PAG LIN 1 1 Section 1. Section 321.1, subsection 76, Code 1995, is 1 2 amended to read as follows: 1 3 76.A "special"Special truck" means a motor truck or 1 4 truck tractor not used for hire with a gross weight 1 5 registration of six through thirty-two tons used by a person 1 6 engaged in farming to transport commodities produced only by 1 7 the owner, or to transport commodities purchased by the owner 1 8 for use in the owner's own farming operation or occasional use 1 9 for charitable purposes. "Special truck" also means a motor 1 10 truck or truck tractor not used for hire with a gross weight 1 11 registration of six through thirty-two tons used by a person 1 12 engaged in farming who assists another person engaged in 1 13 farming through an exchange of services and includes a 1 14 commercial motor vehicle operated between the farms of the 1 15 farmers who are exchanging services. A "special truck" does 1 16 not include a truck tractor operated more than seventy-five 1 17 hundred miles annually. 1 18 EXPLANATION 1 19 This bill adds to the definition of special truck, a motor 1 20 truck or truck tractor not used for hire with a gross weight 1 21 registration of six through 32 tons used by persons engaged in 1 22 farming who assist each other through an exchange of services 1 23 and includes a commercial motor vehicle operated between the 1 24 farms of the farmers who are exchanging services. Current 1 25 law, section 321.121, provides that the registration fee for a 1 26 special truck is lower than that required for other trucks and 1 27 that in addition to a simple misdemeanor which is the penalty 1 28 for violating chapter 321, any person who is found to be using 1 29 a motor vehicle registered as a special truck for a purpose 1 30 other than as permitted in section 321.1, subsection 76, shall 1 31 be required to pay the regular registration fee. 1 32 LSB 1617SS 76 1 33 js/jj/8.1
