PAG LIN 1 1 Section 1. NEW SECTION. 8.57A LOST FEDERAL FUNDS 1 2 STABILIZATION ACCOUNT. 1 3 1. A lost federal funds stabilization account is created 1 4 as a separate account in the state treasury. The account 1 5 shall consist of appropriations made to the account and 1 6 transfers of interest, earnings, and moneys from other funds 1 7 and accounts as provided by law. The account shall be 1 8 separate from the general fund of the state and the balance in 1 9 the account shall not be considered part of the balance of the 1 10 general fund of the state. Moneys in the account may be used 1 11 for cash flow purposes provided moneys so allocated are 1 12 returned to the account by the end of each fiscal year. 1 13 2. Moneys in the stabilization account are not subject to 1 14 section 8.33. Notwithstanding section 12C.7, subsection 2, 1 15 interest or earnings on moneys in the stabilization account 1 16 shall be credited to the rebuild Iowa infrastructure fund 1 17 created in section 8.57. 1 18 3. Moneys in the stabilization account shall be used in 1 19 accordance with appropriations made by the general assembly to 1 20 replace funds previously expended but no longer expended by 1 21 the federal government in or to the credit of this state. 1 22 Moneys appropriated from the fund for the purposes of a 1 23 program shall be limited to the reduction in the amount of 1 24 federal funds expended for purposes of the program for a state 1 25 fiscal year from the amount expended by the federal government 1 26 in either of the two state fiscal years preceding the state 1 27 fiscal year for which the funds are appropriated. 1 28 4. The federal block grant purposes for which 1 29 appropriations may be made under this section shall include 1 30 but are not limited to substance abuse. 1 31 5. The federal block grant purposes for which 1 32 appropriations may be made under this section shall include 1 33 but are not limited to community mental health services. 1 34 6. The federal block grant purposes for which 1 35 appropriations may be made under this section shall include 2 1 but are not limited to maternal and child health services. 2 2 7. The federal block grant purposes for which 2 3 appropriations may be made under this section shall include 2 4 but are not limited to preventive health and health services. 2 5 8. The federal block grant purposes for which 2 6 appropriations may be made under this section shall include 2 7 but are not limited to drug control and system improvement 2 8 grants. 2 9 9. The federal block grant purposes for which 2 10 appropriations may be made under this section shall include 2 11 but are not limited to community services. 2 12 10. The federal block grant purposes for which 2 13 appropriations may be made under this section shall include 2 14 but are not limited to community development. 2 15 11. The federal block grant purposes for which 2 16 appropriations may be made under this section shall include 2 17 but are not limited to education. 2 18 12. The federal block grant purposes for which 2 19 appropriations may be made under this section shall include 2 20 but are not limited to low-income home energy assistance. 2 21 13. The federal block grant purposes for which 2 22 appropriations may be made under this section shall include 2 23 but are not limited to social services. 2 24 14. The federal block grant purposes for which 2 25 appropriations may be made under this section shall include 2 26 but are not limited to projects for assistance in transition 2 27 from homelessness. 2 28 15. The federal block grant purposes for which 2 29 appropriations may be made under this section shall include 2 30 but are not limited to child care and development. 2 31 16. The federal block grant purposes for which 2 32 appropriations may be made under this section shall include 2 33 but are not limited to department of agriculture and land 2 34 stewardship programs. 2 35 17. The federal block grant and other programs and payment 3 1 purposes for which appropriations may be made under this 3 2 section shall include but are not limited to United States 3 3 department of agriculture programs and payments. 3 4 18. The federal block grant purposes for which 3 5 appropriations may be made under this section shall include 3 6 but are not limited to department of justice programs. 3 7 19. The federal block grant purposes for which 3 8 appropriations may be made under this section shall include 3 9 but are not limited to auditor of state programs. 3 10 20. The federal block grant purposes for which 3 11 appropriations may be made under this section shall include 3 12 but are not limited to department for the blind programs. 3 13 21. The federal block grant purposes for which 3 14 appropriations may be made under this section shall include 3 15 but are not limited to ethics and campaign disclosure board 3 16 programs. 3 17 22. The federal block grant purposes for which 3 18 appropriations may be made under this section shall include 3 19 but are not limited to Iowa state civil rights commission 3 20 programs. 3 21 23. The federal block grant purposes for which 3 22 appropriations may be made under this section shall include 3 23 but are not limited to college student aid commission 3 24 programs. 3 25 24. The federal block grant purposes for which 3 26 appropriations may be made under this section shall include 3 27 but are not limited to department of commerce programs. 3 28 25. The federal block grant purposes for which 3 29 appropriations may be made under this section shall include 3 30 but are not limited to department of corrections programs. 3 31 26. The federal block grant purposes for which 3 32 appropriations may be made under this section shall include 3 33 but are not limited to department of cultural affairs 3 34 programs. 3 35 27. The federal block grant purposes for which 4 1 appropriations may be made under this section shall include 4 2 but are not limited to department of elder affairs programs. 4 3 28. The federal block grant purposes for which 4 4 appropriations may be made under this section shall include 4 5 but are not limited to department of employment services 4 6 programs. 4 7 29. The federal block grant purposes for which 4 8 appropriations may be made under this section shall include 4 9 but are not limited to department of general services 4 10 programs. 