PAG LIN 1 1 Section 1. Section 37.9, Code 1995, is amended by adding 1 2 the following new unnumbered paragraph: 1 3 NEW UNNUMBERED PARAGRAPH. In cities having a population of 1 4 more than one hundred thousand, the city council may 1 5 establish, by ordinance, the number of commission members at 1 6 not less than five. 1 7 Sec. 2. Section 37.15, Code 1995, is amended to read as 1 8 follows: 1 9 37.15 EX OFFICIO MEMBER. 1 10In case any suchIf a memorial hall or buildingshall beis 1 11 a city hall, coliseum, or auditorium, the mayor ofsuchthe 1 12 city may be an ex officio voting member of the commission 1 13heretofore provided for, in which case there shall be selected1 14but four commissioners as otherwise provided, and such four,1 15together with the mayor, shall constitute a commission of five1 16 created in section 37.9. 1 17 Sec. 3. Section 400.1, unnumbered paragraph 1, Code 1995, 1 18 is amended to read as follows: 1 19 In cities having a population of eight thousand or over, 1 20 having a paid fire department or a paid police department, the 1 21 mayor, one year after each regular municipal election, with 1 22 the approval of the council, shall appoint three civil service 1 23 commissioners who shall hold office, one until the first 1 24 Monday in April of the second year, one until the first Monday 1 25 in April of the fourth year, and one until the first Monday in 1 26 April of the sixth year after such appointment, whose 1 27 successors shall be appointed for a term of six years. In 1 28 cities having a population of more than one hundred thousand, 1 29 the city council may establish, by ordinance, the number of 1 30 civil service commissioners at not less than three. 1 31 Sec. 4. Section 403.15, subsection 2, Code 1995, is 1 32 amended to read as follows: 1 33 2. If the urban renewal agency is authorized to transact 1 34 business and exercise powers pursuant tothethis chapter, the 1 35 mayor or chairperson of the board, as applicable, by and with 2 1 the advice and consent of the local governing body, shall 2 2 appoint a board of commissioners of the urban renewal agency, 2 3 which board shall consist of five commissioners. In cities 2 4 having a population of more than one hundred thousand, the 2 5 city council may establish, by ordinance, the number of 2 6 commissioners at not less than five. The term of office of 2 7 each such commissioner shall be one year. 2 8 Sec. 5. Section 403A.5, unnumbered paragraph 2, Code 1995, 2 9 is amended to read as follows: 2 10 If the municipal housing agency is authorized to transact 2 11 business and exercise powers hereunder, the mayor, by and with 2 12 the advice and consent of the local governing body, shall 2 13 appoint a board of commissioners of the municipal housing 2 14 agency which board shall consist of five commissioners. The 2 15 term of office for three of the commissioners originally 2 16 appointed shall be two years and the term of office for two of 2 17 the commissioners originally appointed shall be one year. 2 18 Thereafter the term of office for each commissioner shall be 2 19 two years. In cities having a population of more than one 2 20 hundred thousand, the city council may establish, by 2 21 ordinance, the number of commissioners at not less than five. 2 22 EXPLANATION 2 23 This bill authorizes cities with a population of more than 2 24 100,000 to increase the membership of certain city boards and 2 25 commissions, the membership of which is specified by state 2 26 law. These boards and commissions include the veterans 2 27 memorial building commission, civil service commission, 2 28 commission for an urban renewal agency, and commission for a 2 29 municipal housing agency. This bill allows these larger 2 30 cities the option of appointing more than three or five 2 31 members to these boards and commissions. 2 32 LSB 1791SV 76 2 33 tj/jj/8
