1 1 Section 1. Section 135I.2, Code 1995, is amended to read
1 2 as follows:
1 3 135I.2 APPLICABILITY.
1 4 This chapter applies to all swimming pools and spas owned
1 5 or operated by local or state government, or commercial
1 6 interests or private entities including, but not limited to,
1 7 facilities operated by cities, counties, public or private
1 8 school corporations, hotels, motels, camps, apartments,
1 9 condominiums, and health or country clubs. This chapter does
1 10 not apply to facilities intended for single family use or to
1 11 facilities operated by homeowners' associations representing
1 12 twenty-five or fewer dwelling units. To avoid duplication and
1 13 promote coordination of inspection activities, the department
1 14 may enter into agreements pursuant to chapter 28E with a local
1 15 board of health to provide for inspection and enforcement in
1 16 accordance with this chapter.
1 17 EXPLANATION
1 18 This bill exempts homeowners' associations which represent
1 19 25 or fewer dwelling units from the requirements related to
1 20 the regulation of swimming pools.
