PAG LIN 1 1 Section 1. Section 321.438, subsection 2, Code 1995, is 1 2 amended by striking the subsection and inserting in lieu 1 3 thereof the following: 1 4 2. a. A person shall not operate a motor vehicle 1 5 requiring registration under this chapter on the highways of 1 6 the state under any of the following conditions: 1 7 (1) If a sunscreening device or transparent material used 1 8 in conjunction with safety glazing materials applied to the 1 9 windshield extends downward more than five inches from the top 1 10 of the windshield or further than the AS-1 line. 1 11 (2) If a sunscreening device or transparent material used 1 12 in conjunction with safety glazing materials on the front side 1 13 windows located at the immediate right and left of the driver, 1 14 or on the side windows or rear windows behind the driver, has 1 15 a total light transmittance of less than thirty-five percent. 1 16 If a sunscreening device or transparent material is applied to 1 17 any window to the rear of the driver, the vehicle shall be 1 18 equipped with one left and one right rearview mirror. 1 19 b. A sunscreening device shall be nonreflective and shall 1 20 not be red, amber, or yellow in color. 1 21 c. A five percent light transmittance tolerance shall be 1 22 allowed for a vehicle violating this subsection. 1 23 d. This subsection shall not apply to the following: 1 24 (1) To windows situated behind the driver of a motor 1 25 truck, bus, recreational vehicle, or multipurpose vehicle. 1 26 (2) To a motor vehicle, if a light-sensitive disorder 1 27 permit is properly affixed to the vehicle. A person suffering 1 28 from a light-sensitive disorder may operate a motor vehicle 1 29 equipped with windows with less than thirty-five percent light 1 30 transmittance on the side and rear windows, if that person has 1 31 a light-sensitive disorder permit properly affixed to the 1 32 motor vehicle. The department shall issue a light-sensitive 1 33 disorder permit if the applicant files a written statement 1 34 signed by a licensed vision specialist which certifies that 1 35 the applicant suffers from a light-sensitive disorder and that 2 1 it is medically necessary for the person to obtain a waiver of 2 2 the light transmittance requirements of this subsection. Any 2 3 other person operating such a motor vehicle with a light- 2 4 sensitive disorder permit affixed to the vehicle shall not be 2 5 considered to have violated this subsection, even though that 2 6 person may not suffer from a light-sensitive disorder. As 2 7 used in this paragraph, "licensed vision specialist" means a 2 8 physician or osteopath licensed under chapter 148, 150, or 2 9 150A, or an optometrist licensed under chapter 154. This 2 10 exemption does not apply to commercial vehicles. 2 11 Sec. 2. Section 805.8, subsection 2, paragraph d, Code 2 12 Supplement 1995, is amended to read as follows: 2 13 d. For improper equipment under section 321.438, 2 14 subsection 2, the scheduled fine isfifteentwo hundred 2 15 dollars. 2 16 EXPLANATION 2 17 Current law prohibits the operation of a motor vehicle with 2 18 a windshield or side windows that are excessively dark or 2 19 reflective so that it is difficult for a person outside the 2 20 vehicle to see into the vehicle and requires the state 2 21 department of transportation to adopt rules establishing a 2 22 minimum measurable light transmittance standard. The 2 23 department, in 761 I.A.C. 450.7(2), has adopted the federal 2 24 standard contained in 49 C.F.R. } 571.205, which in turn 2 25 adopts the 70 percent light transmittance standards set forth 2 26 in the American national standard "Safety Code for Safety 2 27 Glazing Materials for Glazing Motor Vehicles Operating on Land 2 28 Highways". 2 29 This bill prohibits a person from operating a motor vehicle 2 30 requiring registration within the state if a sunscreening 2 31 device or transparent material used in conjunction with safety 2 32 glazing materials applied to the windshield extends downward 2 33 more than five inches from the top of the windshield or 2 34 further than the AS-1 line or if a sunscreening device or 2 35 transparent material used in conjunction with safety glazing 3 1 materials on the front side windows located at the immediate 3 2 right and left of the driver, or on the side windows or rear 3 3 windows behind the driver, has a total light transmittance of 3 4 less than 35 percent. 3 5 The bill allows a 5 percent light transmittance tolerance. 3 6 The bill requires that if a sunscreening device or transparent 3 7 material is applied to any window to the rear of the driver, 3 8 the vehicle shall be equipped with one left and one right 3 9 rearview mirror. The bill provides that a sunscreening device 3 10 shall be nonreflective and shall not be red, amber, or yellow 3 11 in color. 3 12 The 35 percent light transmittance requirements do not 3 13 apply to windows located behind the driver of a motor truck, 3 14 bus, recreational vehicle, or multipurpose vehicle or to a 3 15 person suffering from a light-sensitive disorder who has 3 16 obtained a permit. To obtain a light-sensitive disorder 3 17 permit, the applicant must file a written statement signed by 3 18 a licensed vision specialist certifying that the applicant 3 19 suffers from a light-sensitive disorder. This exemption does 3 20 not apply to commercial vehicles. 3 21 Finally, the bill increases the applicable scheduled fine 3 22 from $15 to $200. 3 23 LSB 3758SS 76 3 24 js/cf/24
