  1  1    Section 1.  Section 99B.6, subsection 1, paragraph k, Code
  1  2 1995, is amended to read as follows:
  1  3    k.  A person under the age of twenty-one years shall not
  1  4 participate in the gambling except pursuant to sections 99B.3,
  1  5 99B.4, 99B.5, and 99B.7.  Any licensee knowingly allowing a
  1  6 person under the age of twenty-one to participate in the
  1  7 gambling prohibited by this paragraph or any person knowingly
  1  8 participating in gambling with a person under the age of
  1  9 twenty-one, is guilty of a simple misdemeanor.  However, a
  1 10 person who was eighteen years of age or older on March 30,
  1 11 1994, may participate in gambling as otherwise provided in
  1 12 this chapter.
  1 13    Sec. 2.  Section 99D.11, subsection 7, Code 1995, is
  1 14 amended to read as follows:
  1 15    7.  A person under the age of twenty-one years shall not
  1 16 make a pari-mutuel wager.  However, this subsection does not
  1 17 apply to a person who was eighteen years of age or older on
  1 18 March 30, 1994.
  1 19    Sec. 3.  Section 99D.24, subsection 2, Code 1995, is
  1 20 amended to read as follows:
  1 21    2.  A person knowingly permitting a person under the age of
  1 22 twenty-one years to make a pari-mutuel wager is guilty of a
  1 23 simple misdemeanor.  However, the prohibition against pari-
  1 24 mutuel wagering in this subsection does not apply to a person
  1 25 who was eighteen years of age or older on March 30, 1994.
  1 26    Sec. 4.  Section 99E.18, subsection 2, Code 1995, is
  1 27 amended to read as follows:
  1 28    2.  A ticket or share shall not be sold to a person who has
  1 29 not reached the age of twenty-one.  This does not prohibit the
  1 30 lawful purchase of a ticket or share for the purpose of making
  1 31 a gift to a person who has not reached the age of twenty-one.
  1 32 A licensee or a licensee's employee who knowingly sells or
  1 33 offers to sell a lottery ticket or share to a person who has
  1 34 not reached the age of twenty-one is guilty of a simple
  1 35 misdemeanor.  In addition the license of a licensee shall be
  2  1 suspended.  A prize won by a person who has not reached the
  2  2 age of twenty-one but who purchases a winning ticket or share
  2  3 in violation of this subsection shall be forfeited.  However,
  2  4 the prohibition against the purchase of a ticket or a share as
  2  5 provided in this subsection does not apply to a person who was
  2  6 eighteen years of age or older on March 30, 1994.
  2  7    Sec. 5.  Section 99F.9, subsection 5, Code 1995, is amended
  2  8 to read as follows:
  2  9    5.  A person under the age of twenty-one years shall not
  2 10 make a wager on an excursion gambling boat and shall not be
  2 11 allowed in the area of the excursion boat where gambling is
  2 12 being conducted.  However, a person eighteen years of age or
  2 13 older may be employed to work in a gambling area and the
  2 14 prohibitions in this subsection relating to gambling do not
  2 15 apply to a person who was eighteen years of age or older on
  2 16 March 30, 1994.
  2 17    Sec. 6.  Section 99F.15, subsection 2, Code 1995, is
  2 18 amended to read as follows:
  2 19    2.  A person knowingly permitting a person under the age of
  2 20 twenty-one years to make a wager is guilty of a simple
  2 21 misdemeanor.  However, the prohibition against wagering in
  2 22 this subsection does not apply to a person who was eighteen
  2 23 years of age or older on March 30, 1994.
  2 24    Sec. 7.  EFFECTIVE DATE &endash; APPLICABILITY DATE.  This Act,
  2 25 being deemed of immediate importance, takes effect upon
  2 26 enactment, and applies retroactively to March 30, 1994.  
  2 27                           EXPLANATION
  2 28    This bill legalizes gambling for persons who were 18 years
  2 29 of age or more as of March 30, 1994, when the gambling age for
  2 30 lottery, pari-mutuel wagering, and riverboat gambling was
  2 31 increased to 21 years of age.  This bill will "grandfather"
  2 32 those persons who were eligible to gamble before 1994 Iowa
  2 33 Acts, chapter 1021, took effect on March 31, 1994, but not
  2 34 after it took effect.
  2 35    This bill takes effect upon enactment and applies
  3  1 retroactively to March 30, 1994.
