  1  1                     DEPARTMENT OF EDUCATION
  1  2    Section 1.  There is appropriated from the general fund of
  1  3 the state to the department of education for the fiscal year
  1  4 beginning July 1, 1995, and ending June 30, 1996, the
  1  5 following amounts, or so much thereof as may be necessary, to
  1  6 be used for the purposes designated:
  1  7    1.  GENERAL ADMINISTRATION
  1  8    For salaries, support, maintenance, miscellaneous purposes,
  1  9 and for not more than the following full-time equivalent
  1 10 positions:  
  1 11 .................................................. $  5,134,445

  1 13    One of the full-time equivalent positions provided
  1 14 for under this subsection shall be filled by an
  1 15 individual hired by the department of education to
  1 16 direct and administer the management information
  1 17 system.  The individual hired shall possess a
  1 18 background in education and administrative experience
  1 19 at the community college level.
  1 20    The department of education shall conduct a study
  1 21 of the possible uses for the remaining portion of the
  1 22 interest earned on the permanent school fund after transfers
  1 23 are made pursuant to section 257B.1A, subsections 2 and 3.
  1 24 The department shall submit a report of its findings and
  1 25 recommendations to the general assembly and the legislative
  1 26 fiscal bureau by January 1, 1996.
  1 27    The department of education shall conduct a study
  1 28 of chapter 299, the compulsory education law of this
  1 29 state, in cooperation with interested individuals from
  1 30 throughout the state.  The department shall submit a
  1 31 report of the findings and recommendations to the
  1 32 general assembly by January 1, 1996.
  1 33    2.  VOCATIONAL EDUCATION ADMINISTRATION
  1 34    For salaries, support, maintenance, miscellaneous
  1 35 purposes, and for not more than the following full-
  2  1 time equivalent positions:

  2  4    3.  VOCATIONAL REHABILITATION DIVISION
  2  5    a.  For salaries, support, maintenance, miscellaneous
  2  6 purposes, and for not more than the following full-time

  2 10    It is the intent of the general assembly that the division
  2 11 of vocational rehabilitation services of the department of
  2 12 education shall seek, in addition to state appropriations,
  2 13 funds other than federal funds, which may include but are not
  2 14 limited to local funds, for purposes of matching federal
  2 15 vocational rehabilitation funds.
  2 16    Notwithstanding the full-time equivalent position limit
  2 17 established in this subsection for the fiscal year ending June
  2 18 30, 1996, if federal funding is available to pay the costs of
  2 19 additional employees for the vocational rehabilitation
  2 20 division who would have duties relating to vocational
  2 21 rehabilitation services paid for through federal funding,
  2 22 authorization to hire not more than four full-time equivalent
  2 23 employees shall be provided, the full-time equivalent position
  2 24 limit shall be exceeded, and the additional employees shall be
  2 25 hired by the division.
  2 26    b.  For matching funds for programs to enable severely
  2 27 physically or mentally disabled persons to function more
  2 28 independently, including salaries and support, and for not
  2 29 more than the following full-time equivalent positions:

  3 15 shall not exceed the comparable services offered to resident
  3 16 public school pupils:

  3 32    10.  VOCATIONAL AGRICULTURE YOUTH ORGANIZATION
  3 33    To assist a vocational agriculture youth organization
  3 34 sponsored by the schools to support the foundation established
  3 35 by that vocational agriculture youth organization and for
  4  1 other youth activities:

  4  3    11.  CAREER PATHWAYS PROGRAM
  4  4    For purposes of developing and implementing a career
  4  5 pathways program to expand opportunities for youth and adults
  4  6 to become prepared for and succeed in high-wage, high-skill

  4  9    Of the funds appropriated in this subsection, for
  4 10 the fiscal year beginning July 1, 1995, and ending
  4 11 June 30, 1996, $50,000 shall be expended for purposes
  4 12 of employing an individual to administer and direct
  4 13 the career opportunities program.  The individual
  4 14 employed shall possess a background in business and
  4 15 secondary and postsecondary education.
  4 16    12.  FAMILY RESOURCE CENTERS
  4 17    For support of the family resource center demonstration
  4 18 program established under chapter 256C:

  4 20    13.  CAREER OPPORTUNITY PROGRAM
  4 21    For purposes of providing assistance to minority persons
  4 22 who major in fields or subject areas where minorities are
  4 23 currently underrepresented or underutilized pursuant to
  4 24 section 260C.29, as enacted by this Act:

  4 26    14.  PUBLIC BROADCASTING DIVISION
  4 27    For salaries, support, maintenance, capital expenditures,
  4 28 miscellaneous purposes, and for not more than the following
  4 29 full-time equivalent positions:

