  1  1    Section 1.  Section 8D.1, Code 1995, is amended to read as
  1  2 follows:
  1  3    8D.1  PURPOSE – LEGISLATIVE INTENT.
  1  4    It is the intent of the general assembly that:
  1  5    1.  The communications of state government be co-ordinated
  1  6 coordinated to effect maximum practical consolidation and
  1  7 joint use of communications services.
  1  8    2.  The Iowa communications network's primary purpose is
  1  9 for educational uses associated with voice, data, and video
  1 10 communication services for educational users in this state.
  1 11    3.  The Iowa communications network not be used to provide
  1 12 voice, data, or video services in competition with private
  1 13 communication services providers in this state.
  1 14    4.  The Iowa communications network user base not be
  1 15 expanded to include additional types of users not already
  1 16 identified in this chapter as of July 1, 1996, unless such
  1 17 expansion is approved by a two-thirds majority vote in both
  1 18 the senate and the house of representatives and approved by
  1 19 the governor.
  1 20    5.  Of the authorized users identified in this chapter,
  1 21 only the communication needs of grades kindergarten through
  1 22 twelve, area education agencies, and other educational
  1 23 institutions receiving state funding should be subsidized by
  1 24 the taxpayers of this state.  All other authorized users shall
  1 25 not be subsidized by state revenue and shall be required to
  1 26 pay rates developed by the commission which are based on the
  1 27 recovery of all network costs associated with providing
  1 28 service to the type of user group of which the authorized user
  1 29 is associated, including those costs associated with
  1 30 maintenance, operations, administration, depreciation, capital
  1 31 costs, and all other relevant costs identified by the
  1 32 commission.  
  1 33                           EXPLANATION
  1 34    This bill amends section 8D.1, which states the purpose and
  1 35 intent of the general assembly regarding the Iowa
  2  1 communications network.  The bill provides that the primary
  2  2 purpose of the network should be for educational uses
  2  3 associated with voice, data, and video services utilized by
  2  4 educational users.  The bill provides that the types of
  2  5 authorized users should not be expanded beyond those currently
  2  6 provided for unless approved by a two-thirds vote of each
  2  7 chamber and approved by the governor.  The bill also provides
  2  8 that only services provided to grades kindergarten through 12,
  2  9 area education agencies, and other educational institutions
  2 10 receiving state funding should be subsidized by state funding
  2 11 and that other authorized users should be required to pay
  2 12 rates which are not subsidized by state funds and which are
  2 13 developed to recover all network costs associated with
  2 14 providing the service to such users.
