1 1 Section 1. NEW SECTION. 456A.37 EURASIAN WATER MILFOIL.
1 2 1. DEFINITIONS. As used in this section:
1 3 a. "Infestation of Eurasian water milfoil" means an
1 4 infestation of Eurasian water milfoil that occupies more than
1 5 twenty percent of the littoral area of a body of water.
1 6 b. "Watercraft" means any vessel which through the
1 7 buoyance of water floats upon the water and is capable of
1 8 carrying one or more persons.
1 9 2. EURASIAN WATER MILFOIL MANAGEMENT PLAN. Before January
1 10 1, 1998, the commission shall prepare a long-term statewide
1 11 Eurasian water milfoil management plan. The plan shall
1 12 address all of the following:
1 13 a. The detection and prevention of accidental
1 14 introductions into the state of Eurasian water milfoil.
1 15 b. A public awareness campaign regarding Eurasian water
1 16 milfoil.
1 17 c. The control and eradication of Eurasian water milfoil
1 18 in public waters.
1 19 d. The development of a plan of containment strategies
1 20 that at a minimum shall include all of the following:
1 21 (1) The participation by lake associations, local citizens
1 22 groups, and local units of government in the development and
1 23 implementation of lake management plans where Eurasian water
1 24 milfoil exists.
1 25 (2) Notice to travelers of the penalties for violation of
1 26 laws relating to Eurasian water milfoil.
1 27 3. GRANTS. The director of the department of natural
1 28 resources shall accept gifts, donations, and grants to aid in
1 29 accomplishing the control and eradication of Eurasian water
1 30 milfoil.
1 31 4. RULEMAKING. The commission shall adopt rules pursuant
1 32 to chapter 17A. The rules shall:
1 33 a. Restrict the introduction, propagation, use,
1 34 possession, and spread of Eurasian water milfoil.
1 35 b. Identify bodies of water with infestation of Eurasian
2 1 water milfoil. The department shall require that bodies of
2 2 water be posted as infested. The department may prohibit
2 3 boating, fishing, swimming, and trapping in infested bodies of
2 4 water.
2 5 5. PROHIBITIONS.
2 6 a. A person shall not do any of the following:
2 7 (1) Transport Eurasian water milfoil on a public road.
2 8 (2) Place a trailer or launch a watercraft with Eurasian
2 9 water milfoil attached in public waters.
2 10 (3) Operate a watercraft in a marked Eurasian water
2 11 milfoil infestation area.
2 12 b. The penalty for violating this subsection is contained
2 13 in section 805.8, subsection 5B.
2 14 Sec. 2. Section 805.8, Code Supplement 1995, is amended by
2 15 adding the following new subsection:
2 16 NEW SUBSECTION. 5B. EURASIAN WATER MILFOIL. For
2 17 violations of section 456A.37, subsection 5, the scheduled
2 18 fine is one hundred dollars.