  4 32    Of the full-time equivalent positions provided for under
  4 33 this subsection for the fiscal year beginning July 1, 1995,
  4 34 and ending June 30, 1996, it is the intent of the general
  4 35 assembly that 4.0 full-time equivalent positions be provided
  5  1 for purposes formerly provided for under the Star Schools
  5  2 program.
  5  3    The public broadcasting division shall conduct a study, in
  5  4 collaboration with all entities receiving services via the
  5  5 Iowa communications network, of the efficiencies of the
  5  6 network and shall make recommendations relating to the
  5  7 elimination of duplicative efforts.  The study shall include
  5  8 an investigation of the duties and functions of employees of
  5  9 the division, other state agencies, area education agencies,
  5 10 and public schools, if those duties and functions involve the
  5 11 Iowa communications network.  The division shall submit a
  5 12 report of its findings and recommendations to the general
  5 13 assembly and the legislative fiscal bureau by January 1, 1996.
  5 14    15.  NATIONAL ASSESSMENT OF EDUCATION PROGRESS (NAEP)
  5 15    For participation by the department of education in a state
  5 16 and national project to determine the academic achievement of
  5 17 Iowa students in math, reading, science, United States
  5 18 history, or geography:  
  5 19 .................................................. $     50,000
  5 20    16.  LOCAL ARTS COMPREHENSIVE EDUCATIONAL
  5 21 STRATEGIES (LACES)
  5 22    For contracting with the Iowa alliance for arts
  5 23 education to execute the local arts comprehensive
  5 24 educational strategies program (LACES):  
  5 25 .................................................. $     25,000
  5 26    The department of education and the Iowa alliance for arts
  5 27 education shall jointly develop grant applications and select
  5 28 grant recipients for the local arts comprehensive educational
  5 29 strategies program.  At least 50 percent of the funds
  5 30 appropriated by the general assembly for the fiscal year
  5 31 beginning July 1, 1995, and ending June 30, 1996, for purposes
  5 32 of the local arts comprehensive educational strategies
  5 33 program, shall be allocated to schools which are new
  5 34 participants in the program.
  5 35    17.  ADVANCED PLACEMENT
  6  1    For purposes of awarding matching grants to schools to be
  6  2 used for instructional staff development so that additional
  6  3 advanced placement courses may be offered at K-12 public
  6  4 schools:  
  6  5 .................................................. $     75,000
  6  6    Schools that receive grants under this subsection shall
  6  7 provide a local match or other matching financial support and
  6  8 shall coordinate instructional staff development with a public
  6  9 postsecondary institution.  
  6 10    18.  VOCATIONAL EDUCATION TO SECONDARY SCHOOLS
  6 11    For reimbursement for vocational education expenditures
  6 12 made by secondary schools:  
  6 13 .................................................. $  3,308,850
  6 14    Funds appropriated in this subsection shall be used for
  6 15 expenditures made by school districts to meet the standards
  6 16 set in sections 256.11, 258.4, and 260C.14 as a result of the
  6 17 enactment of 1989 Iowa Acts, chapter 278.  Funds shall be used
  6 18 as reimbursement for vocational education expenditures made by
  6 19 secondary schools in the manner provided by the department of
  6 20 education for implementation of the standards set in 1989 Iowa
  6 21 Acts, chapter 278.
  6 22    19.  COMMUNITY COLLEGES
  6 23    Notwithstanding chapter 260D, for general state financial
  6 24 aid, including general financial aid to merged areas in lieu
  6 25 of personal property tax replacement payments under section
  6 26 427A.13, to merged areas as defined in section 260C.2, for
  6 27 vocational education programs in accordance with chapters 258
  6 28 and 260C, to purchase instructional equipment for vocational
  6 29 and technical courses of instruction in community colleges,
  6 30 and for salary increases:

  6 32    The funds appropriated in this subsection shall be
  6 33 allocated as follows:

  7 14    Sec. 2.  Notwithstanding 1994 Iowa Acts, chapter 1193,
  7 15 section 2, subsection 2, funds appropriated and allocated to
  7 16 the merged areas pursuant to 1994 Iowa Acts, chapter 1193,
  7 17 section 2, for the fiscal year beginning July 1, 1994, and
  7 18 ending June 30, 1995, pursuant to section 8.53, unnumbered
  7 19 paragraph 1, shall be paid to the merged areas by June 30,
  7 20 1995.
  7 21    Sec. 3.  The department of education shall, in consultation
  7 22 with the Iowa association of community college presidents and
  7 23 the Iowa association of community college trustees, conduct a
  7 24 study of funding for community colleges, and shall make
  7 25 specific recommendations on the elimination of chapter 260D
  7 26 and for alternatives to present community college funding
  7 27 including, but not limited to, a plan for distribution of
  7 28 funds to community colleges.  The department shall submit a
  7 29 report of its findings and recommendations to the governor and
  7 30 the general assembly by December 1, 1995.  
  7 31                 COLLEGE STUDENT AID COMMISSION
  7 32    Sec. 4.  There is appropriated from the general fund of the
  7 33 state to the college student aid commission for the fiscal
  7 34 year beginning July 1, 1995, and ending June 30, 1996, the
  7 35 following amounts, or so much thereof as may be necessary, to
  8  1 be used for the purposes designated:
  8  2    1.  GENERAL ADMINISTRATION
  8  3    For salaries, support, maintenance, miscellaneous purposes,
  8  4 and for not more than the following full-time equivalent
  8  5 positions:  
  8  6 .................................................. $    321,256
  8  7 ............................................... FTEs       7.05
  8  8    From the moneys appropriated in this subsection,
  8  9 $15,000 for the fiscal year beginning July 1, 1995,
  8 10 and ending June 30, 1996, shall be expended to provide
  8 11 grants to students who would meet the requirements for
  8 12 receipt of a vocational-technical tuition grant, but
  8 13 who are enrolled in a licensed school of cosmetology
  8 14 arts and sciences under chapter 157, or a licensed
  8 15 barber school under chapter 158.  The amount of the
  8 16 grant made by the college student aid commission
  8 17 pursuant to this subsection shall be not less than
  8 18 $300 or the amount of the student's established
  8 19 financial need.
  8 20    2.  UNIVERSITY OF OSTEOPATHIC MEDICINE AND HEALTH SCIENCES
  8 21    a.  For forgivable loans to Iowa students attending the
  8 22 university of osteopathic medicine and health sciences, under
  8 23 the forgivable loan program pursuant to section 261.19A:  
  8 24 .................................................. $    379,260
  8 25    b.  For the university of osteopathic medicine and health
  8 26 sciences for an initiative in primary health care to direct
  8 27 primary care physicians to shortage areas in the state:  
  8 28 .................................................. $    395,000
  8 29    The moneys appropriated in this lettered paragraph shall be
  8 30 used as follows:
  8 31    (1)  To reduce student loan debt for primary care
  8 32 physicians in an amount not to exceed $30,000 per student for
  8 33 a four-year period of medical service in medically under-
  8 34 served areas of the state.
  8 35    (2)  For tuition scholarships for students attending the
  9  1 university of osteopathic medicine and health sciences who
  9  2 agree to practice primary care medicine in medically under-
  9  3 served areas of the state.  The student shall practice in the
  9  4 state two years for every year of tuition.  A person receiving
  9  5 funds under this subparagraph shall not be eligible for funds
  9  6 under subparagraph (1).
  9  7    (3)  For general administration costs of the university for
  9  8 the primary care initiative, the university shall expend an
  9  9 amount not to exceed $50,000.
  9 10    The university of osteopathic medicine and health sciences
  9 11 shall report quarterly to the legislative fiscal bureau
  9 12 concerning the expenditure of funds used pursuant to
  9 13 subparagraphs (1), (2), and (3) of this lettered paragraph.
  9 14 The university shall also submit the annual audit of the
  9 15 university to the legislative fiscal bureau within six months
  9 16 following the year being audited.  The college student aid
  9 17 commission shall not provide moneys for subparagraphs (1) and
  9 18 (2) of this lettered paragraph until the university has signed
  9 19 and submitted contracts for the use of these moneys for
  9 20 reduction of student loan debt and tuition scholarships.
  9 21 Funds for subparagraph (3) of this lettered paragraph shall be
  9 22 provided quarterly to the university.  Notwithstanding section
  9 23 8.33, the funds for this lettered paragraph shall not revert
  9 24 to the general fund but be available for expenditure the
  9 25 following fiscal year for purposes of subparagraphs (1) and
  9 26 (2).
  9 27    3.  STUDENT AID PROGRAMS
  9 28    For payments to students for the Iowa grant program:  
  9 29 .................................................. $  1,469,790
  9 30    From the moneys appropriated in this subsection,
  9 31 $1,397,790 for the fiscal year beginning July 1, 1995,
  9 32 and ending June 30, 1996, shall be expended for an
  9 33 Iowa grant program, with funds to be allocated to
  9 34 institutions pursuant to section 261.93A.  The
  9 35 remainder shall be allocated for the graduate student
 10  1 financial assistance program.
 10  2    Sec. 5.  There is appropriated from the loan reserve
 10  3 account to the college student aid commission for the fiscal
 10  4 year beginning July 1, 1995, and ending June 30, 1996, the
 10  5 following amount, or so much thereof as may be necessary, to
 10  6 be used for the purposes designated:
 10  7    For operating costs of the Stafford loan program including
 10  8 salaries, support, maintenance, miscellaneous purposes, and
 10  9 for not more than the following full-time equivalent
 10 10 positions:

