  1  1    Section 1.  Section 483A.24, subsection 2, Code 1995, is
  1  2 amended by striking the subsection and inserting in lieu
  1  3 thereof the following:
  1  4    2.  a.  Upon written application, the department shall
  1  5 issue annually a deer hunting license to the following
  1  6 persons:
  1  7    (1)  An owner of a farm unit.
  1  8    (2)  Each member of the owner's immediate family residing
  1  9 with the owner.
  1 10    (3)  A tenant of a farm unit or a member of the tenant's
  1 11 immediate family residing with the tenant.
  1 12    b.  Upon written application, the department shall issue
  1 13 annually a wild turkey hunting license to the following
  1 14 persons:
  1 15    (1)  An owner of a farm unit or a member of the owner's
  1 16 immediate family residing with the owner.
  1 17    (2)  A tenant of a farm unit or a member of the tenant's
  1 18 immediate family residing with the tenant.
  1 19    c.  The deer or wild turkey hunting license is valid only
  1 20 for hunting on the farm unit upon which the owner or tenant or
  1 21 both are actively engaged in its operation.  Licensees under
  1 22 this subsection must be residents of this state.
  1 23    d.  The application required for the deer or wild turkey
  1 24 hunting license shall be made on forms furnished by the
  1 25 commission.  The license shall be issued without fee.  An
  1 26 applicant may apply and receive the deer or wild turkey
  1 27 hunting license through the county recorder or other
  1 28 designated county officer until the opening day of hunting
  1 29 season for the applicable game.
  1 30    e.  Deer and wild turkey hunting licenses issued under this
  1 31 subsection are subject to all other provisions of the laws and
  1 32 rules pertaining to the taking of deer and wild turkey.  The
  1 33 deer license and turkey license shall be the equivalent of the
  1 34 least restrictive license issued under section 481A.38.
  1 35    f.  As used in this subsection:
  2  1    (1)  "Farm unit" means all of the parcels of land, not
  2  2 necessarily contiguous, which are operated as a unit for
  2  3 agricultural purposes and which are under the lawful control
  2  4 of a landowner or tenant.  A landowner or tenant may designate
  2  5 parcels of agricultural land of not less than one hundred
  2  6 acres as a separate farm unit.
  2  7    (2)  "Immediate family" means a spouse, son, daughter,
  2  8 stepson, or stepdaughter.
  2  9    (3)  "Tenant" means a person, other than the landowner, who
  2 10 is actively engaged in the operation of a farm unit.
  2 11    Sec. 2.  Section 483A.24, subsections 3, 4, 5, 6, and 7,
  2 12 Code 1995, are amended by striking the subsections.  
  2 13                           EXPLANATION
  2 14    This bill strikes and rewrites those provisions of section
  2 15 483A.24 which provide for the issuance of deer and wild turkey
  2 16 hunting licenses without fee to farm unit owners and tenants.
  2 17    This bill requires the issuance of a deer hunting license
  2 18 to each farm owner and each member of the farm owner's
  2 19 immediate family.  If there is a tenant actively engaged in
  2 20 the operation of a farm unit, the tenant or a member of the
  2 21 tenant's immediate family is eligible for a deer hunting
  2 22 license.  Current law provides for a deer hunting license to
  2 23 be issued annually to the landowner or a member of the
  2 24 landowner's family, not a license for each of them.
  2 25    The bill also allows each landowner or the landowner's
  2 26 immediate family and a tenant or the tenant's immediate family
  2 27 one wild turkey hunting license annually.  This provision is
  2 28 the same as current law.
  2 29    The bill also defines farm unit and allows a landowner or
  2 30 tenant to designate parcels of agricultural land having at
  2 31 least 100 acres to be a separate farm unit.  Immediate family
  2 32 is also defined to include a spouse, son, daughter, stepson,
  2 33 and stepdaughter.
  2 34    A landowner or tenant of a farm unit must reside in this
  2 35 state, but not on the farm unit, to be eligible for the free
  3  1 licenses.  A member of the owner's immediate family or the
  3  2 tenant's immediate family must reside with the owner or tenant
  3  3 to be eligible for the free licenses.
