  1  1    Section 1.  Section 468.101, Code 1995, is amended to read
  1  2 as follows:
  1  3    468.101  COMPLETION OF WORK &endash; REPORT &endash; NOTICE.
  1  4    When the work to be done under any a contract is completed
  1  5 to the satisfaction of the engineer in charge of construction,
  1  6 the engineer shall so report and certify that the contract is
  1  7 completed to the board, which.  Upon receipt of the report,
  1  8 the board shall fix set a day to consider the report and shall
  1  9 give notice of the time and purpose of the meeting by ordinary
  1 10 mail to the landowners of the district owners of the land on
  1 11 which the work was done, and to the owners of each tract of
  1 12 land or lot within the district by publication in a newspaper
  1 13 of general circulation in the county, and the.  The
  1 14 publication is not required to name the owners of any tract of
  1 15 land or lot within the district.  The date fixed for
  1 16 considering the report by the board shall be not less than ten
  1 17 days after the date of mailing, or publication, whichever is
  1 18 later.  
  1 19                           EXPLANATION
  1 20    This bill amends chapter 468 which governs drainage and
  1 21 levee districts.  The chapter provides that the governing body
  1 22 of a drainage or levee district may contract for work done
  1 23 within the district.  Section 468.101 provides that when work
  1 24 done under a contract is completed to the satisfaction of the
  1 25 engineer in charge of construction, the engineer must report
  1 26 the completed work to the governing board of the district.
  1 27 The board must set a day to consider the report and provide
  1 28 notice of the time and purpose of the meeting by ordinary mail
  1 29 to the landowners of the district and by publication in a
  1 30 newspaper of general circulation in the county.  Section
  1 31 357.18 provides that the same process is applicable in water
  1 32 districts.
  1 33    This bill provides that for drainage and levee districts
  1 34 and for water districts, the notice must be delivered to the
  1 35 owners of the land on which the work was done, and by
  2  1 publication to other landowners in the district without naming
  2  2 the landowners.