 10 13                     STATE BOARD OF REGENTS
 10 14    Sec. 6.  There is appropriated from the general fund of the
 10 15 state to the state board of regents for the fiscal year
 10 16 beginning July 1, 1995, and ending June 30, 1996, the
 10 17 following amounts, or so much thereof as may be necessary, to
 10 18 be used for the purposes designated:
 10 19    1.  OFFICE OF STATE BOARD OF REGENTS
 10 20    a.  For salaries, support, maintenance, miscellaneous
 10 21 purposes, and for not more than the following full-time
 10 22 equivalent positions:

 10 25    If the moneys provided in this lettered paragraph are
 10 26 augmented by reimbursements from the institutions under the
 10 27 control of the state board of regents for the funding of the
 10 28 office of the state board of regents, the office shall report
 10 29 quarterly such reimbursements to the chairpersons and ranking
 10 30 members of the joint appropriations subcommittee on education.
 10 31    b.  For allocation by the state board of regents to the
 10 32 state university of Iowa, the Iowa state university of science
 10 33 and technology, and the university of northern Iowa to
 10 34 reimburse the institutions for deficiencies in their operating
 10 35 funds resulting from the pledging of tuitions, student fees
 11  1 and charges, and institutional income to finance the cost of
 11  2 providing academic and administrative buildings and facilities
 11  3 and utility services at the institutions:

 11  5    The state board of regents, the department of management,
 11  6 and the legislative fiscal bureau shall cooperate to determine
 11  7 and agree upon, by November 15, 1995, the amount that needs to
 11  8 be appropriated for tuition replacement for the fiscal year
 11  9 beginning July 1, 1996.
 11 10    c.  For funds to be allocated to the southwest Iowa
 11 11 graduate studies center:

 11 13    d.  For funds to be allocated to the siouxland interstate
 11 14 metropolitan planning council for the tristate graduate center
 11 15 under section 262.9, subsection 21:

 11 27    b.  For the primary health care initiative in the college
 11 28 of medicine:

 11 30    From the moneys appropriated in this lettered paragraph,
 11 31 $330,000 shall be allocated to the department of family
 11 32 practice at the state university of Iowa college of medicine
 11 33 for family practice faculty and support staff.
 11 34    It is the intent of the general assembly that the
 11 35 university place additional emphasis on the locum tenus
 12  1 program.
 12  2    c.  University hospitals
 12  3    For salaries, general support, maintenance, equipment, and
 12  4 miscellaneous purposes and for medical and surgical treatment
 12  5 of indigent patients as provided in chapter 255, and for not
 12  6 more than the following full-time equivalent positions:

