  1  1    Section 1.  Section 123.36, subsection 6, Code 1995, is
  1  2 amended to read as follows:
  1  3    6.  Any club, hotel, motel, or commercial establishment
  1  4 holding a liquor control license, subject to section 123.49,
  1  5 subsection 2, paragraph "b", may apply for and receive
  1  6 permission to sell and dispense alcoholic liquor and wine to
  1  7 patrons on Sunday for consumption on the premises only, and
  1  8 beer for consumption on or off the premises between the hours
  1  9 of eight six a.m. on Sunday and two a.m. on the following
  1 10 Monday.  A class "D" liquor control licensee may apply for and
  1 11 receive permission to sell and dispense alcoholic beverages to
  1 12 patrons for consumption on the premises only between the hours
  1 13 of eight six a.m. on Sunday and two a.m. on the following
  1 14 Monday.  For the privilege of selling beer, wine, and
  1 15 alcoholic liquor on the premises on Sunday the liquor control
  1 16 license fee of the applicant shall be increased by twenty
  1 17 percent of the regular fee prescribed for the license pursuant
  1 18 to this section, and the privilege shall be noted on the
  1 19 liquor control license.
  1 20    Sec. 2.  Section 123.49, subsection 2, paragraphs b and k,
  1 21 Code 1995, are amended to read as follows:
  1 22    b.  Sell or dispense any alcoholic beverage or beer on the
  1 23 premises covered by the license or permit, or permit its
  1 24 consumption thereon between the hours of two a.m. and six a.m.
  1 25 on a weekday, and between the hours of two a.m. on Sunday and
  1 26 six a.m. on the following Monday, however, a holder of a
  1 27 liquor control license or retail beer permit granted the
  1 28 privilege of selling alcoholic liquor or beer on Sunday may
  1 29 sell or dispense alcoholic liquor or beer between the hours of
  1 30 eight six a.m. on Sunday and two a.m. on the following Monday.
  1 31    k.  Sell or dispense any wine on the premises covered by
  1 32 the permit or permit the consumption on the premises between
  1 33 the hours of two a.m. and six a.m. on a weekday, and between
  1 34 the hours of two a.m. on Sunday and six a.m. on the following
  1 35 Monday, however, a holder of a wine permit authorized to sell
  2  1 wine on Sunday may sell or dispense wine between the hours of
  2  2 eight six a.m. on Sunday and two a.m. on the following Monday.
  2  3    Sec. 3.  Section 123.134, subsection 5, Code 1995, is
  2  4 amended to read as follows:
  2  5    5.  Any club, hotel, motel, or commercial establishment
  2  6 holding a class "B" beer permit, subject to the provisions of
  2  7 section 123.49, subsection 2, paragraph "b", may apply for and
  2  8 receive permission to sell and dispense beer to patrons on
  2  9 Sunday for consumption on or off the premises between the
  2 10 hours of eight six a.m. on Sunday and two a.m. on the
  2 11 following Monday.  Any class "C" beer permittee may sell beer
  2 12 for consumption off the premises between the hours of eight
  2 13 six a.m. on Sunday and two a.m. on the following Monday.  For
  2 14 the privilege of selling beer on Sunday the beer permit fees
  2 15 of the applicant shall be increased by twenty percent of the
  2 16 regular fees prescribed for the permit pursuant to this
  2 17 section and the privilege shall be noted on the beer permit.
  2 18    Sec. 4.  Section 123.150, unnumbered paragraph 1, Code
  2 19 1995, is amended to read as follows:
  2 20    Notwithstanding section 123.36, subsection 6, section
  2 21 123.49, subsection 2, paragraph "b", and section 123.134,
  2 22 subsection 5, a holder of any class of liquor control license
  2 23 or the holder of a class "B" beer permit may sell or dispense
  2 24 alcoholic liquor, wine, or beer to patrons for consumption on
  2 25 the premises between the hours of eight six a.m. on Sunday and
  2 26 two a.m. on Monday when that Monday is New Year's Day and beer
  2 27 for consumption off the premises between the hours of eight
  2 28 six a.m. on Sunday and two a.m. on the following Monday when
  2 29 that Sunday is the day before New Year's Day.  The liquor
  2 30 control license fee or beer permit fee of licensees and
  2 31 permittees permitted to sell or dispense liquor, wine, or beer
  2 32 on a Sunday when that Sunday is the day before New Year's Day
  2 33 shall not be increased because of this privilege.  
  2 34                           EXPLANATION
  2 35    This bill changes the hours for the legal sale of alcoholic
  3  1 beverages on Sundays to match the hours for legal sales on
  3  2 weekdays.  The uniform hours will be 6 a.m. until 2 a.m. the
  3  3 following day.
