PAG LIN 1 1 Section 1. Section 294A.2, subsection 5, Code 1995, is 1 2 amended to read as follows: 1 3 5. "Teacher" means an individual holding a practitioner's 1 4 license issued under chapter 272, or a letter of authorization 1 5 or statement of professional recognition issued by the board 1 6 of educational examiners, who is employed in a 1 7 nonadministrative position by a school district or area 1 8 education agency pursuant to a contract issued by a board of 1 9 directors under section 279.13. A teacher may be employed in 1 10 both an administrative and a nonadministrative position by a 1 11 board of directors and shall be considered a part-time teacher 1 12 for the portion of time that the teacher is employed in a 1 13 nonadministrative position. 1 14Effective July 1, 1988, "teacher""Teacher" includes a 1 15 licensed individual employed on less than a full-time basis by 1 16 a school district through a contract between the school 1 17 district and an institution of higher education with a 1 18 practitioner preparation program in which the licensed teacher 1 19 is enrolled in any practitioner preparation program. 1 20 Sec. 2. RETROACTIVE APPLICABILITY. This Act, being deemed 1 21 of immediate importance, takes effect upon enactment and is 1 22 retroactively applicable to July 1, 1994. 1 23 EXPLANATION 1 24 This bill restores language relating to the definition of 1 25 teacher for purposes of the educational excellence program. 1 26 The language was struck from the Code in 1989 through the 1 27 enactment of House File 794, which established an autonomous 1 28 board to perform the duties of the board of educational 1 29 examiners and the professional practices commission. 1 30 Prior to 1989, school nurses and area education agency 1 31 professionals were included in the definition of teacher and 1 32 could qualify to receive Phase I, II or III payments. The 1 33 board of educational examiners issues letters of authorization 1 34 and statements of professional recognition to school nurses 1 35 who have at least a bachelor of science in nursing, school 2 1 social workers, occupational therapists, physical therapists, 2 2 hearing clinicians, and speech clinicians. 2 3 The bill takes effect upon enactment and is retroactively 2 4 applicable to July 1, 1994. 2 5 LSB 1463SV 76 2 6 kh/cf/24