 12  9    The university of Iowa hospitals and clinics shall
 12 10 submit quarterly a report regarding the portion of the
 12 11 appropriation in this lettered paragraph expended on
 12 12 general support in a format jointly developed by the
 12 13 university of Iowa hospitals and clinics, the
 12 14 legislative fiscal bureau, and the department of
 12 15 management which delineates the expenditures and
 12 16 purposes of the funds.
 12 17    Funds appropriated in this lettered paragraph shall not be
 12 18 used to perform abortions except medically necessary
 12 19 abortions, and shall not be used to operate the early
 12 20 termination of pregnancy clinic except for the performance of
 12 21 medically necessary abortions.  For the purpose of this
 12 22 lettered paragraph, an abortion is the purposeful interruption
 12 23 of pregnancy with the intention other than to produce a live-
 12 24 born infant or to remove a dead fetus, and a medically
 12 25 necessary abortion is one performed under one of the following
 12 26 conditions:
 12 27    (1)  The attending physician certifies that continuing the
 12 28 pregnancy would endanger the life of the pregnant woman.
 12 29    (2)  The attending physician certifies that the fetus is
 12 30 physically deformed, mentally deficient, or afflicted with a
 12 31 congenital illness.
 12 32    (3)  The pregnancy is the result of a rape which is
 12 33 reported within 45 days of the incident to a law enforcement
 12 34 agency or public or private health agency which may include a
 12 35 family physician.
 13  1    (4)  The pregnancy is the result of incest which is
 13  2 reported within 150 days of the incident to a law enforcement
 13  3 agency or public or private health agency which may include a
 13  4 family physician.
 13  5    (5)  The abortion is a spontaneous abortion, commonly known
 13  6 as a miscarriage, wherein not all of the products of
 13  7 conception are expelled.
 13  8    The total quota allocated to the counties for indigent
 13  9 patients for the fiscal year beginning July 1, 1995, shall not
 13 10 be lower than the total quota allocated to the counties for
 13 11 the fiscal year commencing July 1, 1994.  The total quota
 13 12 shall be allocated among the counties on the basis of the 1990
 13 13 census pursuant to section 255.16.
 13 14    d.  Psychiatric hospital
 13 15    For salaries, support, maintenance, equipment, and
 13 16 miscellaneous purposes and for the care, treatment, and
 13 17 maintenance of committed and voluntary public patients, and
 13 18 for not more than the following full-time equivalent
 13 19 positions:

 15 30 amount of $5.35 million for the construction of the facility
 15 31 to house the national advanced driving simulator to match
 15 32 federal funds provided for the project.  Funds provided for
 15 33 the construction of the facility to house the national
 15 34 advanced driving simulator in fiscal years beginning July 1,
 15 35 1996, and July 1, 1997, shall only be expended upon receiving
 16  1 notification from the national highway traffic safety
 16  2 administration that the United States congress has authorized
 16  3 the construction of the national advanced driving simulator,
 16  4 that federal funds have been appropriated to begin
 16  5 construction, and that delivery of the motion base, graphics
 16  6 system, and integrating software will take place in
 16  7 substantial compliance with the United States department of
 16  8 transportation's acquisition schedule as set forth in the
 16  9 cooperative agreement between the state university of Iowa and

 16 30 committee of legislators in the planning, implementation, and

 16 32 members appointed by the majority leader of the senate, two
 16 33 members appointed by the minority leader of the senate, two
 16 34 members appointed by the speaker of the house of
 16 35 representatives, and two members appointed by the minority
 17  1 leader of the house of representatives.  The summit shall
 17  2 examine strategies regarding the expansion of export and trade
 17  3 opportunities with Canada and Mexico for agricultural,
 17  4 commercial, and telecommunications, durable goods and other
 17  5 manufactured products and services, due to the ratification of
 17  6 the North American free trade agreement, especially strategies
 17  7 to increase exports of agricultural products and businesses in
 17  8 rural communities, for assisting small and medium-sized
 17  9 businesses which do not currently export or trade with Canada
 17 10 or Mexico to initiate such trade, and for developing
 17 11 intermodal transportation systems to establish a Laredo to
 17 12 Duluth North American free trade agreement trade corridor.
 17 13 The summit shall also examine the activities of other states
 17 14 regarding efforts to promote trade with Canada or Mexico and
 17 15 the potential for cooperative efforts with other states, and
 17 16 strategies to mitigate any potential negative effects on any
 17 17 Iowa economic sector as a result of growth in export and trade
 17 18 with Canada and Mexico.  The university shall seek the widest
 17 19 possible summit participation by public or private entities,
 17 20 businesses, labor organizations, other groups, or individual

