1 1 Section 1. Section 598.35, Code 1995, is amended by adding
1 2 the following new subsection:
1 3 NEW SUBSECTION. 7. Notwithstanding the requirement for
1 4 establishment of a substantial relationship with the child
1 5 prior to the filing of the petition, the parents of the child,
1 6 whether married or unmarried, have not allowed visitation by
1 7 the grandparent during a period of at least three months.
1 8 Sec. 2. Section 598.35, unnumbered paragraph 2, Code 1995,
1 9 is amended to read as follows:
1 10 A petition for grandchild visitation rights shall be
1 11 granted only upon a finding that the visitation is in the best
1 12 interests of the child and that, with the exception of the
1 13 circumstances described in subsection 7, the grandparent had
1 14 established a substantial relationship with the child prior to
1 15 the filing of the petition.
1 16 EXPLANATION
1 17 This bill provides an additional basis for the filing of a
1 18 petition for grandparent visitation rights. The new basis
1 19 established in the bill is that the parents of the child,
1 20 whether or not the parents are married or unmarried, have not
1 21 allowed the grandparents visitation with the child for a
1 22 period of at least three months, notwithstanding the otherwise
1 23 applicable requirement that the grandparent establish a
1 24 substantial relationship with the child prior to the filing of
1 25 the petition. However, the existing requirement that a
1 26 petition be granted only if it is in the best interest of the
1 27 child is still applicable under the bill.
