  1  1    Section 1.  Section 99D.22, subsection 1, Code 1995, is
  1  2 amended to read as follows:
  1  3    1.  A licensee shall hold at least one race on each racing
  1  4 day limited to Iowa-foaled horses or Iowa-whelped dogs as
  1  5 defined by the department of agriculture and land stewardship
  1  6 using standards consistent with this section.  However, if
  1  7 sufficient competition cannot be had among that class of
  1  8 horses or dogs on any day, another race for the day may be
  1  9 substituted.  A sum equal to twelve percent of the purse won
  1 10 by an Iowa-foaled horse or Iowa-whelped dog shall be used to
  1 11 promote the horse and dog breeding industries.  The twelve
  1 12 percent shall be withheld by the licensee from the breakage
  1 13 and shall be paid at the end of the race meeting to the state
  1 14 department of agriculture and land stewardship which in turn
  1 15 shall deposit it in a special fund to be known as the Iowa
  1 16 horse and dog breeders fund and pay it by December 31 of each
  1 17 calendar year to the breeder of the winning Iowa-foaled horse
  1 18 or Iowa-whelped dog.  For the purposes of this section, the
  1 19 breeder of a thoroughbred horse shall be considered to be the
  1 20 owner of the brood mare at the time the foal is dropped.  The
  1 21 breeder of a quarter horse or standardbred horse shall be
  1 22 considered to be the owner of the mare at the time of
  1 23 breeding.
  1 24    Sec. 2.  Section 99D.22, subsection 2, unnumbered paragraph
  1 25 1, Code 1995, is amended to read as follows:
  1 26    For the purposes of this chapter, the following shall be
  1 27 considered in determining if a horse is an Iowa-foaled
  1 28 thoroughbred horse, quarter horse, or standardbred horse:
  1 29    Sec. 3.  Section 99D.22, subsection 2, paragraph a, Code
  1 30 1995, is amended to read as follows:
  1 31    a.  All thoroughbred horses, quarter horses, or
  1 32 standardbred horses foaled in Iowa prior to January 1, 1985,
  1 33 which are registered by the jockey club, American quarter
  1 34 horse association, or United States trotting association as
  1 35 Iowa foaled shall be considered to be Iowa foaled.
  2  1    Sec. 4.  Section 99D.22, subsection 2, paragraph c,
  2  2 unnumbered paragraph 1, Code 1995, is amended to read as
  2  3 follows:
  2  4    To be eligible for registration as an Iowa thoroughbred,
  2  5 quarter horse, or standardbred stallion, the following
  2  6 requirements shall be met:
  2  7    Sec. 5.  Section 99D.22, subsection 2, paragraph c, sub-
  2  8 paragraph (1), Code 1995, is amended by striking the sub-
  2  9 paragraph and inserting in lieu thereof the following:
  2 10    (1)  Stallion residency from January 1 through July 31 for
  2 11 the year of registration.  However, horses going to stud for
  2 12 the first year shall be eligible upon registration with
  2 13 residency to continue through July 31.
  2 14    Sec. 6.  Section 99D.22, subsection 3, paragraphs a and d,
  2 15 Code 1995, are amended to read as follows:
  2 16    a.  Adopt standards to qualify thoroughbred, quarter horse,
  2 17 or standardbred stallions for Iowa breeding.  A stallion shall
  2 18 stand for service in the state at the time of the foal's
  2 19 conception and shall not stand for service at any place
  2 20 outside the state during the calendar year in which the foal
  2 21 is conceived.
  2 22    d.  Adopt a schedule of fees to be charged to breeders of
  2 23 thoroughbreds, quarter horses, or standardbreds to administer
  2 24 this subsection.
  2 25    Sec. 7.  Section 99D.22, subsection 4, Code 1995, is
  2 26 amended to read as follows:
  2 27    4.  To qualify for the Iowa horse and dog breeders fund, a
  2 28 dog shall have been whelped in Iowa and raised for the first
  2 29 six months of its life in Iowa.  In addition, the owner of the
  2 30 dog shall have been a resident of the state for at least two
  2 31 years prior to the whelping.  The department of agriculture
  2 32 and land stewardship shall adopt rules and prescribe forms to
  2 33 bring Iowa breeders into compliance with residency
  2 34 requirements of dogs and breeders in this subsection.  
  2 35                           EXPLANATION
  3  1    This bill makes several changes relating to the
  3  2 requirements to qualify an Iowa-foaled horse or an Iowa-
  3  3 whelped dog for pari-mutuel racing purposes.  These changes
  3  4 include defining who is a breeder for Iowa-foaled quarter and
  3  5 standardbred horses, modifying residency requirements for Iowa
  3  6 stallions, and mandating the department of agriculture and
  3  7 land stewardship to adopt rules and prescribe forms to verify
  3  8 residency for Iowa-whelped dogs.