 19 11    Sec. 8.  For the fiscal year beginning July 1, 1995, and
 19 12 ending June 30, 1996, the state board of regents may use
 19 13 notes, bonds, or other evidences of indebtedness issued under
 19 14 section 262.48 to finance projects that will result in energy
 19 15 cost savings in an amount that will cause the state board to
 19 16 recover the cost of the projects within an average of six
 19 17 years.
 19 18    Sec. 9.  MEDICAL ASSISTANCE &endash; SUPPLEMENTAL AMOUNTS.  For
 19 19 the fiscal year beginning July 1, 1995, and ending June 30,
 19 20 1996, the department of human services shall continue the
 19 21 supplemental disproportionate share and a supplemental
 19 22 indirect medical education adjustment applicable to state-
 19 23 owned acute care hospitals with more than 500 beds and shall
 19 24 reimburse qualifying hospitals pursuant to that adjustment
 19 25 with a supplemental amount for services provided medical
 19 26 assistance recipients.  The adjustment shall generate
 19 27 supplemental payments intended to equal the state
 19 28 appropriation made to a qualifying hospital for treatment of
 19 29 indigent patients as provided in chapter 255.  To the extent
 19 30 of the supplemental payments, a qualifying hospital shall,
 19 31 after receipt of the funds, transfer to the department of
 19 32 human services an amount equal to the actual supplemental
 19 33 payments that were made in that month.  The aggregate amounts
 19 34 for the fiscal year shall not exceed the state appropriation
 19 35 made to the qualifying hospital for treatment of indigent
 20  1 patients as provided in chapter 255.  The department of human
 20  2 services shall deposit the portion of these funds equal to the
 20  3 state share in the department's medical assistance account and
 20  4 the balance shall be credited to the general fund of the
 20  5 state.  To the extent that state funds appropriated to a
 20  6 qualifying hospital for the treatment of indigent patients as
 20  7 provided in chapter 255 have been transferred to the
 20  8 department of human services as a result of these supplemental
 20  9 payments made to the qualifying hospital, the department shall
 20 10 not, directly or indirectly, recoup the supplemental payments
 20 11 made to a qualifying hospital for any reason, unless an
 20 12 equivalent amount of the funds transferred to the department
 20 13 of human services by a qualifying hospital pursuant to this
 20 14 provision is transferred to the qualifying hospital by the
 20 15 department.
 20 16    If the state supplemental amount allotted to the state of
 20 17 Iowa for the federal fiscal year beginning October 1, 1995,
 20 18 and ending September 30, 1996, pursuant to section 1923 (f)(3)
 20 19 of the federal Social Security Act, as amended, or pursuant to
 20 20 federal payments for indirect medical education is greater
 20 21 than the amount necessary to fund the federal share of the
 20 22 supplemental payments specified in the preceding paragraph,
 20 23 the department of human services shall increase the
 20 24 supplemental disproportionate share or supplemental indirect
 20 25 medical education adjustment by the lesser of the amount
 20 26 necessary to utilize fully the state supplemental amount or
 20 27 the amount of state funds appropriated to the state university
 20 28 of Iowa general education fund and allocated to the university
 20 29 for the college of medicine.  The state university of Iowa
 20 30 shall transfer from the allocation for the college of medicine
 20 31 to the department of human services, on a monthly basis, an
 20 32 amount equal to the additional supplemental payments made
 20 33 during the previous month pursuant to this paragraph.  A
 20 34 qualifying hospital receiving supplemental payments pursuant
 20 35 to this paragraph that are greater than the state
 21  1 appropriation made to the qualifying hospital for treatment of
 21  2 indigent patients as provided in chapter 255 shall be
 21  3 obligated as a condition of its participation in the medical
 21  4 assistance program to transfer to the state university of Iowa
 21  5 general education fund on a monthly basis an amount equal to
 21  6 the funds transferred by the state university of Iowa to the
 21  7 department of human services.  To the extent that state funds
 21  8 appropriated to the state university of Iowa and allocated to
 21  9 the college of medicine have been transferred to the
 21 10 department of human services as a result of these supplemental
 21 11 payments made to the qualifying hospital, the department shall
 21 12 not, directly or indirectly, recoup these supplemental
 21 13 payments made to a qualifying hospital for any reason, unless
 21 14 an equivalent amount of the funds transferred to the
 21 15 department of human services by the state university of Iowa
 21 16 pursuant to this paragraph is transferred to the qualifying
 21 17 hospital by the department.
 21 18    Continuation of the supplemental disproportionate share and
 21 19 supplemental indirect medical education adjustment shall
 21 20 preserve the funds available to the university hospital for
 21 21 medical and surgical treatment of indigent patients as
 21 22 provided in chapter 255 and to the state university of Iowa
 21 23 for educational purposes at the same level as provided by the
 21 24 state funds initially appropriated for that purpose.
 21 25    The department of human services shall, in any compilation
 21 26 of data or other report distributed to the public concerning
 21 27 payments to providers under the medical assistance program,
 21 28 set forth reimbursements to a qualifying hospital through the
 21 29 supplemental disproportionate share and supplemental indirect
 21 30 medical education adjustment as a separate item and shall not
 21 31 include such payments in the amounts otherwise reported as the
 21 32 reimbursement to a qualifying hospital for services to medical
 21 33 assistance recipients.
 21 34    For purposes of this section, "supplemental payment" means
 21 35 a supplemental payment amount paid for medical assistance to a
 22  1 hospital qualifying for that payment under this section.

