1 1 Section 1. Section 633.219, Code 1995, is amended by
1 2 adding the following new subsection:
1 3 NEW SUBSECTION. 2A. Notwithstanding subsection 2, a
1 4 parent who had no significant and meaningful contact with a
1 5 child as that term is used in section 232.116, subsection 1,
1 6 paragraph "d", subparagraph (3), prior to the date of the
1 7 child's death and who owed child support on the date of the
1 8 death shall not receive a share of the decedent child's
1 9 estate. The share of that parent shall pass to the other
1 10 parent or if there is no other parent, as otherwise prorated
1 11 in this section.
1 12 EXPLANATION
1 13 This bill provides that a parent who would otherwise be
1 14 entitled to a share of a child's estate, but who has had no
1 15 part in the child's upbringing, and who owes child support,
1 16 shall not receive a share of the estate.
