1 1 Section 1. NEW SECTION. 321.473A ANNUAL PERMIT FEE FOR
1 2 OPERATORS OF MOTOR TRUCKS TRANSPORTING SOLID WASTE.
1 3 The operator of a motor truck, which is not registered
1 4 within the state, which transports solid waste, as defined in
1 5 section 455B.301, to a sanitary disposal project or sanitary
1 6 landfill located within this state, shall not transport solid
1 7 waste in this state unless the operator obtains an annual
1 8 permit by paying an annual fee to the department. The
1 9 department shall determine the amount of the annual fee and
1 10 shall grant a permit as determined by rule. A permit shall be
1 11 effective for not more than one year from the date of
1 12 issuance. The operator of a motor truck which transports
1 13 solid waste without a permit in violation of this section
1 14 commits a simple misdemeanor. Each transport of solid waste
1 15 in violation of this section constitutes a separate offense.
1 16 EXPLANATION
1 17 This bill requires the operator of a motor truck, which is
1 18 not registered within the state, which transports solid waste
1 19 to a sanitary disposal project or sanitary landfill located
1 20 within this state, to obtain an annual permit by paying an
1 21 annual fee to the state department of transportation. The
1 22 department shall determine the amount of the annual fee and
1 23 shall grant a permit as determined by rule. The operator of a
1 24 motor truck which transports solid waste without a permit in
1 25 violation of the bill commits a simple misdemeanor. Each
1 26 transport of solid waste in violation of the bill constitutes
1 27 a separate offense.