 23 18    Sec. 12.  Notwithstanding section 8.33, funds appropriated
 23 19 in 1994 Iowa Acts, chapter 1193, section 14, remaining
 23 20 unencumbered or unobligated on June 30, 1995, shall not revert
 23 21 to the general fund of the state but shall be available for
 23 22 purposes of the Iowa grant program, in addition to funds
 23 23 appropriated in section 4, subsection 3, of this Act, with
 23 24 funds to be distributed pursuant to section 261.93A.
 23 25    Sec. 13.  Notwithstanding section 257B.1A, subsection 4,
 23 26 and 1994 Iowa Acts, chapter 1193, section 15, for the fiscal
 23 27 year beginning July 1, 1994, and ending June 30, 1995, the
 23 28 remaining portion of the interest earned on the permanent
 23 29 school fund shall, after transfers are made pursuant to
 23 30 section 257B.1A, subsections 2 and 3, be deposited in the
 23 31 interest for Iowa schools fund established under this Act.
 23 32    Sec. 14.  There is appropriated from the scholarship and
 23 33 tuition grant reserve fund to the college student aid
 23 34 commission for the fiscal year beginning July 1, 1995, and
 23 35 ending June 30, 1996, the amount of $160,000 for purposes of
 24  1 the work-study program, in addition to funds appropriated in
 24  2 section 261.85.
 24  3    Sec. 15.  Funds appropriated for state scholarships
 24  4 pursuant to section 261.25, subsection 2, for the fiscal year
 24  5 beginning July 1, 1995, and ending June 30, 1996, shall be
 24  6 used in their entirety to fund scholarships to eligible
 24  7 students, and the college student aid commission shall not
 24  8 place an across-the-board ceiling on the amount distributed
 24  9 under the state scholarship program.
 24 10    Sec. 16.  Section 257B.1, subsection 5, Code 1995, is
 24 11 amended by striking the subsection.
 24 12    Sec. 17.  Section 257B.1A, Code 1995, is amended by
 24 13 striking the section and inserting in lieu thereof the
 24 14 following:
 24 15    257B.1A  TRANSFER OF INTEREST.
 24 16    1.  The interest for Iowa schools fund is established in
 24 17 the office of treasurer of state.  The department of revenue
 24 18 and finance shall deposit interest earned on the permanent
 24 19 school fund in the interest for Iowa schools fund.  Moneys in
 24 20 the interest for Iowa schools fund shall be transferred or
 24 21 allocated only for school purposes as provided in this
 24 22 section.
 24 23    2.  For a transfer of moneys from the interest for Iowa
 24 24 schools fund to the first in the nation in education
 24 25 foundation, prior to July 1, October 1, January 1, and March 1
 24 26 of each year, the governing board of the first in the nation
 24 27 in education foundation established in section 257A.2 shall
 24 28 certify to the treasurer of state the cumulative total value
 24 29 of contributions received under section 257A.7 for deposit in
 24 30 the first in the nation in education fund and for the use of
 24 31 the foundation.  The cumulative total value of contributions
 24 32 received includes the value of the amount deposited in the
 24 33 national center endowment fund established in section 263.8A
 24 34 in excess of eight hundred seventy-five thousand dollars.  The
 24 35 value of in-kind contributions shall be based upon the fair
 25  1 market value of the contribution determined for income tax
 25  2 purposes.
 25  3    The portion of the interest in Iowa schools fund that is
 25  4 equal to the cumulative total value of contributions, less the
 25  5 portion of the interest in Iowa schools fund dedicated to the
 25  6 national center for gifted and talented education, is
 25  7 dedicated to the first in the nation in education foundation
 25  8 for that year.  The interest earned on this dedicated amount
 25  9 shall be transferred by the treasurer of state to the credit
 25 10 of the first in the nation in education foundation.
 25 11    3.  For a transfer of moneys from the interest in Iowa
 25 12 schools fund to the national center endowment fund established
 25 13 in section 263.8A, prior to July 1, October 1, January 1, and
 25 14 March 1 of each year, the state university of Iowa shall
 25 15 certify to the treasurer of state the cumulative total value
 25 16 of contributions received and deposited in the national center
 25 17 endowment fund.  Within fifteen days following certification
 25 18 by the state university of Iowa, the treasurer of state shall
 25 19 transfer from the interest in Iowa schools fund to the
 25 20 national center an amount equal to one-half the cumulative
 25 21 total value of the contributions deposited in the national
 25 22 center endowment fund, not to exceed eight hundred seventy-
 25 23 five thousand dollars.
 25 24    Sec. 18.  NEW SECTION.  260C.24  PAYMENT OF APPROPRIATION.
 25 25    Payment of appropriations for distribution under this
 25 26 chapter or of appropriations made in lieu of such
 25 27 appropriations, shall be made by the department of revenue and
 25 28 finance in monthly installments due on or about the fifteenth
 25 29 of each month of a budget year, and installments shall be as
 25 30 nearly equal as possible, as determined by the department of
 25 31 revenue and finance, taking into consideration the relative
 25 32 budget and cash position of the state resources.
 25 33    Sec. 19.  NEW SECTION.  260C.29  CAREER OPPORTUNITY PROGRAM
 25 34 &endash; MISSION.
 25 35    1.  The mission of the career opportunity program
 26  1 established in this section is to encourage collaborative
 26  2 efforts by a community college, the institutions under the
 26  3 control of the state board of regents, and business and
 26  4 industry to enhance the educational opportunities and provide
 26  5 for job creation and career advancement for Iowa's minority
 26  6 persons by providing assistance to minority persons who major
 26  7 in fields or subject areas where minorities are currently
 26  8 underrepresented or underutilized.
 26  9    2.  A career opportunity program is established to be
 26 10 administered by the community college located in a county with
 26 11 a population in excess of three hundred thousand.  The
 26 12 community college shall provide office space for the efficient
 26 13 operation of the program.  The community college shall employ
 26 14 a director for the program.  The director of the program shall
 26 15 employ necessary support staff.  The director and staff shall
 26 16 be employees of the community college.
 26 17    3.  The director of the program shall do the following:
 26 18    a.  Direct the coordination of the program between the
 26 19 community college and the institutions of higher education
 26 20 under the control of the state board of regents.
 26 21    b.  Propose rules to the state board of education as
 26 22 necessary to implement the program.
 26 23    c.  Recruit minority persons into the program.
 26 24    d.  Enlist the assistance and cooperation of leaders from
 26 25 business and industry to provide job placement services for
 26 26 students who are successfully completing the program.
 26 27    e.  Prepare and submit an annual report to the governor and
 26 28 the general assembly by January 15.
