  1  1    Section 1.  NEW SECTION.  135.105A  LEAD INSPECTOR AND LEAD
  1  2 ABATER TRAINING AND CERTIFICATION ESTABLISHED.
  1  3    1.  The department shall establish a program for the
  1  4 training and certification of lead inspectors and lead abaters
  1  5 who provide inspections and abatement for monetary
  1  6 compensation.  The department shall maintain a listing,
  1  7 available to the public and to city and county health
  1  8 departments, of lead inspectors and lead abaters who have
  1  9 successfully completed the training program and have been
  1 10 certified by the department.  A person may be certified as
  1 11 both a lead inspector and a lead abater.  However, a person
  1 12 who is certified as both a lead inspector and as a lead abater
  1 13 shall not provide both inspection and abatement services at
  1 14 the same site unless a written consent or waiver, following
  1 15 full disclosure by the person, is obtained from the owner or
  1 16 manager of the site.
  1 17    2.  The department shall also establish a program for the
  1 18 training of painting, demolition, and remodeling contractors
  1 19 and those who provide mitigation control services for monetary
  1 20 compensation.  The training shall be completed on a voluntary
  1 21 basis.
  1 22    3.  A person who owns or manages real property is not
  1 23 required to obtain certification to perform mitigation control
  1 24 or abatement measures of property which the person owns or
  1 25 manages.  However, the department shall encourage property
  1 26 owners and managers to complete the training course to ensure
  1 27 the use of appropriate and safe mitigation and abatement
  1 28 procedures.
  1 29    4.  A person shall not perform lead abatement or lead
  1 30 inspections for compensation unless the person has completed a
  1 31 training program approved by the department and has obtained
  1 32 certification.  A person who violates this section is subject
  1 33 to a civil penalty not to exceed five thousand dollars for
  1 34 each offense.
  1 35    Sec. 2.  NEW SECTION.  135.105B  VOLUNTARY GUIDELINES –
  2  1 HEALTH AND ENVIRONMENTAL MEASURES – CONFIRMED CASES OF LEAD
  2  2 POISONING.
  2  3    1.  The department may develop voluntary guidelines which
  2  4 may be used to develop and administer local programs to
  2  5 address the health and environmental needs of children who are
  2  6 confirmed as lead poisoned.
  2  7    2.  The voluntary guidelines may be based upon existing
  2  8 local ordinances that address the medical case management of
  2  9 children's health needs and the mitigation of the
  2 10 environmental factors which contributed to the lead poisoning.
  2 11    3.  Following development of the voluntary guidelines,
  2 12 cities or counties may elect to utilize the guidelines in
  2 13 developing and administering local programs through city or
  2 14 county health departments on a city, county, or multicounty
  2 15 basis or may request that the state develop and administer the
  2 16 local program.  However, cities and counties are not required
  2 17 to develop and administer local programs based upon the
  2 18 guidelines.
  2 19    Sec. 3.  ADOPTION OF RULES.  The department shall adopt
  2 20 rules regarding training, certification, suspension, and
  2 21 revocation requirements and shall implement the training and
  2 22 certification program established in section 135.105A.  The
  2 23 department shall seek federal funding and shall establish fees
  2 24 in amounts sufficient to defray the costs of the training and
  2 25 certification program.
  2 26    Sec. 4.  CONTINGENT EFFECTIVE DATE.  This Act takes effect
  2 27 only after the department obtains certification from the
  2 28 United States environmental protection agency as an accredited
  2 29 program to train and certify lead inspectors and abaters.
  2 30 However, the department may establish a temporary program for
  2 31 the voluntary certification of lead inspectors and lead
  2 32 abaters during the period prior to obtaining certification as
  2 33 an accredited program from the United States environmental
  2 34 protection agency.