4 11 30. The federal block grant purposes for which 4 12 appropriations may be made under this section shall include 4 13 but are not limited to governor and lieutenant governor 4 14 programs. 4 15 31. The federal block grant purposes for which 4 16 appropriations may be made under this section shall include 4 17 but are not limited to department of human rights programs. 4 18 32. The federal block grant purposes for which 4 19 appropriations may be made under this section shall include 4 20 but are not limited to department of inspections and appeals 4 21 programs. 4 22 33. The federal block grant purposes for which 4 23 appropriations may be made under this section shall include 4 24 but are not limited to judicial department programs. 4 25 34. The federal block grant purposes for which 4 26 appropriations may be made under this section shall include 4 27 but are not limited to Iowa law enforcement academy programs. 4 28 35. The federal block grant purposes for which 4 29 appropriations may be made under this section shall include 4 30 but are not limited to department of management programs. 4 31 36. The federal block grant purposes for which 4 32 appropriations may be made under this section shall include 4 33 but are not limited to department of natural resources 4 34 programs. 4 35 37. The federal block grant purposes for which 5 1 appropriations may be made under this section shall include 5 2 but are not limited to board of parole programs. 5 3 38. The federal block grant purposes for which 5 4 appropriations may be made under this section shall include 5 5 but are not limited to department of personnel programs. 5 6 39. The federal block grant purposes for which 5 7 appropriations may be made under this section shall include 5 8 but are not limited to department of public defense programs. 5 9 40. The federal block grant purposes for which 5 10 appropriations may be made under this section shall include 5 11 but are not limited to public employment relations board 5 12 programs. 5 13 41. The federal block grant purposes for which 5 14 appropriations may be made under this section shall include 5 15 but are not limited to state board of regents programs. 5 16 42. The federal block grant purposes for which 5 17 appropriations may be made under this section shall include 5 18 but are not limited to department of revenue and finance 5 19 programs. 5 20 43. The federal block grant purposes for which 5 21 appropriations may be made under this section shall include 5 22 but are not limited to secretary of state programs. 5 23 44. The federal block grant purposes for which 5 24 appropriations may be made under this section shall include 5 25 but are not limited to Iowa state fair authority programs. 5 26 45. The federal block grant purposes for which 5 27 appropriations may be made under this section shall include 5 28 but are not limited to office of state-federal relations 5 29 programs. 5 30 46. The federal block grant purposes for which 5 31 appropriations may be made under this section shall include 5 32 but are not limited to treasurer of state programs. 5 33 47. The federal block grant purposes for which 5 34 appropriations may be made under this section shall include 5 35 but are not limited to department of public safety programs. 6 1 48. The federal block grant purposes for which 6 2 appropriations may be made under this section shall include 6 3 but are not limited to Iowa department of public health 6 4 programs. 6 5 49. The federal block grant purposes for which 6 6 appropriations may be made under this section shall include 6 7 but are not limited to department of human services programs. 6 8 50. The federal block grant purposes for which 6 9 appropriations may be made under this section shall include 6 10 but are not limited to department of economic development 6 11 programs. 6 12 51. The federal block grant purposes for which 6 13 appropriations may be made under this section shall include 6 14 but are not limited to state department of transportation 6 15 programs. 6 16 52. The federal block grant purposes for which 6 17 appropriations may be made under this section shall include 6 18 but are not limited to department of education programs. 6 19 53. The federal block grant purposes for which 6 20 appropriations may be made under this section shall include 6 21 but are not limited to commission of veterans affairs 6 22 programs. 6 23 54. The federal block grant purposes for which 6 24 appropriations may be made under this section shall include 6 25 but are not limited to governor's alliance on substance abuse 6 26 programs. 6 27 55. The general assembly may provide that all or part of 6 28 the moneys deposited in the GAAP deficit reduction account 6 29 created in section 8.57 shall be transferred to the 6 30 stabilization account in lieu of appropriation of the moneys 6 31 to the Iowa economic emergency fund. 6 32 56. This section is repealed September 1, 1998, and 6 33 effective upon repeal, moneys remaining in the stabilization 6 34 account which are unexpended or unobligated shall be 6 35 transferred to the general fund of the state. 7 1 Sec. 2. Section 8.58, Code Supplement 1995, is amended to 7 2 read as follows: 7 3 8.58 EXEMPTION FROM AUTOMATIC APPLICATION. 7 4 To the extent that moneys appropriated under section 8.57 7 5 do not result in moneys being credited to the general fund 7 6 under section 8.55, subsection 2, moneys appropriated under 7 7 section 8.57 and moneys contained in the cash reserve fund, 7 8 rebuild Iowa infrastructure fund,andIowa economic emergency 7 9 fund, and lost federal funds stabilization account shall not 7 10 be considered in the application of any formula, index, or 7 11 other statutory triggering mechanism which would affect 7 12 appropriations, payments, or taxation rates, contrary 7 13 provisions of the Code notwithstanding. 7 14 To the extent that moneys appropriated under section 8.57 7 15 do not result in moneys being credited to the general fund 7 16 under section 8.55, subsection 2, moneys appropriated under 7 17 section 8.57 and moneys contained in the cash reserve fund, 7 18 rebuild Iowa infrastructure fund,andIowa economic emergency 7 19 fund, and lost federal funds stabilization account shall not 7 20 be considered by an arbitrator or in negotiations under 7 21 chapter 20. 7 22 Sec. 3.