 26 29    4.  To be eligible for the program, a minority person shall
 26 30 be a resident of Iowa who is accepted for admission at or
 26 31 attends a community college or an institution of higher
 26 32 education under the control of the state board of regents.  In
 26 33 addition, the person shall major in or achieve credit toward
 26 34 an associate degree, a bachelor's degree, or a master's degree
 26 35 in a field or subject area where minorities are
 27  1 underrepresented or underutilized.
 27  2    5.  The amount of assistance provided to a student under
 27  3 this section shall not exceed the cost of tuition, fees, and
 27  4 books required for the program in which the student is
 27  5 enrolled and attends.  As used in this section, "books" may
 27  6 include book substitutes, including reusable workbooks, loose-
 27  7 leaf or bound manuals, and computer software materials used as
 27  8 book substitutes.  A student who meets the qualifications of
 27  9 this section shall receive assistance under this section for
 27 10 not more than the equivalent of two full years of study.
 27 11    6.  For purposes of this section, "minority person" means a
 27 12 person who is Black, Hispanic, Asian, or a Pacific Islander,
 27 13 American Indian, or an Alaskan native American.
 27 14    Sec. 20.  Section 260D.14A, unnumbered paragraphs 1 and 5,
 27 15 Code 1995, are amended to read as follows:
 27 16    The department of education shall provide for the
 27 17 establishment of a community college excellence 2000 account
 27 18 in the office of the treasurer of state for deposit of moneys
 27 19 appropriated to the account for purposes of funding quality
 27 20 instructional centers and program and administrative sharing
 27 21 agreements under sections 260C.45 and 260C.46.  There is
 27 22 appropriated from the general fund of the state to the
 27 23 department of education for the fiscal year beginning July 1,
 27 24 1995 1997, an amount equal to two and five-tenths percent of
 27 25 the total state general aid generated for all community
 27 26 colleges during the budget year under this chapter for deposit
 27 27 in the community college excellence 2000 account.  In the next
 27 28 succeeding two fiscal years, the percent multiplier shall be
 27 29 increased in equal increments until the multiplier reaches
 27 30 seven and one-half percent of the total state general aid
 27 31 generated for all community colleges during the budget year.
 27 32    It is the intent of the general assembly that the general
 27 33 assembly enact legislation by July 1, 1995 1997, that will
 27 34 increase the maximum percent multiplier established in this
 27 35 section from seven and five-tenths percent to ten percent.
 28  1    Sec. 21.  Section 261.12, subsection 1, paragraph b, Code
 28  2 1995, is amended to read as follows:
 28  3    b.  For the fiscal year beginning July 1, 1989 1995, and
 28  4 for each following fiscal year, two thousand six nine hundred
 28  5 fifty dollars.
 28  6    Sec. 22.  Section 261.25, subsection 1, Code 1995, is
 28  7 amended to read as follows:
 28  8    1.  There is appropriated from the general fund of the
 28  9 state to the commission for each fiscal year the sum of
 28 10 thirty-two thirty-five million four six hundred twenty-two
 28 11 sixty-four thousand three seven hundred sixty-two fifty
 28 12 dollars for tuition grants.
 28 13    Sec. 23.  NEW SECTION.  261.51  CHIROPRACTIC GRADUATE
 28 14 STUDENT FORGIVABLE LOANS.
 28 15    1.  A chiropractic graduate student forgivable loan program
 28 16 is established, to be administered by the college student aid
 28 17 commission for resident graduate students who are enrolled at
 28 18 Iowa chiropractic colleges and universities.  A resident
 28 19 graduate student attending an Iowa chiropractic college or
 28 20 university is eligible for loan forgiveness under the program
 28 21 if the student meets all of the following conditions:
 28 22    a.  The student graduates from an Iowa chiropractic college
 28 23 or university that meets the requirements for approval under
 28 24 section 151.4.
 28 25    b.  The student has completed a chiropractic residency
 28 26 program.
 28 27    c.  The student practices in the state of Iowa.
 28 28    d.  The student has made application for, using the
 28 29 procedures specified in section 261.16, and received moneys
 28 30 through the college student aid commission from the funds
 28 31 allocated for loans under this section.
 28 32    2.  Of the moneys loaned to an eligible student, for each
 28 33 year of up to and including four years of practice in Iowa,
 28 34 the amount of one thousand one hundred dollars shall be
 28 35 forgiven.  If a student fails to complete a year of practice
 29  1 in the state, the loan amount for that year shall not be
 29  2 forgiven.  Forgivable loans made to eligible students shall
 29  3 not become due, for repayment purposes, until after the
 29  4 student has completed the student's residency.
 29  5    3.  For purposes of this section "graduate student" means a
 29  6 student who has completed at least ninety semester hours, or
 29  7 the trimester or quarter equivalent, of postsecondary course
 29  8 work at a public higher education institution or at an
 29  9 accredited private institution, as defined under section
 29 10 261.9.  The college student aid commission shall adopt rules,
 29 11 consistent with rules used for students enrolled in higher
 29 12 education institutions under the control of the state board of
 29 13 regents, for purposes of determining Iowa residency status of
 29 14 graduate students under this section.  The commission shall
 29 15 also adopt rules which provide standards, guidelines, and
 29 16 procedures for the receipt, processing, and administration of
 29 17 student applications and loans under this section.
 29 18    Sec. 24.  Section 261.85, unnumbered paragraph 1, Code
 29 19 1995, is amended to read as follows:
 29 20    There is appropriated from the general fund of the state to
 29 21 the commission for each fiscal year the sum of two million
 29 22 eight nine hundred ninety-eight fifty thousand eight hundred
 29 23 forty dollars for the work-study program.
 29 24    Sec. 25.  Section 262.2, Code 1995, is amended to read as
 29 25 follows:
 29 26    262.2  APPOINTMENT &endash; TERM OF OFFICE.
 29 27    1.  The members shall be appointed by the governor subject
 29 28 to confirmation by the senate.  The term of each member of the
 29 29 board shall be for six years.  The terms of three members of
 29 30 the board shall begin and expire in each odd-numbered year as
 29 31 provided in section 69.19.
 29 32    2.  The recognized student government organization at each
 29 33 of the three institutions of higher learning under the control
 29 34 of the board shall submit, at least biennially, to the
 29 35 executive director who shall transfer to the governor a list
 30  1 of at least three names of students eligible to represent the
 30  2 institution on the board.  The governor may appoint the ninth
 30  3 member of the board from the lists of names submitted by the
 30  4 recognized student organizations.
 30  5    Sec. 26.  Section 275.55A, Code 1995, is amended to read as
