1 1 Section 1. Section 714.16, subsection 1, paragraph o, Code
1 2 1995, is amended to read as follows:
1 3 o. "Water treatment system" means a device or assembly for
1 4 which a claim is made that it will improve the quality of
1 5 drinking water by reducing one or more contaminants through
1 6 mechanical, physical, chemical, or biological processes or
1 7 combinations of the processes. "Water treatment system" does
1 8 not include a portable water system used by a hiker or a
1 9 camper. As used in this paragraph and in subsection 2,
1 10 paragraph "h", each model of a water treatment system shall be
1 11 deemed a distinct water treatment system.
1 12 EXPLANATION
1 13 This bill amends the consumer fraud law by excluding from
1 14 the definition of a "water treatment system" a portable water
1 15 system used by a hiker or a camper. The bill exempts the
1 16 seller of a portable water system from the need to comply with
1 17 the requirements of the consumer fraud law. The consumer
1 18 fraud law requires that a "water treatment system" is
1 19 performance-tested by a third-party testing agency, meets the
1 20 performance-testing requirements specified in the testing
1 21 protocol, bears a conspicuous and legible label pertaining to
1 22 the need to read the manufacturer's performance data sheet,
1 23 and is accompanied by the consumer information pamphlet
1 24 compiled by the Iowa department of public health. The
1 25 attorney general is authorized to enforce the provisions of
1 26 the consumer fraud law through numerous civil remedies
1 27 including restitution, injunctions, fines, dissolving a
1 28 corporation, and payment of attorney's fees.
