PAG LIN 1 1 Section 1. Section 257.2, subsection 12, Code 1995, is 1 2 amended to read as follows: 1 3 12. "State percent of growth" means the percent of growth 1 4 which is establishedby statutepursuant to section 257.8, and 1 5 which is used in determining the allowable growth. 1 6 Sec. 2. Section 257.8, subsection 1, Code 1995, is amended 1 7 to read as follows: 1 8 1. STATE PERCENT OF GROWTH. The state percent of growth 1 9 for a budget year shall be established by statute which shall 1 10 be enacted within thirty days of the submission in the base 1 11 year of the governor's budget under section 8.21. However, if 1 12 the general assembly has not presented legislation 1 13 establishing the state percent of growth to the governor by 1 14 the thirty-ninth day, the state percent of growth is 1 15 established as the lesser of two and seven-tenths percent or 1 16 two-thirds of the annual percent change in the national 1 17 consumer price index computed for the twelve-month period 1 18 ending September 30 of the base year. The establishment of 1 19 the state percent of growth for a budget year shall be the 1 20 only subject matter of the bill which enacts the state percent 1 21 of growth for a budget year. 1 22 Sec. 3. Section 257.8, Code 1995, is amended by adding the 1 23 following new subsection: 1 24 NEW SUBSECTION. 1A. GENERAL ASSEMBLY EXPENSES. 1 25 Notwithstanding section 2.10, subsection 1, if the state 1 26 percent of growth has not been established by the thirtieth 1 27 day, members of the general assembly shall not receive the per 1 28 diem payments for the expenses of office provided for members 1 29 of the general assembly, for each day following the thirtieth 1 30 day until the state percent of growth has been established 1 31 under subsection 1 and the maximum number of days that a 1 32 member may receive per diem during the regular session under 1 33 section 2.10, subsection 1, shall be reduced by the number of 1 34 days for which per diem is not allowed under this subsection. 1 35 Sec. 4. Sections 1 and 2 of this Act, being deemed of 2 1 immediate importance, take effect upon enactment and apply to 2 2 school budget years beginning on or after July 1, 1995. 2 3 EXPLANATION 2 4 The bill provides that if the general assembly has not 2 5 established the state percent of growth within 30 days of the 2 6 submission of the governor's budget the members shall not be 2 7 paid the expense per diem until it is established. 2 8 The bill provides that if the general assembly has not 2 9 presented legislation to the governor by the thirty-ninth day 2 10 the state percent of growth is automatically set at the lesser 2 11 of 2.7 percent or two-thirds of the annual percent change in 2 12 the federally computed CPI for the 12-month period ending 2 13 September 30. 2 14 The state percent of growth provision takes effect upon 2 15 enactment. 2 16 LSB 2244SS 76 2 17 mg/jj/8.2
