1 1 Section 1. NEW SECTION. 514C.11 SERVICES PROVIDED BY
1 2 LICENSED ADVANCED REGISTERED NURSE PRACTITIONERS.
1 3 Notwithstanding section 514C.6, a policy, contract, or plan
1 4 providing for third-party payment or prepayment of health or
1 5 medical expenses shall include a provision for the payment of
1 6 necessary medical or surgical care and treatment provided by
1 7 an advanced registered nurse practitioner licensed pursuant to
1 8 chapters 147 and 152, if performed within the scope of the
1 9 licensed advanced registered nurse practitioner's license and
1 10 the policy, contract, or plan would pay for the care and
1 11 treatment if the care and treatment were provided by a person
1 12 engaged in the practice of medicine or surgery as licensed
1 13 under chapter 148 or 150A. The policy, contract, or plan
1 14 shall provide that insureds or enrollees under the policy,
1 15 contract, or plan may reject the coverage for services which
1 16 may be provided by a licensed advanced registered nurse
1 17 practitioner if the coverage is rejected for all providers of
1 18 similar services. The terms and conditions under which
1 19 advanced registered nurse practitioner services are
1 20 compensated shall not contain practice or supervision
1 21 restrictions in addition to those already imposed by law as of
1 22 July 1, 1996. This section applies to services provided under
1 23 a policy, contract, or plan issued on or after July 1, 1996,
1 24 and to an existing policy, contract, or plan on the policy's,
1 25 contract's, or plan's anniversary or renewal date, or upon the
1 26 expiration of the applicable collective bargaining contract,
1 27 if any, whichever is later. This section does not apply to
1 28 enrollees eligible for coverage under Title XVIII of the
1 29 federal Social Security Act or any other similar coverage
1 30 under a state or federal government plan.
1 31 EXPLANATION
1 32 The bill creates new section 514C.11 and requires insurance
1 33 companies and other third-party payors to provide
1 34 reimbursement for services provided by a licensed advanced
1 35 registered nurse practitioner if reimbursement for such
2 1 services would be provided by a person engaged in the practice
2 2 of medicine or surgery as licensed under chapter 148 or 150A.
