1 1 Section 1. Section 232.22, Code 1995, is amended by adding
1 2 the following new subsection:
1 3 NEW SUBSECTION. 7. A child taken into custody as a
1 4 material witness or for contempt of court may be placed in a
1 5 juvenile detention facility. A child being held in a juvenile
1 6 detention facility as a material witness or for contempt of
1 7 court shall have all the rights of an adult being held as a
1 8 material witness or for contempt of court.
1 9 Sec. 2. CONDITIONAL EFFECTIVE PROVISION. This Act shall
1 10 not take effect unless an appropriation is made or is
1 11 specified which complies with section 25B.2, subsection 3.
1 12 EXPLANATION
1 13 This bill provides that a juvenile may be held in a
1 14 juvenile detention facility as a material witness or for
1 15 contempt of court. A juvenile held as a material witness or
1 16 for contempt of court has all the rights of an adult being
1 17 held for those reasons.
1 18 This bill may contain a state mandate under chapter 25B.
1 19 The bill shall not take effect unless an appropriation fully
1 20 funding the cost of this bill or specifying the state's
1 21 proportionate share of the cost is made.
