  1  1    Section 1.  Section 321.457, subsection 2, paragraph f,
  1  2 Code 1995, is amended to read as follows:
  1  3    f.  A motor vehicle or combination of vehicles may be
  1  4 operated upon the highways of this state, irrespective of the
  1  5 length and weight limitations imposed by the laws of this
  1  6 state, if the motor vehicle or combination of vehicles is
  1  7 operated within the corporate limits of a city abutting a
  1  8 border of this state and such operations have been approved by
  1  9 ordinance of the city council and if the length and weight of
  1 10 the motor vehicle or combination of vehicles is in conformity
  1 11 with the laws relating to length and weight of the abutting
  1 12 state on July 1, 1974.  If a city council has authorized such
  1 13 operation upon highways within the corporate limits, then the
  1 14 limit of travel for such motor vehicles or combination of
  1 15 vehicles within the state is extended to the commercial zones
  1 16 as described by federal regulations concerning interstate
  1 17 commerce, 49 code of federal regulations, paragraphs 1048.10,
  1 18 1048.38, and C.F.R. } 1048.101 as they exist on July 1, 1974.
  1 19    Sec. 2.  IMMEDIATE EFFECTIVE DATE.  This Act, being deemed
  1 20 of immediate importance, is effective upon enactment.  
  1 21                           EXPLANATION
  1 22    This bill provides that a motor vehicle or combination of
  1 23 vehicles may be operated within the corporate limits of a city
  1 24 abutting a border of this state and extends the limit of
  1 25 travel to the commercial zone of the city as prescribed in
  1 26 federal regulations, even though the length and weight of the
  1 27 vehicle violate the law of this state if the laws of the
  1 28 abutting state allow for the operation of the vehicle in the
  1 29 other state.
  1 30    The change in this section is precipitated by a change in
  1 31 federal law contained in Pub. L. No. 104-59, and signed by the
  1 32 president on November 28, 1995, which provides an exemption
  1 33 from existing length and weight limitations for vehicles using
  1 34 interstate route 29 between Sioux City, Iowa, and the border
  1 35 between Iowa and South Dakota and vehicles using interstate
  2  1 route 129 between Sioux City, Iowa, and the border between
  2  2 Iowa and Nebraska.  This bill is effective upon enactment.
