PAG LIN 1 1 Section 1. Section 692A.1, subsection 3, paragraph k, Code 1 2 Supplement 1995, is amended to read as follows: 1 3 k. Stalking in violation of section 708.11, subsection 3, 1 4 paragraph "b", subparagraph (3), if the fact-finder determines 1 5 by clear and convincing evidence that the offense was sexually 1 6 motivated. 1 7 l. Sexual exploitation of a minor in violation of section 1 8 728.12, subsection 2 or 3. 1 9 m. An indictable offense committed in another jurisdiction 1 10 which would constitute an indictable offense under paragraphs 1 11 "a" through"j""l". 1 12 Sec. 2. Section 692A.1, subsection 6, Code Supplement 1 13 1995, is amended by adding the following new paragraphs after 1 14 paragraph c: 1 15 NEW PARAGRAPH. d. Telephone dissemination of obscene 1 16 materials in violation of section 728.15. 1 17 NEW PARAGRAPH. e. Rental or sale of hard-core pornography 1 18 in violation of section 728.4. 1 19 NEW PARAGRAPH. f. Indecent exposure in violation of 1 20 section 709.9. 1 21 Sec. 3. Section 692A.1, subsection 6, paragraph d, Code 1 22 Supplement 1995, is amended to read as follows: 1 23d.g. Any of the following offenses, if the offense 1 24 involves sexual abuse or attempted sexual abuse: murder, 1 25 attempted murder, kidnapping,orburglary, or manslaughter. 1 26 Sec. 4. Section 692A.5, subsection 2, Code Supplement 1 27 1995, is amended by adding the following new unnumbered 1 28 paragraph: 1 29 NEW UNNUMBERED PARAGRAPH. If the offender refuses to 1 30 register, the sheriff, warden, or superintendent shall 1 31 immediately notify a prosecuting attorney of the refusal to 1 32 register. The prosecuting attorney may bring a contempt of 1 33 court action against the offender in the county in which the 1 34 offender was convicted. An offender who refuses to register 1 35 may be held in contempt and incarcerated following the entry 2 1 of judgment by the court on the contempt action until the 2 2 offender complies with the registration requirements. 2 3 Sec. 5. Section 692A.13, Code Supplement 1995, is amended 2 4 by adding the following new subsection: 2 5 NEW SUBSECTION. 8. Records regarding the persons 2 6 requesting registry information shall be maintained for ten 2 7 years. 2 8 Sec. 6. The department of human services shall work with 2 9 the department of public safety to develop a single point of 2 10 contact for persons seeking information regarding individuals 2 11 who may be listed on the child abuse registry created in 2 12 section 235A.14, the dependent adult abuse registry created in 2 13 section 235B.5, or the sex offender registry created in 2 14 section 692A.10. The department of human services and the 2 15 department of public safety shall also study the issue of 2 16 information sharing among the registries. The department of 2 17 human services and the department of public safety shall 2 18 present a joint report to the general assembly not later than 2 19 December 15, 1996, regarding the feasibility of creating a 2 20 single point of contact for information on the registries and 2 21 providing information sharing among the registries, including 2 22 the statutory changes necessary for implementation. 2 23 SF 2208 2 24 mk/cc/26
