  1  1    Section 1.  Section 902.7, Code 1995, is amended to read as
  1  2 follows:
  1  3    902.7  MINIMUM SENTENCE &endash; USE POSSESSION OF A FIREARM.
  1  4    At the trial of a person charged with participating in a
  1  5 forcible felony, if the trier of fact finds beyond a
  1  6 reasonable doubt that the person is guilty of a forcible
  1  7 felony and that the person represented that the person was in
  1  8 the immediate possession and control of a firearm, displayed a
  1  9 firearm in a threatening manner, or was armed with a firearm
  1 10 while participating in the forcible felony the convicted
  1 11 person shall serve a minimum of five years of the sentence
  1 12 imposed by law.  A person sentenced pursuant to this section
  1 13 shall not be eligible for parole until the person has served
  1 14 the minimum sentence of confinement imposed by this section.
  1 15    Sec. 2.  NEW SECTION.  902.7A  FORCIBLE FELONY SENTENCE &endash;
  1 16 USE OR DISPLAY OF A FIREARM.
  1 17    At the trial of a person charged with participating in a
  1 18 forcible felony, if the trier of fact finds beyond a
  1 19 reasonable doubt that the person is guilty of a forcible
  1 20 felony and that the person used a firearm or displayed the
  1 21 firearm in a threatening manner while participating in the
  1 22 forcible felony, the person shall serve the person's sentence
  1 23 as follows:
  1 24    1.  If the forcible felony is a class "B" felony or
  1 25 greater, the person shall serve not less than twenty years of
  1 26 the sentence and shall not be eligible for parole until the
  1 27 person has served the twenty years.
  1 28    2.  If the forcible felony is a class "C" or "D" felony,
  1 29 the person shall be sentenced to and shall serve twenty years,
  1 30 and shall not be eligible for release until the person has
  1 31 served the twenty years, notwithstanding any other provision
  1 32 of law.  
  1 33                           EXPLANATION
  1 34    This bill provides a mandatory minimum period of
  1 35 confinement of 20 years for the commission of a forcible
  2  1 felony with a firearm.