 30  6 follows:
 30  7    275.55A  ATTENDANCE IN OTHER DISTRICT.
 30  8    A pupil student enrolled in ninth, tenth, or eleventh grade
 30  9 during the school year preceding the effective date of a
 30 10 dissolution proposal, who was a resident of the school
 30 11 district that dissolved, may enroll in any a school district
 30 12 to which territory of the school district that dissolved was
 30 13 attached until that pupil's the student's graduation from high
 30 14 school, unless the student was expelled or suspended from
 30 15 school and the conditions of expulsion or suspension have not
 30 16 been met.  The student under expulsion or suspension shall not
 30 17 be enrolled until the board of directors of the school
 30 18 district to which territory of the dissolved school district
 30 19 was attached approves, by majority vote, the enrollment of the
 30 20 student.  Notwithstanding section 282.24, the district of
 30 21 residence of the pupil student, determined in the dissolution
 30 22 proposal, shall pay tuition to the school district selected by
 30 23 the pupil student in an amount not to exceed the district cost
 30 24 per pupil of the district of residence and the school district
 30 25 selected by the pupil student shall accept that tuition
 30 26 payment and enroll the pupil student.
 30 27    Sec. 27.  Section 282.4, Code 1995, is amended to read as
 30 28 follows:
 30 29    282.4  SUSPENSION &endash; EXPULSION &endash; DISMISSAL.
 30 30    1.  The board may, by a majority vote, expel any pupil
 30 31 student from school for a violation of the regulations or
 30 32 rules established by the board, or when the presence of the
 30 33 pupil student is detrimental to the best interests of the
 30 34 school.  The board may confer upon any teacher, principal, or
 30 35 superintendent the power temporarily to dismiss suspend a
 31  1 pupil student, notice of such dismissal the suspension being
 31  2 at once given in writing to the president of the board.
 31  3    2.  A pupil student who commits an assault, as defined
 31  4 under section 708.1, against a school employee in a school
 31  5 building, on school grounds, or at a school-sponsored function
 31  6 shall be suspended for a time to be determined by the
 31  7 principal.  Notice of the suspension shall be immediately sent
 31  8 to the president of the board.  By special meeting or at the
 31  9 next regularly scheduled board meeting, the board shall review
 31 10 the suspension and decide whether to hold a disciplinary
 31 11 hearing to determine whether or not to order further sanctions
 31 12 against the pupil student, which may include expelling the
 31 13 pupil student.  In making its decision, the board shall
 31 14 consider the best interests of the school district, which
 31 15 shall include what is best to protect and ensure the safety of
 31 16 the school employees and pupils students from the pupil
 31 17 student committing the assault.
 31 18    A pupil student shall not be suspended or expelled pursuant
 31 19 to this section if the suspension or expulsion would violate
 31 20 the federal Individuals with Disabilities Education Act.
 31 21    3.  Notwithstanding section 282.6, if a student has been
 31 22 expelled or suspended from school and has not met the
 31 23 conditions of the expulsion or suspension and if the student,
 31 24 or the parent or guardian of the student, changes district of
 31 25 residence, the student shall not be enrolled in the new
 31 26 district of residence until the board of directors of the new
 31 27 district of residence approves, by a majority vote, the
 31 28 enrollment of the student.
 31 29    Sec. 28.  Section 282.5, Code 1995, is amended to read as
 31 30 follows:
 31 31    282.5  READMISSION OF STUDENT.
 31 32    When a student is dismissed suspended by a teacher,
 31 33 principal, or superintendent, pursuant to section 282.4, the
 31 34 student may be readmitted by the teacher, principal, or
 31 35 superintendent, but when expelled by the board the student may
 32  1 be readmitted only by the board or in the manner prescribed by
 32  2 the board.
 32  3    Sec. 29.  Section 294A.25, subsection 8, Code 1995, is
 32  4 amended to read as follows:
 32  5    8.  For the fiscal year beginning July 1, 1994 1995, to the
 32  6 department of education from phase III moneys the amount of
 32  7 one million two hundred fifty thousand dollars for support for
 32  8 the operations of the new Iowa schools development corporation
 32  9 and for school transformation design and implementation
 32 10 projects administered by the corporation.  Of the amount
 32 11 provided in this subsection, one hundred fifty thousand
 32 12 dollars shall be used for the school and community planning
 32 13 initiative.
 32 14    Sec. 30.  Section 303.3, subsection 3, Code 1995, is
 32 15 amended to read as follows:
 32 16    3.  Notwithstanding section 8.33, moneys committed to
 32 17 grantees under contract that remain unexpended on June 30 of
 32 18 any fiscal year shall not revert but shall be available for
 32 19 expenditure for purposes of the contract program until June 30
 32 20 of the succeeding fiscal year.
 32 21    Sec. 31.  FUNDS TRANSFERRED.
 32 22    1.  For the fiscal year beginning July 1, 1995, and ending
 32 23 June 30, 1996, the amount of $150,000 is to be paid to the
 32 24 department of education from additional funds transferred from
 32 25 phase I to phase III for development of a K-12 and community
 32 26 college management information system.  Notwithstanding
 32 27 section 294A.20, if the additional funds transferred from
 32 28 phase I to phase III are insufficient for purposes of the
 32 29 appropriation provided under this subsection, moneys allocated
 32 30 to phase III, which would otherwise revert to the general fund
 32 31 under section 294A.20, shall be transferred to the department
 32 32 in an amount sufficient to fully fund the appropriation made
 32 33 under this subsection.  The department shall submit a report
 32 34 to the legislative fiscal bureau by January 1, 1996,
 32 35 describing the specific expenditure of funds appropriated by
 33  1 the general assembly for purposes of the management
 33  2 information system; the estimated time of completion of the
 33  3 system; the department's accomplishments under the system; and
 33  4 any recommendations for future system funding needs.
 33  5    2.  For the fiscal year beginning July 1, 1995, and ending
 33  6 June 30, 1996, up to $50,000 from additional funds transferred
 33  7 from phase I to phase III is to be paid to the department of
 33  8 education for support of the Iowa mathematics and science
 33  9 coalition.  If funds available from the specified sources are
 33 10 insufficient to fully fund the appropriation, the amount
 33 11 appropriated to the department under this subsection shall be
 33 12 reduced to an amount equal to the available funds.
 33 13    Sec. 32.  1994 Iowa Acts, chapter 1193, section 15, is
 33 14 repealed.
 33 15    Sec. 33.  Sections 2, 11 through 13, 16, 17, 26 through 28,
 33 16 30, and this section of this Act, being deemed of immediate
 33 17 importance, take effect upon enactment.
