PAG LIN 1 1 Section 1. Section 455D.10A, subsection 2, Code 1995, is 1 2 amended to read as follows: 1 3 2. MERCURY CONTENT LIMITED. 1 4 a.Beginning July 1, 1993, aA person shall not sell, 1 5 distribute, or offer for retail sale in this state an alkaline 1 6 manganese battery that contains more than twenty-five one- 1 7 thousandths of a percent mercury by weight, or a button cell1 8battery which contains more than twenty-five milligrams of1 9mercury.Effective January 1, 1996, aA person shall not 1 10 sell, distribute, or offer for sale at retail in this state an 1 11 alkaline manganese household battery manufactured on or after 1 12 January 1, 1996, to which mercury has been added. This 1 13 paragraph does not apply to alkaline manganese button cell 1 14 batteries. 1 15 b. A person shall not sell, distribute, or offer for 1 16 retail sale in this state an alkaline manganese button cell 1 17 battery which contains more than twenty-five milligrams of 1 18 mercury. 1 19 EXPLANATION 1 20 This bill clarifies that a person cannot sell, distribute, 1 21 or offer for retail sale an alkaline manganese button cell 1 22 battery containing more than 25 milligrams of mercury. 1 23 Current law prohibits the sale or distribution of alkaline 1 24 manganese household batteries containing mercury beginning 1 25 January 1, 1996. This bill amends that provision to allow for 1 26 the retail sale of alkaline manganese household batteries 1 27 after January 1, 1996, provided the batteries were 1 28 manufactured prior to that date. 1 29 LSB 2597SV 76 1 30 js/sc/14
