PAG LIN 1 1 Section 1. NEW SECTION. 104C.1 DEFINITIONS. 1 2 For purposes of this section, unless the context otherwise 1 3 requires: 1 4 1. "Department" means the Iowa department of public 1 5 health. 1 6 2. "HVAC" means heating, ventilation, and air 1 7 conditioning. 1 8 Sec. 2. NEW SECTION. 104C.2 DEPARTMENT DUTIES. 1 9 The department shall adopt rules under chapter 17A 1 10 procedures for all of the following: 1 11 1. For the examination of applicants for certification 1 12 pursuant to this chapter. 1 13 2. For the approval of an examination for certification 1 14 which satisfies the requirements as established by the 1 15 department and which is offered by a municipality to a plumber 1 16 or HVAC professional, which upon successful completion will 1 17 result in such plumber or HVAC professional being certified. 1 18 3. Establishing criteria for continuing education, which 1 19 shall include sixteen hours of continuing education 1 20 instruction during the two-year period of certification. 1 21 4. Maintaining a registry for all certified plumbers and 1 22 HVAC professionals. 1 23 5. Establishing fees sufficient for the administration of 1 24 this chapter. 1 25 Sec. 3. NEW SECTION. 104C.3 VOLUNTARY CERTIFICATION &endash; 1 26 REGISTRATION &endash; CONTINUING EDUCATION. 1 27 1. A plumber or HVAC professional may apply to take an 1 28 examination for certification under this chapter. The 1 29 application may be made to the department or to a municipality 1 30 offering an examination which has been approved by the 1 31 department. Upon successful completion of the examination by 1 32 the applicant the department shall enter the applicant's name 1 33 on the registry and issue a certificate to the applicant 1 34 indicating that the applicant has successfully completed the 1 35 examination and is certified to install and repair plumbing or 2 1 HVAC systems. 2 2 2. A certification pursuant to this chapter expires two 2 3 years from the date issued. The certification may be renewed 2 4 as determined by the department upon application by the 2 5 certificate holder, without examination. Application for 2 6 renewal shall be made in writing to the department accompanied 2 7 by the required renewal certification fee at least thirty days 2 8 prior to the expiration date of the certificate. The 2 9 application shall include the continuing education programs 2 10 which the applicant attended during the previous two-year 2 11 period. 2 12 3. A plumber or HVAC professional who successfully 2 13 completes the examination and is certified pursuant to this 2 14 chapter shall not be required to take any other examination in 2 15 this state, which is offered by another municipality, to be 2 16 able to engage in the installation and repair of plumbing or 2 17 HVAC systems in that municipality. 2 18 Sec. 4. NEW SECTION. 104C.4 PROHIBITED ACT &endash; PENALTY. 2 19 A person shall not advertise or hold oneself out to the 2 20 public as a certified plumber or certified HVAC professional 2 21 unless the person is certified pursuant to this chapter. A 2 22 person who falsely claims to be a certified plumber or 2 23 certified HVAC professional pursuant to this chapter, either 2 24 in writing or in other communications, is guilty of a simple 2 25 misdemeanor. 2 26 EXPLANATION 2 27 This bill creates a new chapter 104C relating to the 2 28 voluntary certification of plumbers and heat, ventilation, and 2 29 air conditioning (HVAC) professionals. 2 30 New section 104C.1 establishes definitions for terms used 2 31 in the chapter. 2 32 New section 104C.2 directs the department of public health 2 33 to adopt rules for the examination of applicants for 2 34 certification, approval of examinations to be given for 2 35 certification, establishment of criteria for continuing 3 1 education, establishment of a registry, and for establishing 3 2 fees. 3 3 New section 104C.3 provides that certification under this 3 4 chapter is voluntary. The section provides that a 3 5 certification granted under the chapter expires after two 3 6 years. The section also provides that a plumber or HVAC 3 7 professional who successfully completes an examination and is 3 8 certified under this chapter shall not be required to take any 3 9 other exam in this state. 3 10 New section 104C.4 provides that a person who advertises or 3 11 holds oneself out to the public as a certified plumber or 3 12 certified HVAC professional, and who is not certified, is 3 13 guilty of a simple misdemeanor. 3 14 LSB 1448SZ 76 3 15 mj/sc/14
