PAG LIN 1 1 Section 1. Section 724.22, subsection 3, Code 1995, is 1 2 amended to read as follows: 1 3 3. A parent, guardian, spouse who is eighteen years of age 1 4 or older, or another person with the express consent of the 1 5 minor's parent or guardian or spouse who is eighteen years of 1 6 age or older may allow a minor to possess a rifle or shotgun 1 7 or the ammunition therefor, which may be lawfully used only 1 8 under the direct supervision of the parent, guardian, spouse 1 9 who is eighteen years of age or older, or other person. 1 10 However, a minor who is fourteen through seventeen years old 1 11 may participate in an organized shooting competition, which is 1 12 recognized as such in the community, with the written 1 13 permission of the minor's parent, guardian, or spouse who is 1 14 eighteen years of age or older under the supervision of the 1 15 competition officials. 1 16 Sec. 2. Section 724.22, subsection 7, Code 1995, is 1 17 amended to read as follows: 1 18 7. ACCESS TOLOADEDAMMUNITION OR FIREARMS BY CHILDREN 1 19 RESTRICTED &endash; PENALTY. It shall be unlawful for any person to 1 20 store or leave ammunition or aloadedfirearm, which is not 1 21 secured by a trigger lock mechanism, or placed in a securely 1 22 locked box or container, or placed in some other location 1 23 which a reasonable person would believe to be secure from a 1 24 minor under the age of fourteen years, if such person knows or 1 25 has reason to believe that a minor under the age of fourteen 1 26 years is likely to gain access to the ammunition or firearm 1 27 without the lawful permission of the minor's parent, guardian, 1 28 or person having charge of the minor, the minor lawfully gains 1 29 access to the ammunition or firearm without the consent of the 1 30 minor's parent, guardian, or person having charge of the 1 31 minor, and the minor exhibits the ammunition or firearm in a 1 32 public place in an unlawful manner, or uses the ammunition or 1 33 firearm unlawfully to cause injury or death to a person. This 1 34 subsection does not apply if the minor obtains the ammunition 1 35 or firearm as a result of an unlawful entry by any person. A 2 1 violation of this subsection is punishable as a serious 2 2 misdemeanor. 2 3 EXPLANATION 2 4 This bill provides that a minor may use a rifle or shotgun 2 5 only under the direct supervision of the minor's parent, 2 6 guardian, or spouse or another person who has the consent of 2 7 the parent, guardian, or spouse unless the minor is competing 2 8 in an organized shooting competition which is recognized as 2 9 such by the community. The minor must have the written 2 10 permission of the minor's parent, guardian, or spouse and be 2 11 supervised by the competition officials. The bill also 2 12 applies the existing serious misdemeanor penalty for access by 2 13 a minor under the age of 14 to a loaded firearm to access by a 2 14 minor under age 14 to an unloaded firearm and ammunition. 2 15 LSB 1688SS 76 2 16 mk/sc/14
