  1  1    Section 1.  Section 359.42, Code 1995, is amended to read
  1  2 as follows:
  1  3    359.42  TOWNSHIP FIRE PROTECTION SERVICE, EMERGENCY WARNING
  1  4 SYSTEM, AND AMBULANCE SERVICE.
  1  5    The trustees of each township shall provide fire protection
  1  6 service for the township, exclusive of any part of the
  1  7 township within a benefited fire district and, in counties not
  1  8 providing ambulance services, may provide ambulance emergency
  1  9 medical service.  The trustees may purchase, own, rent, or
  1 10 maintain fire protection service or ambulance emergency
  1 11 medical service apparatus or equipment or both kinds of
  1 12 apparatus or equipment and provide housing for the equipment.
  1 13 The trustees of a township which is located within a county
  1 14 having a population of three hundred thousand or more may also
  1 15 establish and maintain an emergency warning system within the
  1 16 township.  The trustees may contract with a public or private
  1 17 agency under chapter 28E for the purpose of providing any
  1 18 service or system required or authorized under this section.
  1 19    Sec. 2.  Section 359.43, subsection 1, Code 1995, is
  1 20 amended to read as follows:
  1 21    1.  The township trustees may levy an annual tax not
  1 22 exceeding forty and one-half cents per thousand dollars of
  1 23 assessed value of the taxable property in the township,
  1 24 excluding property within a benefited fire district or within
  1 25 the corporate limits of a city, for the purpose of exercising
  1 26 the powers and duties specified in section 359.42.  However,
  1 27 in a township having a fire protection service or ambulance
  1 28 emergency medical service agreement or both service agreements
  1 29 with a special charter city having a paid fire department, the
  1 30 township trustees may levy an annual tax not exceeding fifty-
  1 31 four cents per thousand dollars of the assessed value of the
  1 32 taxable property for the services authorized or required under
  1 33 section 359.42 and in a township which is located within a
  1 34 county having a population of three hundred thousand or more,
  1 35 the township trustees may levy an annual tax not exceeding
  2  1 sixty-seven and one-half cents per thousand dollars of
  2  2 assessed value of taxable property for the services authorized
  2  3 or required under section 359.42.  
  2  4                           EXPLANATION
  2  5    This bill authorizes townships to provide emergency medical
  2  6 care.  Currently, townships may provide ambulance service if
  2  7 the county does not provide the ambulance service.
