1 1 Section 1. Section 99B.5, subsection 1, paragraph g, Code
1 2 1995, is amended by striking the paragraph and inserting in
1 3 lieu thereof the following:
1 4 g. The actual retail value of any prize does not exceed
1 5 two hundred dollars. If a prize consists of more than one
1 6 item, unit, or part, the aggregate retail value of all items,
1 7 units, or parts shall not exceed two hundred dollars.
1 8 However, either a fair sponsor or a qualified organization,
1 9 but not both, may hold one raffle per calendar year at which
1 10 prizes having a combined value of more than two hundred
1 11 dollars may be offered. If the prize is merchandise, its
1 12 value shall be determined by the purchase price paid by the
1 13 fair sponsor or qualified organization.
1 14 Sec. 2. Section 99B.5, Code 1995, is amended by adding the
1 15 following new subsections:
1 16 NEW SUBSECTION. 3. A licensee under this section may hold
1 17 one real property raffle per calendar year at which the value
1 18 of the real property may exceed two hundred dollars in lieu of
1 19 the annual raffle authorized in subsection 1, paragraph "g",
1 20 if all of the following requirements are met:
1 21 a. The licensee has submitted the special real property
1 22 raffle license application and a fee of one hundred dollars to
1 23 the department, has been issued a license, and prominently
1 24 displays the license at the drawing area of the raffle.
1 25 b. The real property was acquired by gift or donation or
1 26 has been owned by the licensee for a period of at least five
1 27 years.
1 28 c. All other requirements of this section and section
1 29 99B.2 are met, except that the cost to participate in the
1 30 raffle may exceed one dollar for each participant.
1 31 d. Receipts from the raffle are kept in a separate
1 32 financial account.
1 33 e. A cumulative report for the raffle on a form determined
1 34 by the department and one percent of the gross receipts are
1 35 submitted to the department within sixty days of the raffle
2 1 drawing. The one percent of the gross receipts shall be
2 2 retained by the department to pay for the cost of the special
2 3 audit.
2 4 NEW SUBSECTION. 4. For each real property raffle license
2 5 issued, the department shall conduct a special audit of the
2 6 raffle to verify compliance with the appropriate requirements
2 7 of this chapter.
2 8 Sec. 3. Section 99B.7, subsection 1, paragraph d, Code
2 9 1995, is amended by striking the paragraph and inserting in
2 10 lieu thereof the following:
2 11 d. Cash prizes shall not be awarded in games other than
2 12 bingo and raffles. The value of a prize shall not exceed two
2 13 hundred dollars and merchandise prizes shall not be
2 14 repurchased. If a prize consists of more than one item, unit,
2 15 or part, the aggregate value of all items, units, or parts
2 16 shall not exceed two hundred dollars. However, one raffle may
2 17 be conducted per calendar year at which prizes having a
2 18 combined value of more than two hundred dollars may be
2 19 awarded. If the prize is merchandise, its value shall be
2 20 determined by purchase price paid by the organization or
2 21 donor.
2 22 Sec. 4. Section 99B.7, subsection 1, Code 1995, is amended
2 23 by adding the following new paragraphs:
2 24 NEW PARAGRAPH. q. A licensee under this section may hold
2 25 one real property raffle per calendar year at which the value
2 26 of the real property may exceed two hundred dollars in lieu of
2 27 the annual raffle authorized in subsection 1, paragraph "d",
2 28 if all of the following requirements are met:
2 29 (1) The licensee has submitted the special real property
2 30 raffle property license application and a fee of one hundred
2 31 dollars to the department, has been issued a license, and
2 32 prominently displays the license at the drawing area of the
2 33 raffle.
2 34 (2) The real property was acquired by gift or donation or
2 35 has been owned by the licensee for a period of at least five
3 1 years.
3 2 (3) All other requirements of this section and section
3 3 99B.2 are met, except that the cost to participate in the
3 4 raffle may exceed one dollar for each participant.
3 5 (4) Receipts from the raffle are kept in a separate
3 6 financial account.
3 7 (5) A cumulative report for the raffle on a form
3 8 determined by the department and one percent of the gross
3 9 receipts are submitted to the department within sixty days of
3 10 the raffle drawing. The one percent of the gross receipts
