PAG LIN 1 1 Section 1. NEW SECTION. 262.1A REGENT CANDIDATE ADVISORY 1 2 COMMISSION ESTABLISHED &endash; MEMBERSHIP AND DUTIES. 1 3 1. A regent candidate advisory commission is created to 1 4 advise and make recommendations to the governor regarding the 1 5 appointment of members to the state board of regents. 1 6 2. The commission shall consist of twenty-four members 1 7 jointly appointed by the majority leader of the senate and the 1 8 speaker of the house of representatives. The membership shall 1 9 include one student from each of the institutions listed in 1 10 section 262.7, subsections 1, 2, and 3, who is enrolled on a 1 11 full-time basis in good standing at either the graduate or 1 12 undergraduate level at the time of the member's appointment. 1 13 a. The terms shall be staggered and each member shall 1 14 serve a three-year term commencing May 1 of the year of 1 15 appointment. In making all appointments, consideration shall 1 16 be given to gender, race or ethnic representation, population 1 17 and demographic factors, and representation of different 1 18 geographic regions. All appointments shall comply with 1 19 sections 69.16 and 69.16A. If a vacancy occurs, a successor 1 20 shall be appointed in the same manner and subject to the same 1 21 qualifications as the original appointment to serve the 1 22 unexpired term. 1 23 b. The commission shall elect a chairperson from its 1 24 membership for a one-year term. The commission shall meet 1 25 annually and at other times as necessary. 1 26 c. All meetings of the commission or a committee 1 27 established by the commission at which public business is 1 28 discussed or formal action is taken shall comply with the 1 29 requirements of chapter 21. 1 30 d. Members of the commission shall serve without 1 31 compensation, but shall receive actual and necessary expenses, 1 32 including travel at the state rate. Payment shall be made 1 33 from funds available pursuant to section 2.12. 1 34 e. A majority of the commission constitutes a quorum. 1 35 3. The commission shall review the qualifications of 2 1 candidates for membership on the state board of regents. 2 2 Persons interested in serving as members of the state board of 2 3 regents shall make application to the commission, and, in 2 4 addition, the commission may solicit applications. The 2 5 commission shall consider and be guided by the following when 2 6 making recommendations: 2 7 a. The candidate's knowledge of and demonstrated interest 2 8 in higher education. 2 9 b. The need for balance of members interested in a 2 10 specific institution, including, but not limited to, former 2 11 faculty members or alumni of a specific institution. 2 12 c. The provisions of section 262.1. 2 13 d. Other factors deemed pertinent. 2 14 4. The commission shall submit to the governor at least 2 15 three but not more than five recommendations for each 2 16 appointment to the board. The commission shall forward its 2 17 recommendations to the governor by January 1 in the year in 2 18 which an appointment is due to expire, or as necessary to fill 2 19 a vacancy. 2 20 Sec. 2. Section 262.2, Code 1995, is amended to read as 2 21 follows: 2 22 262.2 APPOINTMENT &endash; TERM OF OFFICE. 2 23 Themembers shall be appointed by thegovernor shall 2 24 appoint a member to the state board of regents from among the 2 25 names of individuals recommended by the regent candidate 2 26 advisory commission, subject to confirmation by the senate. 2 27 The term of each member of the board shall be for six years. 2 28 The terms of three members of the board shall begin and expire 2 29 in each odd-numbered year as provided in section 69.19. 2 30 Sec. 3. INITIAL COMMISSION. Notwithstanding section 1 of 2 31 this Act, commission members shall be appointed to the 2 32 following terms: eight members to initial terms of one year, 2 33 eight members to initial terms of two years, and eight members 2 34 to terms of three years. The initial organizational meeting 2 35 shall be called by the majority leader of the senate and the 3 1 speaker of the house of representatives. 3 2 EXPLANATION 3 3 This bill creates a 24-member regent candidate advisory 3 4 commission to review the qualifications of candidates for 3 5 membership on the state board of regents. The commission 3 6 members are chosen by the majority leader of the senate and 3 7 the speaker of the house of representatives. 3 8 The commission recommendations are to be based upon the 3 9 candidate's knowledge and demonstrated interest in higher 3 10 education, the need for institutional balance, the provisions 3 11 of section 262.1, and other factors deemed pertinent. 3 12 The bill requires the commission to submit at least three 3 13 but not more than five recommendations to the governor for 3 14 each appointment to the board by January 1 or as necessary to 3 15 fill a vacancy. The bill requires that the governor select 3 16 from the commission's recommendations when making an 3 17 appointment to the board. 3 18 The bill provides language to stagger the terms of the 3 19 initial members of the commission and allows the majority 3 20 leader of the senate and the speaker of the house to call the 3 21 initial organizational meeting of the commission. 3 22 LSB 2243SS 76 3 23 kh/jw/5
