  1  1    Section 1.  Section 206.5, subsection 3, paragraph b,
  1  2 unnumbered paragraph 2, Code Supplement 1995, is amended to
  1  3 read as follows:
  1  4    The department shall adopt rules providing for the program
  1  5 requirements which shall at least include the safe handling,
  1  6 application, and storage of pesticides, the correct
  1  7 calibration of equipment used for the application of
  1  8 pesticides, and the effects of pesticides upon the
  1  9 groundwater.  The department shall adopt by rule criteria for
  1 10 allowing a person required to be certified to complete either
  1 11 a written or oral examination.  The examination for commercial
  1 12 applicators shall be given at each community college, as
  1 13 defined in section 260C.2, not less frequently than once every
  1 14 calendar month if one or more commercial applicators wish to
  1 15 take the examination.  The department shall formulate and
  1 16 score the examination for commercial applicators.  The
  1 17 department may select persons who are not employees of the
  1 18 department to proctor and administer the examination for
  1 19 commercial applicators.  The department shall administer the
  1 20 instructional courses, by either teaching the courses or
  1 21 selecting persons to teach the courses, according to criteria
  1 22 as provided by rules adopted by the department.  The
  1 23 department shall, to the extent possible, select persons to
  1 24 teach the courses in each county.  The department is not
  1 25 required to compensate persons selected to teach the courses.
  1 26 In selecting persons, the department shall rely upon
  1 27 organizations interested in the application of pesticides,
  1 28 including associations representing pesticide applicators and
  1 29 associations representing agricultural producers.  The Iowa
  1 30 cooperative extension service in agriculture and home
  1 31 economics of Iowa state university of science and technology
  1 32 shall cooperate with the department in administering the
  1 33 instructional courses.  The Iowa cooperative extension service
  1 34 may teach courses, train persons selected to teach courses, or
  1 35 distribute informational materials to persons teaching the
  2  1 courses.  
  2  2                           EXPLANATION
  2  3    Commercial applicators of pesticides are required to
  2  4 complete an examination prior to receiving certification.
  2  5 This bill requires that examinations for commercial
  2  6 applicators be given at each community college not less
  2  7 frequently than once every calendar month if one or more
  2  8 commercial applicators wish to take the examination.  The bill
  2  9 directs the department of agriculture and land stewardship to
  2 10 formulate and score the examination for commercial
  2 11 applicators.  The bill provides that the department of
  2 12 agriculture and land stewardship may select persons who are
  2 13 not employees of the department to proctor and administer the
  2 14 examinations for commercial applicators.
