  1  1    Section 1.  WELFARE PROGRAM WAIVERS.
  1  2    1.  The department of human services shall submit a waiver
  1  3 request or requests to the United States departments of health
  1  4 and human services and agriculture as necessary to implement
  1  5 the changes in program policy provided in this section which
  1  6 may affect any of the following:
  1  7    a.  The family investment program administered under
  1  8 chapter 239.
  1  9    b.  The medical assistance program administered under
  1 10 chapter 249A.
  1 11    c.  The federal food stamp program.
  1 12    d.  Any other program with federal involvement which
  1 13 provides benefits to a recipient of the family investment
  1 14 program and which may be affected by the program policy change
  1 15 provided in this section.
  1 16    2.  The waiver request or requests shall provide for all of
  1 17 the following provisions:
  1 18    a.  The maximum grant payment amount for a recipient family
  1 19 whose eligibility for the family investment program begins on
  1 20 or after the effective date of the federal waiver shall be
  1 21 limited to the amount that would be paid to a family with two
  1 22 dependent children.  However, if any recipient family has no
  1 23 more than one dependent child on or after the effective date
  1 24 of the waiver and a second birth event produces more than one
  1 25 additional child, the family's grant payment amount shall be
  1 26 adjusted to reflect the actual number of children added to the
  1 27 family as a result of the second birth.
  1 28    b.  On or after the effective date of the federal waiver,
  1 29 the grant payment amount for a recipient family participating
  1 30 in the family investment program with two or more children
  1 31 prior to the effective date of the waiver shall not be
  1 32 increased to reflect the birth or adoption of additional
  1 33 dependent children.
  1 34    c.  On or after the effective date of the federal waiver,
  1 35 the provisions of a family investment agreement shall require
  2  1 that if a dependent child of a family investment program
  2  2 recipient does not regularly attend school, the recipient
  2  3 family grant shall be reduced by fifty dollars per month until
  2  4 the child begins regular school attendance.
  2  5    d.  As a condition of participation in the family
  2  6 investment program, a recipient who is the mother of at least
  2  7 one dependent child shall be required to utilize the Norplant
  2  8 birth control device following the birth of a second or
  2  9 subsequent dependent child.  The cost of the device shall be
  2 10 paid by the state alone if the cost is not payable jointly
  2 11 under the medical assistance program.
  2 12    3.  The waiver request or requests submitted by the
  2 13 department to the federal government pursuant to this section
  2 14 shall be written to apply each of the provisions of this
  2 15 section statewide commencing during the fiscal year beginning
  2 16 July 1, 1995.  However, if statewide implementation is
  2 17 rejected or the department determines that the federal
  2 18 government will not approve a particular waiver provision, the
  2 19 department shall modify the waiver provision to receive
  2 20 federal approval, or make any other change affecting
  2 21 implementation of a waiver provision under this section, and
  2 22 the department shall implement the approved or modified
  2 23 provisions in accordance with federal requirements.
  2 24    Sec. 2.  EFFECTIVE DATE.  This Act, being deemed of
  2 25 immediate importance, takes effect upon enactment.  
  2 26                           EXPLANATION
  2 27    This bill requires the department of human services to
  2 28 apply for federal waivers involving the family investment
  2 29 program (formerly the aid to dependent children program) and
  2 30 related human services programs.
  2 31    The waivers would affect family investment program
  2 32 recipients by limiting the number of dependent children used
  2 33 to determine the grant amount for the program.  For families
  2 34 who become eligible for the program on or after the effective
  2 35 date of the federal waiver the grant amount will be limited to
  3  1 the amount that would be paid to a family with one custodial
  3  2 parent and two dependent children.  For families participating
  3  3 in the program prior to the waiver effective date, the grant
  3  4 amount will not be adjusted to reflect the birth or adoption
  3  5 of additional dependent children once the grant size reflects
  3  6 two or more children.  However, if a recipient family had only
  3  7 one dependent child as of the effective date of the waiver and
  3  8 a second birth event produces more than one additional child,
  3  9 the family's grant size would be adjusted to reflect all of
  3 10 the additional children.  The waiver would also include in
  3 11 family investment agreements a requirement for reduction of
  3 12 the family grant by $50 per month if a recipient family has a
  3 13 child that does not attend school regularly.  The reduction
  3 14 would continue until the child begins regular school
  3 15 attendance.  Finally, as a condition of participating in the
  3 16 program a mother is required to utilize the Norplant birth
  3 17 control device following the birth of a second or subsequent
  3 18 dependent child.
  3 19    The department is directed to apply for statewide
  3 20 implementation of the bill's provisions beginning in fiscal
  3 21 year 1995-1996.  However, if the federal government rejects
  3 22 statewide implementation or does not approve a provision,
  3 23 approval is subject to modification of a provision, or other
  3 24 change as necessary for implementation, and the department is
  3 25 directed to implement the modified provision in accordance
  3 26 with federal requirements.
  3 27    The bill takes effect upon enactment.
