1 1 Section 1. Section 321.460, Code 1995, is amended to read
1 2 as follows:
1 3 321.460 SPILLING LOADS ON HIGHWAYS.
1 4 A vehicle shall not be driven or moved on any highway by
1 5 any person unless such vehicle is so constructed or loaded or
1 6 the load securely covered as to prevent any of its load from
1 7 dropping, sifting, leaking, or otherwise escaping or its load
1 8 covering from dropping from the vehicle, except that sand may
1 9 be dropped for the purpose of securing traction, or water or
1 10 other substance may be sprinkled on a roadway in cleaning or
1 11 maintaining such roadway. The provisions of this section shall
1 12 not apply to vehicles loaded with hay or stover or the
1 13 products listed in section 321.466, subsections 5 and 6,
1 14 except for ground limestone.
1 15 EXPLANATION
1 16 Current law requires that when transporting a substance in
1 17 a vehicle, the vehicle must be constructed or loaded or the
1 18 load securely covered so as to prevent any of the load from
1 19 dropping, sifting, leaking, or escaping. There is an
1 20 exception for the transportation of hay or stover and certain
1 21 other products, including ground limestone. This bill removes
1 22 the exception for the transportation of ground limestone, thus
1 23 requiring that the load be securely covered.
