  1  1    Section 1.  Section 331.439, subsection 3, Code Supplement
  1  2 1995, is amended to read as follows:
  1  3    3.  a.  For the fiscal year beginning July 1, 1996, and
  1  4 succeeding fiscal years, the county's mental health, mental
  1  5 retardation, and developmental disabilities service
  1  6 expenditures for a fiscal year are limited to a fixed budget
  1  7 amount.  The fixed budget amount shall be the amount
  1  8 identified in the county's management plan and budget for the
  1  9 fiscal year.  The county shall be allowed an inflation factor
  1 10 adjustment for services paid from the county's services fund
  1 11 under section 331.424A which is in accordance with the
  1 12 county's management plan and budget, implemented pursuant to
  1 13 this section.
  1 14    b.  Based upon information contained in county management
  1 15 plans and budgets, the state-county management committee shall
  1 16 recommend an inflation factor adjustment to the council on
  1 17 human services by November 15 for the succeeding fiscal year.
  1 18 The inflation factor adjustment shall address costs associated
  1 19 with new consumers of service, service cost inflation, and
  1 20 investments for economy and efficiency.  The council on human
  1 21 services shall recommend to the governor the amount of the
  1 22 inflation factor adjustment for the succeeding fiscal year.
  1 23 The governor shall consider the council's recommendation in
  1 24 developing the governor's recommendation for an inflation
  1 25 factor adjustment for inclusion in the governor's proposed
  1 26 budget for the succeeding fiscal year submitted in accordance
  1 27 with chapter 8.
  1 28    c.  If the general assembly has not revised the amount of
  1 29 the inflation factor adjustment for a fiscal year on the date
  1 30 county budgets must be approved and levies must be certified
  1 31 for that fiscal year, the budgets and levies shall utilize the
  1 32 inflation factor adjustment for that fiscal year recommended
  1 33 by the governor in the governor's proposed budget.
  1 34    Sec. 2.  STATE-COUNTY MANAGEMENT COMMITTEE.  The state-
  1 35 county management committee created in section 331.438 shall
  2  1 review the inflation factor adjustment mechanism created in
  2  2 this Act with attention to the three cost factors incorporated
  2  3 in the mechanism:  new consumers of service, service cost
  2  4 inflation, and investments for economy and efficiency.  The
  2  5 committee shall make recommendations regarding equity,
  2  6 administrative simplicity, and distribution issues associated
  2  7 with implementing the inflation factor adjustment to address,
  2  8 in an effective manner, the cost factors comprising the
  2  9 mechanism.  The committee's review and recommendations shall
  2 10 be included in the annual report to be submitted by January 1,
  2 11 1997, to the governor, general assembly, and department of
  2 12 human services pursuant to section 331.438.
  2 13    Sec. 3.  APPLICABILITY.  The amendment in this Act to
  2 14 section 331.439, subsection 3, relating to an inflation factor
  2 15 adjustment, first applies to the budget process for the fiscal
  2 16 year beginning July 1, 1997.  
  2 17                           EXPLANATION
  2 18    This bill relates to state and county funding for mental
  2 19 health and developmental disability services.
  2 20    Section 331.439, subsection 3, is amended to provide a
  2 21 methodology for establishing an inflation factor adjustment
  2 22 for expenditures for the costs of county mental health and
  2 23 developmental disability services.  The state-county
  2 24 management committee is to make an initial recommendation to
  2 25 the council on human services which in turn is to make a
  2 26 recommendation to the governor.  The governor is to consider
  2 27 the council's recommendation in developing the governor's
  2 28 recommendation for inclusion in the governor's proposed budget
  2 29 for the succeeding fiscal year unless revised by action of the
  2 30 general assembly, the governor's budget recommendation for the
  2 31 inflation factor adjustment is to be used in county budgets
  2 32 and levies for the succeeding fiscal year.  The bill includes
  2 33 an applicability provision specifying the inflation factor
  2 34 adjustment first applies to the budget process for the fiscal
  2 35 year beginning July 1, 1997.
  3  1    The bill directs the state-county management committee to
  3  2 review the inflation factor adjustment mechanism established
  3  3 in the bill and to make recommendations.  The recommendations
  3  4 are to be incorporated in the committee's annual report which
  3  5 is to be submitted by January 1, 1997.
