligor, the
1 7 child support recovery unit shall acknowledge the closure of
1 8 the case upon the record of the judgment or by execution of an
1 9 instrument referring to the judgment, duly acknowledged and
1 10 filed in the office of the clerk of the district court, in
1 11 every county where the judgment is a lien.
1 12 EXPLANATION
1 13 This bill directs the child support recovery unit (CSRU),
1 14 in cases in which the CSRU is providing enforcement services,
1 15 to acknowledge closure of a case, at the time of closure and
1 16 no later than 30 days following receipt of a written request
1 17 by the obligor, upon the record of the judgment or by
1 18 executing an instrument referring to the judgment,
1 19 acknowledged and filed in the office of the clerk of the
1 20 district court in every county where the judgment is a lien
1 21 for the purposes of release of a lien on any real property of
1 22 the obligor.
